Hi Guys, Ideally I would like someone who owns a R33 GTR to check this on their car for me please. The problem is that my panel shop repaired my rear bar, although I think that they haven't aligned it properly. I have attached photos for you guys to see what I am talking about below. Shouldn't Section 1 be flush with Section 2? Currently Section 2 sits about 3mm underneath the top, I am pretty sure this wasn't how it was before, can someone please check on theirs? Thanks

I Got Pinned For Not Having An Cat Converter
R33-RB26DETT replied to R33-RB26DETT's topic in Victoria
SITUATION UPDATE Today I received the letter from the EPA in the mail, its mentions that I will need to go in for "Emission Control Systems & Noise" Testing. Nowhere does it state that I will need to pay a fine of $1500 as the police officer originally stated, although it does say that I have to pay $74.90 for the test to be undertaken. (Non - Refundable). I called up the testing workshop today and he confirmed that I would simply need to make sure my car is stock and I should pass emissions and noise testing without any problems. He said its not a 'Lab Test', so I am just expecting a standard emissions levels check with exhaust gases and in the engine bay. Good news, and huge relief so far. I am getting my 02 Sensors fixed, New Cat Installed and leaking injectors fixed tomorrow to make sure my car is running perfect fuel mixtures in preparation for the test. Basically either the police officer was misinformed or simply trying to scare me when he said that I will be receiving a $1500 fine. Hope this helps out other people in the future, and i'll let you know how my car goes passing emissions. -
Just got it from Just Jap, same one in the first post. Hopefully its good quality, most people seem to think so, *fingers crossed*. I'll let you know how the emissions test goes.

Hi Guys, I am thinking off pulling out my leaking GTR Injectors and replacing the O Rings myself. Only issue is that i want to make sure that the actual housing of the injectors isn't cracked. After I have pulled out all 6 of them how easy would it be to see if one of them is cracked? Would they be visible cracks or would they be too small to see with the naked eye?

We'll I just purchased one now, and I'm going in for emissions testing in the next couple of weeks so i'll let you know how i go.

I agree with what your saying, I don't want to go down the path where I am contesting the officers judgement etc. I don't think that its the best way to go. I think I may just explain the situation to the EPA Officer and that the Roadworthy place obviously made a mistake passing the car. I think that I will need to approach the Roadworthy place and basically tell them that unless they pay the fine I will report them and they could potentially lose their license (which apparently costs $40,000). Also because the private seller got his dad to issue the roadworthy it would definitely work against his him. Hopefully they are descent enough to accept they made a mistake a pay the fine. -

They never even tapped it, since the heat shield is covering most it I doubt they could probably get enough clearance to do this. I was watching them very closely, I kept my mouth shut, was very polite and honest to the officers. He basically said that he could have defected as well if he wanted but since I was so polite and becuase he genuinely believed me that I had no idea and I bought the car in this state he was going to let me go with just the $1500 fine. I guess in one repect I got lucky, but still it doesn't seem fair that he can issue a fine without opening it up to be certain. Also, what's the probability that I will be required to do an emissions test as well? I am pretty sure he mentioned this but not sure. I haven't received the letter in the mail yet from the EPA, so I can't confirm the fine amount or whether I will be required to do an emissions test. Hopefully I dont get the fine, and I just have to show that I do have a Cat Installed. -

Yeah but this guy took photos at night time, with a digital flash, how good quality could they be? And there is a Heatshield covering most of it too, so its not all clearly visible. Id say that if i went to the EPA and said that I did have a cat, but the officer was a n00b and didnt know what he was talking about I could try and contest it. Then it would be up to them to prove that in fact it wasn't a cat. -

Yeah thats exactly what I was thinking. Although a high flow pipe with a straight though pipe appearance would be less likely to pass emissions. Therefore I may need to go an oval shaped design with a cermic core: http://www.skylinesaustralia.com/forums/Ca...ly-t244139.html This would help ensure I pass emissions testing. -

Thanks mate, Im in the East side of town and I am taking my car in to the mechanic this week to get them to look over it and fix my 02 Sensors in readiness for emissions testing. So I will know for sure then. The current pipe does 'look' straight through, as does this one in the below picture: The only difference between mine and the one in the picture is that mine doesn't have a slight buldge, it just runs straight the whole pipe with a much smaller bulge near the flange. -

Correct, I wans't 100% sure although I did suspect it a few months after a purchase the vehicle, in retrospect I should have got it checked and then fixed. But I thought since it passed Roadworthy it should be fine.. At least I didnt get the 10K Fine!! That would be seriously not good. -

Since this will most likely be going to court, I would rather not say specifically. Just that I was pulled over at the shops and got out of the car with my girlfriend, some guy was saying 'Nice Car' and thumbs up - then an officer came running over from the other side of the road and said bring your car over here mate where going to run through it. I did nothing wrong and was simply targeted because I drive an Import, its absolute BS. -

Thanks mate, yeah its totally unfair and a shitty situation since I was sold the car with a Roadworthy especially. If I had guttered it or installed it myself I would cop it sweet, but no way am I going to sit back and take this crap. no freaking way. -

I am not 100% sure whether I do yet. How can you be without opening it up? - WHICH THEY DIDN'T! This is exactly my point, how can they fine you with just looking at it and going 'You obviously dont have a Cat its a straight through pipe?'. It doesnt seem very fair. You would think that they would need to get the EPA to prove that its not a high flow cat since they didnt look internally or run any emissions tests. So that why I am think the Officer is just talking BS, and saying that I will receive the $1500 fine. -

Hi Al, Q) How old is the roadworthy? A) 5 - 6 Months old now. Q) Is the straight through pipe a bolt-on unit? A) Seems to be flanged, with a heat shield surrounding and covering the area. "If it is bolt on, the person that issued the roadworthy only needs to state that it had a cat at the tim of inspection and that the previous owner or yourself has fitted the pipe after the rwc was issued. Unfortunately you wont be able to prove other wise." You make a valid point, HOWEVER I know that I got screwed over because I never removed the Cat Converter. I know for a fact that it has never been changed since the time of purchase. Therefore I will threaten the workshop with a laywer and summons to court to pay the $1500 (if thats what it is). Also, the guy I bought it off got his dad's workshop to do the Roadworthy, so its pretty obvious his dad just signed off on it going 'she'll be right'. The fact is that they signed off on a Roadworthy Certificate which should NOT have been issued, therefore when I approach them they should pay up. Also I got a pre-purchase vehicle inspection from a Workshop in Melbourne who also didn't pick this up, and I have a detailed report from them too. So even they misinformed me... Its an absolutely F'kd up situation which is entirely NOT my fault. -

Obviously, I will need to install a Cat if there is not before I take it in to the EPA. My question was mainly regarding what the fine for this would be? $1500 Fine for not having a Cat seems outrageous! Just wanting confirmation from other members who may have been in a similar situation please. Also how can they prove that there was no cat converter in place simply from a photo? Surely they would need to be a more accurate test than just visual examination, for example what's to say its not a High Flow? Or can they just fine you $1500 without an emissions test and say 'You obviosuly dont have a cat, its just a de-cat'? Also, is it guarenteed that I will be emissions tested? Maybe they will just check to make sure that I do have a Cat installed when I bring it in? -
I got screwed over by a dodgy Roadworthy, and by my previous owner basically.. I got pulled over by police on the Weekend and they said that they where going to preform a roadworthy inspection on my car. They couldn't find anything wrong with my car EXCEPT, they say that I don't appear to have a Catalytic Converter, and said that I would receive an EPA Notice in the mail. They took a photo underneath my car of what appears to be a straight through pipe, and said I should be expecting a $1500 fine accompanied with an Emissions Test. Does this sound right? Is the officer talking BS? I cant find the amount for not having a Cat on the EPA website anywhere? Has anyone ever copped this fine before? How much should I expect to have to pay? Also, I bought the car without the Cat Converter and WITH a roadworthy. So its not my fault and I am going to contest this. I am going to sue the pants of the Workshop that approved it for Roadworthy!!!

Hi, I am just after some second hand stock GTR Injectors, my current ones are leaking, except maybe 2. If anyone is selling them atm please PM me with details. I will need to purchase within the next week or so as I have to clear a defect.
-
In relation to point 2. 2. I can contest the fine through EPA and write a very well written letter explaining that I purchased the car in the current state and that I should not be held liable. Also, how do they know its not a high flow cat? The police officer took a photo of it underneath the car at night for proof but never actually opened the pipe to check inside. For all we know it could just be a high flow cat? The outside of a de-cat and high flow look very similar dont they? Wouldn't it then be up to them to prove that its not a high flow? How can they prove that it wasn't a high flow from a picture? Couldn't I contest this? Then it would be up to them to prove it?
-
Again, thanks for you advice so far, im really pulling my hair out at the moment so i appreciate it! R31Nismoid you are always a gun, so your advice/input would be appreciated here... I am currently thinking there are two possible avenues to dispute this. 1. Since the car was purchased without a Cat & Roadworthy was supplied by his dad's workshop, I can try to contact the previous owner and tell him the situation and request that he pays the $1500 fine, or I will summons him to court. Hopefully he will do the honerable thing and pay the fine otherwise it will be difficult to prove this in court. I should not be held liable for this and its just so unfair!! I might go and consult lawyer, does anyone know any lawyers in melb that would specialise in traffic law?
-
Has anyone ever tried to contest these catalytic converter fines before and won? I have am telling the truth when I say that is how I was sold the car, but how can I prove it? Doesnt it basically come down to his word vs. mine? Also, thanks grantregarding the questions, yeah I thought I may need to fix the 02 Sensors. I think I am going to need to hire a lawyer to settle this matter as I am not paying $1500 for something I didnt do!!!!

I really need some help here guys, I got pulled over and informed that I dont have a Catlytic converter and that I would recieve a $1500 fine in the mail and that I would need to fix this up and take the car in to an EPA testing station to have this cleared withing 14 days. Now the thing is that its not my fault since when I purchased the car it came with a roadworthy certificate and I havent removed it since then. 1. Can I try and contest this, even though I purchased the car 5 months ago? I still have the original roadworthy forms etc. 2. Do I need to remove my Apexi Pod filters and place the stock airbox? 3. Currently my 02 Sensors are disconnected do I need to fix this in order to allow it to pass emissions testing? 4. I have leaking injectors in the engine bay, would I need to fix this as part of compliance with emmisions? I am really stressed about this, since the guy sold me the car without a cat convertor and with a roady, therefore and any help would be appreciated thanks.

I depends you cant tell till you pull them out for sure though.
