Has anyone filed a written complaint against this officer?

that will all be delt with after the court case.

have to give the evidence we've gathered that the car he defected me in is not defected.

once this is done, we then have a court case against this cop to present to the department we would make the complaint to that he lost cause of the fact that the car he defected me in is actually not defected nor requires a modification plate.

i'm sure if i make a post on a few other forums that i could get together a few people who have been picked on by this cop to all make a complaint along with mine which will help.

however, we have other issues to deal with first.

so, best to deal with one thing at a time.

why did you agree to open your bonnet for the cop, if i was asked i wouldn't, and i would leave him alone with my car while i went inside.

but anyway, good luck with it all, i hope this little piggy goes all the way home lol.

This guys actions border line on Harassment & if you are proven to in fact have no legal defects in the court of law I sagest that you smartly slap a harassment complaint on him and then tell them you want something done about this ass.

I hate cops who do that shit

Nice work, best of luck! Stories of cops raping people with ridiculous fines are very common, but it's not often you hear of anyone successfully fighting them... let's hope this one ends happily and fairly.

Sounds like this cop should be permanently on desk duties in a department as far removed from traffic and vehicles as possible.

Good luck mate

As I recently been reamed myself by QLD's finest wanker cop (thats what I call him) - officer M. Little (first name Michael) for stupid reasons listed on the defect notice, i'm in the process of actually taking my 2x fines and defect notice through the courts.

As the story goes....

Was standing at BP fuel station filling up on Logan Road at Underwood area and I asked the cop as he was walkin back to his car after paying if he was a traffic cop. I then proceeded to ask about the new laws that they are bringing in, in regards to people under the age of 25 not being allowed to have a high powerful car such as these imports, etc.

Of course the wanker decided to be breif and quick to answer the question along with wanting to jump to every cops favourite question "can you pop the hood so I can have a look?".

ever heard the expression, "let sleeping dogs lie"? seriously, why would you bother asking a traffic cop about the new laws for P platers? its like poking the sleeping dog with a stick...

Fact that I didnt think this cop would of been a complete and utter wanker and that like some cops, you can actually talk to them without havin to worry about them askin to go over your car.

It is however, cops like this that do put the local community off talkin to them. Since this, i've not had any respect towards a cop.

Don't forget to attend to the cost of going to QLD transport. Make sure you go through small-claims and take it out of his pocket and not through QLD Police. It makes people responsible for their actions if a bad call costs them money.

After talkin to dad about this. Its goin to be a bit hard to do this unfortantly as he did it while on duty which makes QLD police responsible for his actions.

I have heard that, but if he's been knowingly told to stop pressing on with these random fines due to his lack of knowledge, then it's in his lap. QLD police have made their position clear to him, so then it's down to abusing his power and knowingly depriving someone of money. QLD police aren't in a position to know if he's still doing it as most people cop the fine, have a whinge and don't take it further.

If he's acting unlawfully then QLD police won't have a bar of it when it comes down to recouping money, they'll actually advise you to take it to small claims. Unfortunately they can't be fully responsible for the actions of their employees, much like health and safety is down to the individual. Companies aren't liable for unsafe acts of their employess.

We shall see how we go.

But a complaint will be laid and a request for the money spent in regards to this cop will be requested to be refunded in full.

- $80 odd $$'s for goin into the inspection station.

- $50 for the DB testing at right price exhaust.

- $40 to request for a full written history from QLD transport of the car from the day I went to the inspection station (evidence for court).

- then there is court fee's on top of this (around $130 i think) which will be dismissed when we win the case.

$170 already spent on this case.

now, if my father wasnt a lawyer or a friend wasnt and had to pay legal fee's, this is where the big cost would come into it.

simply, i could be lookin at anywhere between $3,000 - $10,000 in legal cost to fight this matter.

of course, if we take this through the small claims court and sue the police officer personally for this matter, then we can include the cost of my dads legal fee's into the requested amount back not leavin my dad a dry pocket.

Good lawyers don't have dry pockets :D

Good luck with the case though! :)

dry pocket as in, fact that he's not chargin me for this but can recoup the cost of his time through the small claims court if i put him through it for reinburstment of everything.

When's your court date?

Does the officer have to be present?

Good luck, keep us posted.

we've sent the fines in and they are yet to issue a date for the court hearing.

no, the cop doesnt have to be present which if he doesnt appear, i've instantly won the case.

Interesting read. Good luck with the case, I’ve been going through rubbish like this for about 4 years, something like $25k+ in legal fees later.

One thing to remember if you’re going to make an example of the Police officer later on though is, it will come back in bite you hard. It did for me (then again I live in a small town not in Brisbane).

Basically it’s on going issues with the original officer I brought down, now all his Police buddies are pretty much out to get me, and do – Thus I’m ALWAYS in court with fines, win and then humorous cycle of complete BS happen's again with result in another ticket, then court.

I get along OK with the Senor Sergent, and first hand information was “ The guy’s think your nothing but a smart ass, they want you, your license or your cars for keeps, I suggest you play it my way or you can deal with them”

Despite the above however, I’m actually in the process of trying to take a more recent innocent to task, and having the officer put up for harassment and sued due to loss of income from the stress created.

Before all the legal “newb’s” jump on a bandwagon who don’t know me, it’s not really whether I win, as I’m aware I don’t have decent grounds to sue, it’s more the principal, and I want to waste his time. That and money really isn’t a concern.

Why not ask? I assume it was a genuine question. “Baiting” Police shouldn’t effect the officer’s judgement when issuing a ticket, although we know it can and does.

What people fail to remember is, they are nothing more then public servants who enforce the law, and have guidelines they need to adhere to as well.

Fortunately for us, they always have their tape recorders out, and if the officer appears to have bitten the “bait” chances are they back down. The last thing the Queensland Police need is taps released to ACA or Today Tonight.

3 of my case’s were dropped by the Police due to this, and their poor attitude, tone in which they spoke to me and the swearing they had used towards me.

Josh is so right about the public servant thing! I am involved with inforcing of non enditable offences and I would love to be able to say what ever I want! But the truth of the matter is you have to be really really careful, Many of the same rules apply to the police too it is just that many people dont know what they are and arent allowed to do!

Further to the taping thing...If an officer is talking crap to you and giving you attitide dont be afraid to pull out your recorder (Many peoples phones will have a recording function) and watch them back down! And they cant stop you as you are allowed to record any conversation that you are privy to.

Why not ask?

because its pointless. what's it going to achieve except unwanted police attention? of course, if you like stirring them up and going to court to defend it later, go right ahead. i can think of better things to do with my time and money than pissing into the wind like that.

It was not my intention to stir anythin with the cop. it was a simple question aimed at the cop requesting to know what is going to happen to those who already own a performance car under the age of 25. The questions were being thrown around on forums before I asked and no one didnt know the answer and I thought asking someone who would be involved with the new law coming in (a traffic cop), he'd know the answer to my question.

If i wanted to stir trouble, I would of asked other questions in regards to something related to a "hoon"ing issue.

    • OK, that is a helpful description, because that sounds exactly like a bleeding issue in the clutch....these are hard to bleed manually even when the damping loop has been removed. I'd suggest bleeding again....start by filling the master cylinder up and opening the bleed nipple. Come back and check every now and then that the master cylinder is not empty. Let it gravity bleed for a few hours and see if that improves
    • I replaced the whole clutch line with the chase bays braided hose, I think it removes that loop, is it the short hose that comes immediately off the slave or is there a drawing in the manual to find what you’re referring to? It was just re-bled when I upgraded to the nismo slave, old slave worked fine but I thought that might help, didn’t change a thing. It’s like the first half of the pedal is pushing air and then when it finally actuates the master the friction zone is tiny. Makes it practically impossible to launch the car
    • Yep, that was one of the things we learned fast in the past with our MX5. When you drive with the top down, you are effectively standing out in the sun, 100% of the time, and not getting in any shade (because roads aren't shaded generally!). Just like standing out in the middle of a field on a sunny 27C day is a bit of a bad plan, so is sitting in a MX5 without sun protection.
    • I also just ordered some Frankenstein bolts and side mounts to fit a hard top Just in case I do find one, basically so it doesn't need to be fixed to the car with only the front latch.......and then gaffa tape to keep it in place for the RTN journey from wherever I get it
    • If your temps are fine now, you probably won't have any issues with where your vents are as they don't look right up at the windscreens high pressure area, so any differences when giving it the beans for extended happy laps would be minimal, but, they should vent heaps when stuck in traffic  Much like how that reverse cowl on my SS let "visible" heat out when stationary, but, because it was basically at the windscreen my coolant temps on the Hwy actually raised because air was being fed into it at speed (110kph), to only come back down to around 90° when I got off the Hwy And your 100% correct about the NC currently not needing vents, but, if I was to add a turbo, and a oil cooler and intercooler in front of the condenserand radiator, and then take it to the track???? It is apparently a recommend requirement if I don't want to worry about coolant or oil temp issues, but, any of the above are possible scenarios, over time As it sits now, with the triple pass radiator and stock air conditioning system, I have absolutely no issues with either temps or air conditioning efficiency, I've been basically daily driving thie car for the last month, both on the Hwy, and peak hour, bumper to bumper traffic, but, that's pretty much expected from basically a standard engine  Talking about no issues daily driving, it was 39° the other day and I was sitting in bumper to bumper traffic on the M5 and then M7, with the top down, and with the air conditioning blowing nice cold air on my feet, balls, and face, well, there was one issue, my head and arms got pretty sun burnt Note to self: leave a hat and sunscreen in the car for such days 🤣
