Stall, time is your friend. Stall as much as you can, for as long as you can. Under no circumstances do you want to go to court while you are still disqualified. The record I have seen is 2 years, it was hard work but it was done.

If you do get a summons, wait until about a week before the court date and then request an adjournment at the local court house. The idea is to stall until you get you licence back, the golden rule is don't get busted for anything else when you do get your licence back. Then get you boss to write a note saying that you HAD to work. Get a copy of the bus and train timetable showing that you couldn't get to work without driving. Obtain a copy of the act removing the "drive for work rule". Submit it all as evidence, say you have learnt your lesson, you have been a good boy since you got your licence back etc etc. That's why you stall, so you get a clean driving period.

Then cop whatever the magistrate hands out on the chin. Whatever you do don't EVER drive without a licence again, you will go to jail.

They usually ask to see your drivers licence.

In NSW they just check that you have it on you... they don't run it on the system or anything so you would have to tell them you where suspended for them to know lol!... most of the time they ask if you have it and if you say yes that's enough, they don't even wanna see it.

The offence is from the date of the offence not the date you are sent the infringement.

so that wont work

and also, in VIC the judge will tell say you should have thought about it before you where speeding, you cant get anything to drive to work and back anymore.

I would say, not to sweat too much about it, as it wont change the outcome of the day, for simple offense like driving whilse suspended, isn't a big deal, you prolly get a junior prosecutor up there trying to sent you to jail, but it depends on the mood of the magistrate on the day, sometimes you get your license back and some time you end up walking for a fair while, but going to jail for driving whilse suspended is unheard of with our legal system and i beg to be proven wrong. ppls who get sent to the slammer for that very offense prolly has already had an illustrious driving record. ie. Dui on multiple occasion and stuff like that.

So don't panic and just go on with your life as normal and don't be silly the next time. Get a pushy if you really have to.

Mate unfortunantly i have a shady driving history and i can tell you now if he didnt give you anything and you didnt sign anything your sweet.

I think the copper you got was a decent bloke and that was his way of punishing you by making you sweat.

I wouldnt stress over it. I got a court notice that had wrong apperance date and had my name spelt wrong. I got off scott free. So you think you have dramas?

Couldnt be bothered reading everything but if the officer was very polite about the manner and you were too and he didnt give you a fine or a CAN then usually this is when they turn the blind eye and let you go with you still leaving a stain in your pants. :)

My friend lost his licence. So before he went to give it in he went to vicroads and said he lost it. They gave him another one. He payed like $20, handed that one in and kept his original one lol. He still drives everywhere though. He is lucky so for.

This happened to me.

I got myself a bloody good lawyer and the end result was just a $700 with no extra suspension, however my reason to drive whilst disqualified was somewhat of an emergency.

I think the excuse of getting to work wont get you off on this one. They'll use the argument that the detriment to work was the concequence of your offence.

Good luck mate, your end result will depend highly on the judge's character and attitude aswell.

He is trying to say that it will look a lot better if you have at least a short period of good driving to back up your statements of "I'm a good boy your honour" .

And then you can also claim that you need your license for work, but you can't claim that if you are still suspended.

my good mate just recently got caught driving to work while he was on a 3 month suspension. He went to caught saying that he really needed to get to work as he missed the bus etc... and expected to get a 6month suspension at the worse and the dumb f**k qld judge gave him TWO f**kING YEARS on suspension!!! so my balls would be in my throat if i was you.

no jail but not having a licence sor two yrs is nearly as bad, lol
