I has this problem last year - was driving me crazy. Turned out it was because I had a flat spot on my starter motor. New starter motor - problem gone.

Unfortunately its always better to get stuff like this in writing. But yeah - for $220, id just suck it up and move on. Legal fees and time will far outweigh getting your $220 back.
