Somone was telling me that police officers had to pull a driver out of his GTR valued at ($100k) according to the news, so i am assuming its an R34. He was a repeat offender for speeding and had his car permanantly confiscated due to the new Hoon laws in Victoria.

I dont know how exactly the story went so any corrections would be great.

What do you people think about these confiscation laws?

i don't think normal speeding counts. if you get caught doing 65 in a 60 zone i don't think they would confiscate your car, unless you were also doing stupid things. it would have to be well over the limit. and you would've had to have had the car impounded more than once. the first time is is either 24 or 48 hours, the next is a few months, then indeffinately. i know that if i got my car inpounded i'd be behaving myself afterwards.

i think it is good in the respect that it gets some hoons out of fast cars for a little while, but bad in the respect that if you owe 20,000 on a car and it gets taken off you, you have to keep paying it off, and try to save up to get a new car at the same time.

also if the car is under finance, and it gets taken off you then the finance company tries to reposses the car they are going to lose money if your car was your only valuable possesion.

i don't think they sell them in the same state though. they usually take them to a different state.

any more info on this guy? i found out a few months back from a good friend that his cousin had a 32 GT-R, total value ~120 grand. i saw ma mate again yesterday for the first time in ages, and asked him about it, he said it got taken off his cousin... could be him. i really cant remember, but for some reason i get a feeling he was from werribee area...

I don't think it normally works like that, ie. they take the car of you on the spot. First offence the car gets clamped on the side of the road, second offence you get a letter and you have to take the car to the closest police station by a certian date(think it can also work this way with the first offence) and for them to actually take the car of you (third offence) they have to take it to court etc. so it would be a lengthy process from the time of being caught to the time of loosing the car......Think the story is probably a little made up by someone

As for speeding offence I think it was 45km or more over the limit for it to be a hooning offence

how does it work for the fourth offence? do they take your car again staright away, or does it go back the start, and u have to get caught another 3 times for em to take a second car?

Would imagine it goes back to the start, to get caught a fourth time though you would have to have more money than sense......

how does the hoon law exactly work? 1 question no has so far answered is do the three strikes stick to the car or your name?

e.g i got hoon law busted twice in my gtr, then i went out and bought a $500 vl and got busted a thrid time.

do they take the vl as a third strike, or does the vl get a 1st strike?

after the third strike do your strike get reset back to zero?

actualy the car IS confiscated and impounded for 48 hours. if its over a weekend then it is 96 hours. plus a $400+ tow and impound fee, plus the fine for the offence.

You get the third strike. My dad is a police officer and said they took away a driver's wife's company car. So it doesnt matter what you drive. You get the strike, and whatever your driving gets impounded, on the spot.

the 3 strikes stick to your name. if you dont get that last bit, i think it was 'the third strike for that hoon happened to be when he was driving his wifes company car, so the police comfiscated that'.

and as you said phatr32, if u get done for 'hooning' in you nice 32/33/34 gts/t/R, then go buy a VL for $500 (maybe for a good one...) and go start laying black lines out front of a cop shop, then go drive the skyline till you get two more strikes up, spend another $500 on a VL, and your free again, although i suspect you wouldnt have a licence by that time anyway

another thing i think alot of people dont see, is how many highspeed chases there are going to be now... i mean, if you own a 34 GT-R for example, if you've had it more than 12 months, odds are you payed 70-100k+, and i bet you've 'hooned' more than 3 times around the streets before, remembering that its at the discreition of the cops if you are hooning or not.

now if on your third strike, say you were caught racing, when you see those blue and red lights in your mirror, and realise that this person is about to take away a minimum of 60k of your money, which you will never see again, you're going to try and avoid that. now take into consideration that you have a much faster car than the cop, then take into account that many people think they are a race-car driver... and here we have a massive increase in high-speed chases, and probly more of the tragic accidents that are supposed to be prevented, whether or not it will be less than the number of deaths from 'hooning' will be interesting to see.

and more-over, it wont even be GT-R/Porsche/high end car owners doing runners, it will be bogans in the $500 VL that i want to buy after the first two strikes my skyline... seriously though, i dont actually own a skyline....

Agreed. But serious, i think the law is fair. If you hoon, you pay the penalties. I've had a R32 GTR for 6 months now and i seriously drive it like a baby. I got pulled over on the 2nd day after i got it for a "random" inspection, but had the RWC on me so nothing happened. Then i've never been pull over again because i don't try to seek attention towards by self.

You get busted for "hooning" 3 times and you loose your car, yet drink drivers can keep getting busted and they do not loose their car ?

although this scenario is a possibility, i couldnt see it as an event that occurs regularly. i mean unless your new R34 gtr isnt registered id say logic states that its as simple as the officer writes down your rego plate number as you try and loose them?

with this in mind who would try and escape the officers wrath?

and also- dont police cars have video cameras?

story cant be true, officers dont have the power to permanently confiscate the car, only the judge does, so it would most def have to go thru a court first

no, they don't have the power to permanently confiscate the car, only the judge does, but they do have the power to kick the driver out of the car and have it towed to the impound yard until the case is heard in court.
