Any1 Not Pay Up @ Fault Insurance Claim?

Just gota phone call from AAMI saying i owe them $1300 for an accident that happened last week. I tapped a lady that hesitated pulling out onto a main rd. causing a few scratches around her crappy corolla number plate, fair enough my fault, i told her 2 call me once she got a quote 4 the damage, thinking we could settle on $500-600 cash. 9 out of 10 ppl would have taken that amount of cash 4 the amount of damage considering the damage done. She went straight 2 the insurance company. SERIOUSLY 2 scratches done 2 my flimsy fibreglass front bar couldnt have damaged much, anyway my question::

1.Has anybody not paid up and delt with the consiquences??

2. When you have an accident with AAMI they make you get 2 indipendent quotes from their repairers, Can i demand 2 see these 2 quotes via fax before i pay up??

3. Cocky insurance salesman threatening me claims 2 charge me $4500 if i dont pay get a court order 2 automatically take it out of my pay and ruin my credit rating for life if i dont pay within a week... Is he trying 2 bluff me??

4. Towards the end of the phone conversation he claims the car is already being fixed, how can it be when they havn't even contacted me 2 confirm who was at fault, she could have just as easily given a bogus story or tryed 2 reverse back after sticking out into an intersection, pretty far fetched i know, but it could happen..

if you lightly tapped my car and there was 1mm of damage id still be telling my insurance and getting it fixed regardless of the cost to you..

btw.. #3 is true, they can take money out of your wages after they sue you.. but would take abit longer than a week

So just give them your insurance company details.

Then your insurance company will send you a bill for your excess.

Either that, or pay it in cash. You get to choose, but either way if your at fault your paying for it.

I think you can request to see the quotes, but either way, choice of repairer your paying the $1300 im afraid (or your own excess)

Fair enough, mayb title was a cheap grap for attention, and mayb im having a bit of a cry. BUT as i like 2 consider all my options before throwing away large amounts of cash, and thought i'd throw one out 2 the audience. I just wanted 2 know if any1 had experience in getting information 2 substatiate the $value the insurance claims, and if i have any rights if i ask 4 an itemised invoice 4 the repair? Too many times have i just forked out 4 things that i have only found out later that i could have gotten out of or at least gotten a better price if i asked the right questions, i've worked in sales and was very good at the schpiel and have had many people waste alot of my time, so me thinks 'if i've got nothing 2 lose, then mayb i will make this a personal vendetta 2 give the rude prick at AMII a hard time and drag this one out a bit in my spare time.' 'why should i give them the easy sale.' Mayb it will be make me feel better even if it wont pay for all those bastards that have backed in2, dented and scratched my prized possesions in the past without leaving details.

It may be worth speakign to your insurance company and say you are happy to pay for her repairs directly as the damage to the cars was minimal. She may be trying to load up the repair bill so that other things on the car get fixed at the same time....

Its clear that he knows that he's at fault, i think its a valid question, im also am curios as to wheather you can just pay the bill and not use insurance at all.

Troy may also be onto something there too, id be asking some questions bout the damage too.

it was a long time ago, so processes might have changed. similar thing happened to me but i was uninsured (hence after that i am never been without insurance). lightly tapped the end of a car infront of me. anway cost of damage was about $1500 or so but i went overseas for 3 months. when i come back get a letter from debt collecting agency. saying that they will do a special deal and i only have pay half of the money right there right now and they will close the matter. i said naa i pay $50/month (which i did for 3 months and forgot all about it ;-). but to this day i do feel scared if they might put a black mark on my credit rating.

hence moral of the the story... Always get insurance and rating protection. And let the insurance companies take care of the problem

this happened to me a couple months back, a few tiny scratches to the back of their car and they said they would just get it buffed out and send me the bill which i was fine with, but a couple weeks later i got a letter of demand and a bill due in 7 days from their insurance company for $890 (theres noway it could have been that much) so i rang and complained and asked for photos of the damage and an itemised bill of the repairs, they quickly changed their tune and let me settle it for $450, still steep but was worth arguing it down...

forgot to add that i paid them direct and not through my insurance because it ended up being less than my excess and there was no damage at all to my car either :verymad:

Just deny that you did that amount of damage and drag it out for a year or so, then they will settle for less, also go through the itemised list of repairs to be carried out and you will see alot of stuff you are not responsible for.

Drag it out and ask for proof and documentation, they hate having to prove themselves, they just try you on for size and most of the time they get away with it.

I had RACV insurance tell me that their insured driver was drunk when she hit me and that i will never see a cent, months later I got my money but not without them trying every trick in the book to get out of paying out.

I agree with you Roy! Seen it done MANY times.

People are often calm and non-confrontational at the time, but may well change their mind later on.

Often in this situation, person thinks it's only 'a small scratch', goes to your usual inflated crash repairer for a quick quote, they say 'nah, not easy at all we gotta do this and that and that ... $2k' (but they know they'll get the work at that price as it's an insurance job (double the price)) then said person goes 'shit, this stuff is expensive, maybe i had better do this through insurance', and then there you are..

By attempting to offer cash, how do you really know at the time 500-600 is going to cover your average panel shop repair cost? If I at the time looked at some damage to my car, and tried to work out on the spot whether that would cover it I'd have no idea as I'm not a smash repairer.

Anyhow, doubt you have much choice but to pay. If you had a lot of money, you'd hire a lawyer, demand that they got three written independent quotes, and you pay cash for the middle of these quotes. But that would cost you more than it's worth. The joys of being rich..

As somebody suggested, ring AAMI and demand a copy of the quotes used to assess the damage. If they've only got one, or it seems suspected, kick up a stink.

I told them i don't have insurance just to see if they would say anything bout my policy with Just Car (a subsiduary if AAMI), was curious as to wether they have access 2 each others database, look up my excess, top it by $100 so it would be the cheaper option, then take my rating 1 and bump my excess up next year. I'm sure thats not what has happened but im not about 2 give them that much cash without getting an fully itemised quote. If they still don't give me anything then a lil letter from uncle QC might do the trick.

its always a good idea to carry a camera with u when u drive, so if something like this does happen u can take photos of the damage. then u dont lose out if ur not concentrating while driving

2nd that! I always carry a camera with me just in case.... been burned in the past where I was hit up the back and pushed into the car in fronts tow bar. They drove off thinking no damage and I was stuck with the repair bill as the "insurance company" claimed I had had a second accident or the damage was there already!!! If I had a camera this would not have been an issue as I could of a) photographed the car in fronts number plate b) photographed my smashed front number plate cover on the rd proving that it happened there!

I want to add to this post with a question for a mate who has an R33...he recently ran into a shitty little hyundai..light hit..wasn't his fault...he was going straight, ran a yellow light and the hyundai didn't give way while turning right and he went right into it...not much damage at all but after the accident some other car pulled up and this dickhead got out and started screaming and abusing my mate saying it was his fault sayin he ran a red light and all and demanded my mates licence...due to the shock my mate complied with all this and easily gave licence and all...now the hyundai's insurance called my mate and is demanding payment for her car claiming it is my mates fault as their client and the witness had both made statements...does the witness count for anything espcially considering this witness behaved in this manner when he wasn't even a part of the accident and could not have seen the light at which my mate drove...he looks like an obvious skyline hater...looks like the typical dick to generalise skyline drivers as hoons...

My mate doesn't have insurance and was wondering as to what the actions he can take now as it was clearly not his fault...any advice guys? sorry for going a bit off on this thread but seems most appropriate for this question

Depending on where it was alot of intersections have RTA monitoring cameras. He could go to the police and ask for the footage possibly? This would show the light sequence and who ultimately is at fault...although running a yellow just about constitutes running a red these days - depending how far he was from the line when the lights changed to yellow of course!

    • Yeah its bad eh. Ey! Watch your mouth. Yep, spot on. The rear's are always gone too though from brake checking. I had them perilously close to a tree that we had taken down. I think the tree peeps may have taken it. Either for a trophy, or accidentally.  
    • f**kin' yikes! That insulation is the shittest stuff I have ever seen. You need to do an insurance job on that f**ker, pronto. WRT to the washer cover, I would have said that there'd have to be some at a wrecker, then remembered that it's a BMW, and reasoned that every single wrecked one would have been tailgating and so the front end would be trashed.

    • Ok, so I got myself some X1 wheels really cheap to try out, they're a bit different and I like them but they're really narrow (18x8) they are available in staggered 18x8/9 also but really hard to find.  I kinda dig them, but not as much as the F10 19's I usually run, so these go into the wheel pile.         As I mentioned in another thread, I got a new exhaust. It's an off-the-shelf stainless one that fits OH-KAY. I don't love the tips size and how far they come out the back, I think I might cut the tips off and replace with some smaller (~3") ones that don't extend as far. It sounds really good though, I'm not sure if its just in my head but the car feels a little quicker, more responsive.      I fitted an eBay special front lip. Surprisingly it fit perfectly and all holes lined up. Its a little rickety but I haven't put any double sided tape on yet, I want to clean the front bar up where it has scraped the road a lot and fil in the number plate holes (or, get body coloured wrap to cover them - is this a thing?  I'm not sure if I'll leave it gloss or pain it matte. I really like it though, I don't particularly like the front bar without it, I don't really like the M-Sport and to get anything else is just too expensive. That said, I might need a new one now anyway as I dropped the car onto the jack after forgetting to put ramps under the front wheels. It bent a lot and while it did go back to normal after I got the car off the jack, I do fear I have not done it any favours.    Lastly, my headlights died. Different problems in each. They have gotten much dimmer over the past year or so, I put new (uber expensive) OSRAM bulbs in them but to no avail. One of them pointed at the ground and the other just kinda did its own thing with light working sometimes. Yeah, check this 18 year old BMW headlight wire. I reckon I know why they were stuffed.            BTW, the yellow and black is the power to the Xenons. Yikes. I hunted around an researched my options here. I would have loved to just get a replacement harness but not a thing. My car has adaptive headlights, that is they rotate left and right with the steering wheel. Good condition used adaptive xenons were over $700 each, non adaptive were around $400 each, but I couldn't help but think that they're all around 18 years old now, surely they'd have the same problems. So I looked at newer LCI headlights but they were even more expensive and I couldn't confirm that they'd be plug and play with lots of people having lots of opinions so not worth the risk.  I ended up getting brand new Chinese headlights from MARS. They're very close to OEM with only the angel eyes being a bit different. I didnt want crazy turn signals or sharp DRL's or anything. Not my bag.  They're not adaptive, I thought thats a feature I wouldn't really miss. So I coded that out.  The lights are awesome, they look so nice and they take so many years off the car. The angel eyes look great and the headlight brightness is ridiculous. I was so used to the old ones, I didn't realise just how bad they were. The new ones use the OEM bulbs, Xenon ballast and leveller motor which I was happier with. The only issue with them is that the rear cover is held on by SEVEN screws. This will be a nightmare to get to and open when I need to change bulbs.   
    • Now that you mention it I can see those too. More subtle. The lighting and low resolution makes it hard to assess super well what's going on but what is visible is bad enough to pull the motor.
