Police Powers And Your Rights
Johnny Cash replied to Johnny Cash's topic in General Automotive Discussion
QLD MEMBERS: "Police Powers and Responsibilities Act 2000" seems to be a good place to look if you're in QLD: Link to the file should be attached to this posting. Section 29 - Searching vehicles without warrant Section 30 - Prescribed circumstances for searching vehicle without warrant (When they refer to "reasonable suspicion", it doesn't just mean the officer says so, there has to be something of substance to make that suspicion reasonable. He can't just have a hunch). Section 32 - Required to give Name and Address Section 33 - Prescribed circumstances for requiring Name and Address (Very important for officers that like to harass motorists!) Part 6, Division 1 - Worth a read. Section 51 - When Police Officers can stop you when you're driving your car. Sections 54 and 55 - Powers to search vehicles, and when. Part 6, Division 2 - When Police can tow your vehicle. Section 228 - Right to Remain Silent (worth a read) There's more to it, but thats a good hit up for QLD'ers! PolicePowResA00.pdf -
READ THIS FIRST!!! DISCLAIMER: Seeing as I had to open my big mouth, I'm going to try and compile a list of police powers and drivers rights. Will try to keep it as up-to-date and accurate as possible, but am not holding this information out as being reliable, and will not be liable for anything that results from using this information. I don't want to leave myself open to being sued for trying to help someone out (as I'm sure you can all understand). I studied police power and procedure a couple years ago, and hopefully still have something lying around that may come in useful... I will also have to find out if different States operate differently, and will try to start with my own State (S.A.) and work my way out. Will start with the basics, e.g. what you are entitled to tell police and do for them, what to look out for, and when to ask for a lawyer (which really puts the ***** up em!) Bear in mind, I'm not trying to train you all up to give police a hard time, just let you all know what your rights are, and put an end to the abuse of police power that occurs all too often. If you have any questions, or have interactions with a police officer that you want to explore with me, feel free to post in here. Will try to get something down in the next few days. Thanks for looking...

Courtesy of www.perfectrun.com.au APEXi POWER FC & FC COMMANDER This is a full-replacement computer, which can be just swapped with genuine computer and makes it possible to control high performance engine. Genuine computer doesn't have to be traded in when purchasing this POWER FC, so you can keep your original computer with you for the case of emergency. The ROM in the POWER FC has specially programmed data, which offers maximum performance to each engine model. This sporty engine management system programmed by APEXi is not only reprogramming the ROM but also it uses controlling system which is much superior to genuine ECU. Also POWER FC can be set to your own desired setting by just connecting the hand-held controller called FC COMMANDER. By reprogramming the each control MAP and data, POWER FC will evolve into the special computer that is programmed by you. Of course it's also easy to get back to original factory setting when needed. FC COMMANDER will show you three functions in the menu after powered on . Then you select one of the three functions, which is "monitor mode" for multi-function monitor, "setting mode" for programming original MAP and "others" for setting of each devices on the car. In the monitor mode, you can see ten kinds of reading such as engine rpm, speed, injector opening percentage, ignition timing, air flow voltage (or pressure voltage), boost, and so on. These data will be shown by the numerical value and also can be shown by graphical picture. For the other function, if you select MAP trace mode, you can trace the MAP of fuel injection and ignition timing. Each function is just controlled by pushing button on FC COMMANDER. In the setting mode, you can reprogram any setting for the engine, which are the change of ignition timing MAP, the change of fuel MAP, the correction of air volume signal of air flow metre, the correction of fuel injection interval, boost setting, the correction of the extra fuel volume for acceleration, the correction of fuel and ignition timing, the change of the fuel injection volume at cranking, the correction of coolant temperature, and the tacho setting. These factors can be changed or corrected very easily. Just select the point which you want to change from the MAP or graph and change it in the setting mode. And also you can control the boost with optional POWER FC BOOST CONTROL KIT.

Tell you what, I'm moving to Mildura (Vic) mid January, so if you hold out, I reckon I'll grab it sometime in February. $450 sounds good, so long as it stays in good condition (no dents, holes or whatever!) Thanks again, Adrian. -
OK, will do. I did a course on police power a couple years ago, should (hopefully) have it all lying around somewhere... As for our rights and freedoms under the Australian Constitution, things like freedom of speech and privacy are not specifically outlined or recognized, but are implied by the courts. It kind of gets hairy from here, but you have to understand that if these things were outlined in bold in the Constitution, there wouldn't be much room for argument. The reality is, the Constitution would not have any force if it was not a document of democracy and due government. As such, it draws its strength from these energies, and uses these underlying notions to remain in force. An example of this is section 51 of the Constitution (the one that lets Parliament make law). It states that: The Parliament shall, subject to this Constitution, have power to make laws for the peace, order, and good government of the Commonwealth... The bit about 'peace, order and good government' is not defined in the Act, but refers to these notions that found our Country and its legal justice system. Hope it helps...

Yeah, the success rate on referendums is something like 6 out of 42. Australian's don't like to change anything! Gee, that link is like first year law! I think all Skyline owners, and anyone who's into cars and cruising around, should get some basic legal knowledge, so you know what cops can and can't do. They abuse their powers so often it's not funny... But yeah, I am a lawyer. B)

Like I said, if you've still got it for sale in a couple months (which I doubt), I'll snap it up. Won't even haggle at 450! -

Johnny Cash replied to slyr32's topic in For Sale (Private Car Parts and Accessories)
Man, thats one nice f**ken exhaust!!! Wish I had the time and money, you should have NO problem getting rid of that. If, by some miracle, you still have it in a few months time, I'm snapping it up, no problem. Adrian. -
Hey, If the bonnet has NO damage or anything untoward, I'm willing to hit up $400 including freight to Adelaide, S.A. ? The trade-off is the money is ready and waiting, so it's all on you. Like I said, I don't want one with stone chips or anything. Seen some going around that need more work than they're worth, and people still asking $500+ Also interested in grill, but you don't seem to mention anything about it... If you're keen, e-mail on [email protected] Thanks, Adrian.

One went on eBay in vgc for $305 plus delivery, with no case warping or anything. So I think the 250 mark is about right. That said, I need to gather the dosh before formally making the offer. -

Johnny Cash replied to pyrofonic's topic in For Sale (Private Car Parts and Accessories)
Cool, Well, all things going well, I might be able to offer $250 with delivery, but no higher. Main reason being, I can get one brand new from Japan for $450 delivered. I figure second hand is worth around $300 - $350, and with the slight damage to the casing, around the $200 - $250. Might be wrong, and you're welcome to more if you can get it (obviously). Thanks either way, Adrian. -
I don't like the whole 'made in Korea' thing...

$350's a bit much considering the warped casing, that said, $250 would be nice! I'm not officially making an offer yet, as I'm still considering getting one new. I'll keep yours in mind tho - only hesitation is the fact that its had some severe heat damage... Good luck with the sale, Adrian. -

I can't imagine the intercoolers have the exact same mounting brackets on a 32 and a 33, and all the pipes line up exactly the same. There must be some difference between the kits, even if it's just mounting locations for the cooler. But, as always, I'm open to persuasion, if anyone has fitted a 33 cooler kit on a 32 directly with no alteration or modification, I'll concede. -

Bear in mind, it's not an open offer. If I don't hear from you soon, I'll assume you've rejected the offer - don't come to me in a year looking for 400 bananas for a front-mount!!! Thanks, Adrian. -

Gee, these 4-door boys are pretty sensitive! -
No luck, gave them an e-mail, they're guestimating between 300 - 400!

They can be given all the special powers they like, but our rights to privacy and to be able to conduct our various businesses without undue harrassment are constitutionally protected, which cannot be absolved by any law of this country...

Yep cool. Well, my offer is $400 which is to include delivery (approx $50), so the intercooler kit itself would be $350. If you can get higher, be my guest! Thanks, Adrian. -
Legally speaking, they have no right to just take your phone out of the blue, they need something to go on, reasonable suspicion to justify it. Otherwise, there would be no phone privacy or right to possession. It would otherwise be a contravention of justice, but thats a lawyer speaking. I guess, if you've got nothing sus, then you've got nothing to hide. But that said, they wouldn't have any natural right to take your phone, or any other property. If it had been me, I would have refused to hand over my phone, and see where it ended up! ...it's a damn shame being a lawyer...

I've added everyone in this list to my MSN, so if you hear from me, thats why!
