Who's your insurer, seems kinda dodge to get excess from you if you're not at fault and have the guy details. It's their job to track them down and sue them for the $$.
I had a similar thing happen but they guy had no insurance.
Just Cars has never asked for excess in any form in a no fault incident.

edit: actually I don't think they're naca ducts now I look at it, looks more like their designed to use the flow of air above the bonnet to pull hot air through it.

r34s rear quarters and rear window can be as dark as they are because it's a tint in the glass itself.
I got mine done at solace and the guy said that aslong as the window itself is tinted it's okay, it's tint films that have the 35% limit.
