Well, I'd like to see the specific legislation > I googled and all I got was some shite from transport SA and thats why i went and called holden hill to get their opinion. Can you please link to me the specifics? I know that if I had hit the cat, I'd be covered by my private comprehensive insurance, if not the 3rd party, but I'm still wondering if there isn't some kind of liability for a cyclist. I understand that if it was 3 lanes and not 2, and he was in a car, then it would be no contest... I'm just wondering if there is a diaspora between the interpretation of the law for cyclists in bike lanes rather than designated heavy traffic lanes - in part because the thing i quoted earlier says that cyclists and drivers share the road equally, that also meaning cyclists might NOT have to have any specific duty of care for the fact of them being more vulnerable. I do understand the point you made being upon this basis, but still.... I'm a little concerned that neither he nor I could see each other... Andrews advice to be supercareful is sage advice, but where does one draw the line? I make it a point to keep turnoffs free while I drive in peak hour traffic, should I therefore be liable for providing an avenue for another driver to hit a cyclist? Its a tough one ... -D

True that My mechanic's pissed off at a Skyline driver who keeps making noise near his property at one tree hill... he says hes getting sick of it and I told him to snap the dudes numberplates so I can post it up here in an attempt to name and shame I know a bunch of u guys are gonna say its pre judging an individual, but when my mechanic, who lives and breathes cars and racing, starts talking about people being blantantly obnoxious, I think I'd trust him over a random... he even said the guy told him "You're just picking on me because of my round taillights" and that people like him keep giving skyline owners a bad name, and I have to agree... I'm interested to see who it is tbh. -D -

Just rang holden hill. They said in such a situation I'd really only be in any trouble if I left the scene.... in spite of the car bisecting the road, the cyclist does have a duty of care to his own person and as such needs to exercise caution when riding, even when in a bike lane. Bloke said that in that situation theres really nothing definitive either way, and he said that if it got in front of a magistrate it would most likely be argued 50/50 at fault... Like u said Pete, it'd have been messy in court but tbh it makes me wonder if they considered such a scenario when making the bike lane - maybe if they put stripes in the bike lane wherever the sidestreets meet, but then again that might just lead to another sense of false security... -D

Neither. Transport SA was quite clear on this. He can argue that he has right of way due to the fact that he was going straight and that I was bisecting that lane however ; a) He was not exercising due care - zooming past stopped traffic at 50 kph is not safe - you would hope that a cyclist would exercise caution considering they dont have two lanes of traffic running alongside them - effectively shielding them from having to exercise caution when they go past a sidestreet b) He was not appropriately visible - therefore not my problem. Having considered this, I actually do wish I'd hit the twat, especially after the mouthful of abuse - If you don't want to get hit, slow the F*&K down. Bloody HOON cyclists. -D

Transport SA pretty much vindicates both of us in this scenario : Bicycles are classified as vehicles and therefore bicycle riders have the same responsibilities and must obey the same rules as motor vehicle drivers. Remember:You can be charged with a traffic offence in the same way as a motor vehicle driver. This includes incurring demerit points against your Driver's Licence if you hold one. You incur demerit points even if you don’t hold a Driver’s Licence (which can prohibit you from obtaining one). Although the law gives you the same rights and responsibilities as other road users, all road users may not be aware of this. You are more easily injured than motor vehicle occupants are and it is therefore safer for you to be highly visible and look out for other road users when riding. The law does not give anyone indisputable right of way. Do not assume that another road user is going to give way Some people will judge all bicycle riders by your actions. If you disregard the road rules, you can undermine the goodwill of other road users. -D

Speaking of cleaned up, I nearly hit some f**khead on a bike today. Was driving my brothers vitara and was in a slip lane to do a right hand turn into a sidestreet. Was on northeast road and the traffic was backed up and the two lanes of cars had stopped to allow room for the turn across the traffic. Anyhow, I'm turning in and this the sphincter of the universe flies past at around 50-60 and screams obscenities at me while I tap the brakes just enough to miss him, as he flies past. You'd think that cyclists exercise a little bit more caution, considering the bike lane is completely blind when the traffic is banked up (and the fact that the traffic was banked up for a good couple KM and the sensible drivers had left room for people to turn... Is it just me, or are all cyclists total wankers? -D
