hence the point i was making about doridori32 having no idea, he cant sue anyone for defamation, well not in QLD, because it satisfies a defence to state that it was: 1)true and 2)in the publics best interest to know obviously case by case its different and the interpretation of the law can differ but as a general statement i think its safe to say, that stating to be weary of dealing with doridori32 or mines_datsun etc, is ok.

reminds me of my what happend to us once. We own a retail store in a shopping complex. Out the back of the warehouse we have some designated carparks that we park in. My mum had just got a new rx8 and it was parked there, for some reason they had to spray some loading bay thing on the road out the back of the warehouse so they proceeded to go about marking the area off and lay the stencil thing down. They started spraying and I happend to be going to get lunch. I walked out and im like wtf are you doing, theyre like spraying the road sign thing, im like its going to go on those cars and they shrugged as if to say who cares. Im like thats our car, its parked in a bay allocated to our store surely you could have asked us to move it. Hes like oh sorry, then started spraying again, so i moved it. What an idiot...

by all means correct me if im wrong Gojira but as i have studied this law and seen it practiced in the past this is the way it has played out. Perhaps there can be many interpretations of this law..it wouldnt be a rarity.

I also have experienced this law, fist hand. In a swimming pool case, the client had a pool installed that didnt meet the artificial rock look as promised by the pool company, it was dodgy and looked completely fake, there was white stains all over it caused by chlorine...(which wasn't supposed to happen) The client had bad mouthed this to a few of her friends and they expressed their concerns with the pool company upon buying the same product. The pool company sued the client for defamation and it was thrown out of court as the statements made by the client were proved true and in no way misleading, hence legal.

ummm....not exactly, i know im only a law student but the law of defamation isnt that extensive and you cant sue someone for defamtion if theyre simply stating something thats true about another. Defamation for damaging somones reputation is sought only if the person has stated untrue or misleading things that have lead to the damaging of the said persons reputation. If the statement is true, however it damages the other persons reputation, your still allowed to say it. Just like if a company sells you a dodgy car, your allowed to go to a current affair and have a winge..extreme example but it illustrates my point.

yea i hear he works for mines, dori, dodgy and co. whilst they arent certified and have no idea wtf they are talking about, they'll sure as hell offer advice for anyone whos willing to pay. When the advice turns out to be wrong they use their moto "you didnt need that anyway, its not my fault im dodgy" as a copout.

like i said dunno exact details but thats the jist of it..he was being a tool, bad luck, he crashed his commo. sounds harsh but thats the way it is...if i was racing past a commo, slowed down and tried to do skids on a highway, then raced past him with people yelling random crap and then i crashed...well im sure its a no brainer that i would receive no sympathy from the commo driver. Hence i give no sympathy to him for doing it to a skyline...sure it sucks what happend but thats the risk you run of doing what he did.

The point isnt whether the pump was adequate. I know it may be hard for you, but try and build a picture for yourself.
