  6. Richard, if you read my post, I clearly state if his tyres were bald, he is screwed, the other issue he will win on no problems at all IF he told them he was on P's and nominated the vehicle correctly as a GTS-t and can prove it.
  7. people not knowing anything telling you too bad shit me. Your insurance company would have taken full details off you, asked you whether your were on P's and also what car you were seeking to insure. If as you say you told them it was a GTST (they should know it is a turbo) and that you were on P's then you complied with your obligation of disclosure to them. By them proceeding to take your money and promising to insure you as a driver in the nominated vehicle, there was consideration, and therefore a binding legal contract. Further they represented that you had insurance. With respect to the fact you are a P-plater and it is illegal to drive a turbo, they had a duty to act in utmost good faith and inform you of potential issues with the insurance cover including that it was a breach of their insurance policy for someone unlicensed to drive the insured vehicle - the fact they knew this, did not tell you and entered into the contract of insurance is clearly an implied waiver of that condition that they are now seeking to rely upon (not referring to unroadworthy issue at this point). If you were nominated as the sole driver then the Insurance Act prevents them from issuing the insurance in the first place! If your tyres were indeed illegal, then you are really in a world of pain because it is going to be more likely than not (standard of proof) that bald tyres contributed to the accident in wet conditions. If however the tyres were completely legal this is what you do immediately: 1. write to the insurer and tell them you dispute their decision and want it immediately reviewed through their internal dispute resolution procedures. Ask them to send you a log of the call that you made when taking out the insurance also. This should be on your file. Carefully check your certificate of insurance, it should say the type of car and that you are on P's. If they do not come to the party after that stop, you then complain to the insurance ombudsman and the department of consumer and employment protection. Finally if no good, you then sue them for: 1. misrepresentation s.53 of the Trade Practices Act; 2. misleading and deceptive conduct s.52 of the Trade Practices Act; 3. breach of Contract; and 4. negligence.
  8. Guys I have contacted the mat people and they know of Dave Grab and he has done 2 or 3 group buys so it could be genuine, would be good if the OP could tell everyone WTF is going on. The mat people are going to call him and kick him the arse

  13. Guys I have a set of four (4) Kruz K28's (also known as Boulders in the US) in full chrome for sale that came off my MY06 Nissan 350Z track edition (large brembos). They are 20 x 8.5 multi-fit PCD (so will fit skyline, commodore, falcon, toyota, mitsubishi etc). 2 of the wheels are in perfect condition, 1 wheel has some minor rash on the very extreme of the lip (been quoted to repair by Alliance rim repair at $100) and the one of the rims has taken a hard hit which I have been told can be repaired at a cost of between $150 and $200. These rims are currently at Bob Jane T-mart in Balcatta WA and I hope to pick them up this weekend at which time I will post up some pics. Two of the rims are fitted with 245/35/18 tyres which are on the wear markers, the other two rims are without tyres. Freight will be at buyers expense outside of WA and I think the cost will be in the region of $25 per rim to be arranged by the buyer but I can drop them to a transport yard if you want. WA buyers can pick up for free. I paid $650 per rim ie $2600 for the set) and I am willing to let all 4 go for $1,000 in AS IS condition given 2 are perfect, one is slightly rashed (about a 1/5 of the circumference of the outer ridge) and one is damaged but capable of repair). I thought i'd post them up here before i whacked them in the local and on ebay. If you are interested, please CALL ME on 0438 942 693. here is a pic on the car: cheers Simon
