Bad news mate.

Totally his fault.

You wouldn't leave it running - esp at GTR!

Sunshine is full of junkies and dodgy people, so anyone in melb would know better than to leave a car running.

Either the guy is thick as 2 planks or his mates stole it.

Either way, I would get the law chasing him down.

Yeah i am not sure if the car is still around i hope it is he operates down in tasssie but i think stores cars next to this place a High Performance Nissan Mechanic down that road called 'Nismo' so mite be in your interest to inform them also, if any GTR parts come up for sale.

Yup. As has been said, go through your contract. If you don't have an eye for detail, for find the most anal friend you have and get them to help.

And go to the cops.

Don't post an address publicly. It may not help legal proceedings (if there ever are any), and probably open you up to litigation.

still, go over the contract, be technical. If you didn't get the car, HE broke contract...

...not to mention, he is an idiot. Whether or not he did it, what an idiot.

see if you can get a hold of (or make sure the servo doesn't destroy) the tape of the incident, even if you can't see anything.

find every receipt, save every email. Its not every day that you get to say goodbye to.... what, on the order of 10K? to much to lose because of an idiot like that

Shop is not Nismo, it's actually Nisma(legal reasons) and i have never been impressed with the owner, heard a few things.

When you said Sunshine, private importer, i had a bad feeling it was him :unsure:.

Close enough to my house so i'll drive past and have a quick glance. Car looks very distinctive with those rims.

i wouldnt bother looking for the rims on the car Al if u do go past be more on the look out for the marks on the body... the scuff marks on the paint and the rear bar with the flame plate on it

just reading all these posts and --- FARK! thats totally sh&t.

its a total bs story and gonna be hard to track down. I would be doing what everyone has suggested ASAP i.e. call the cops and tell them the full story. Write down all events for later reference. Also look at the contact...its pretty likely that without delivery fo the car there is no deal and I find it unlikey the guy can argue the situation was "out of his control" The fact the battery was flat etc seems all too convienent...and the cops will be right onto this.

Go see a proper solisitor/lawyer and get things going against the importer now...there is no way he is gonna give u back the cash without a fight. And u might find there is some out clauses in the contract also esp. for this situation - they might be the dodgy brothers.

totally bad luck mate. I'm sure evryone here will help u out if u need a hand or advice...

bad news.

that's some nasty rust in the driver's side rear quarter panel (in front of the wheel)...

if you can get the cash back might work out better so you can get a better example!

Yeah with the servo tape the police looked at it but i am not sure if they made any copys of it and it was on friday so they might of recorded over it i will have to get hold of bp in mcintyre road and ask the cops might have it not sure.. I just think it was really bad luck on his part but he knows he has to hold his own on this contract so he is dropping off this R32 gts-t to drive till he gets this other gtr ready for my by the 6th of august or give me the full amount of money back..

dont servo's have camera's absolutely everywhere? This is a $20K car not $30 bux worth of juice... Surely your situation is slightly more important...

Yeah mate i know plus all the interest i am paying on this loan is f**ked sorry about my language but it isn't a cheap exercise.

If it were me, I'd ask for all monies to be returned and change importers. Don't settle for some car this shonk choses, chose your own.

He was neglligent in his duty of care and therefore the sole responsibility lies with him. If you need to pursue this legally, you will be guaranteed of a win.

Na i won't it has to be as good as my other one if not better but yeah i will not settle for something way less value i will get my money back rather then have a car and just start over again.

Been keeping an eye out the last few days. Nothing so far.

No parts have come up either.

In a legal sense, as long as you have a contract proving the agreement, you'll be ok, under the laws of Contract and the principles of Negligence would also apply here. Worst comes worse you should be able to get your money back (assuming this dodgey importer guy has money.)

Sorry to hear about this, the circumstances certainly do not add up.

But I notice you only joined up after it happened.

Too bad you did not get on here when you were only thinking about getting a Skyline and possibly get some good advice before buying.

We have to get the word out to more potential Skyline owners somehow via some free media exposure of a positive kind :wub:

Something like the Bikies doing the Kids Toy Run etc.

- That must be the reason they can ride around making 120db from the exhaust and you never see them pulled over.
