exactly!

- coulda, woulda, shoulda!!!

but its all done now, best to make the most of lots of walking and getting fit or even fitter! and saving on running costs of your car!

yep save the money and pay off the fines...

28 days after you being issued the fine

ah ok thanks

Are you sure it is just 6 months you will lose it for now, not 12?

BTW - Got a fine through on the 22nd Dec, appealed it after all the public holidays so will see what happens but as others have said, don't pay the fine if you are going to appeal.

thats what it said on the paper. i have nothing to appeal, i deserved this 1.....even i know it :)

the 12 months/1point is a 6 month loss if you get a point in that 12 months

i know, im on the 1point/12 month till Feb :)

hahahaha seems like everyone's on this option lately :)

Sorry if I added to the confusion, I avoided the 6 mth suspension once due to a loop hole in demerit point allocation many years ago. At that time the demerit points seemed to only get added when the fine was paid.

I would like to commend people for not jumping on the band wagon and slamming R-SPEC, the vast majority of young car lovers tend to drive for many hours in a day and drive in areas that police frequent, so the occasional woot on the skinny pedal can be bad for your finances or travel arrangements.

I am an old fart now and tend to take it easier....... also won't see me down Chaps often in the Skyline... usually in the Rav4 or the Celsior as these cars don't give me an ulcer when I park them and walk away.

Prime opportunity to make your car prettier while it is off the road.

i'm actually selling the car anyway and was getting a gtst. i might still get another car and put it in the garage just to be safe. cough new turbo p-plater laws in 6months? cough

you dont get the demerit points UNTIL the fine is paid. You cant get points taken off u until to are proven guility...the fine system is backwards and designed to speed up the process by just seeing if u will pay, admit guilt which requires no need for a legal case.

but it backdates to the date of the infringement once paid.

so you may delay it for a bit...but when it gets paid..points gone.

Thats my understanding based on the recent reading I have done.

  • 4 months later...

got a vicroads letter today, 4 months later lol. losing license on the 25/06 for 6 months.

If you objected to the TIN then the matter goes to court. They cancel the TIN and send u a summons. The TIN is cancelled and you recieve a letter in the mail stating exactly that.

If you paid it then you have admitted guilt and 3 points apply.

Thats the rules mate.

If you let it expire...I wasnt sure what happens - well now I am cos u just did it and that's what happened!

i honestly had forgotten about this fine until today when i got this letter.

it was 4months ago!!! i don't know if i got an over-due notice or not, probably was thrown out by accident or something....

is there any way i can maybe reduce it to like 3 months or something? :domokun:

VicRoads and the Court are different.

VicRoads will take the demirts right away. Even if you contest it.

Its only once you BEAT the charge that the points will be removed, and in some cases you have to tell VicRoads yourself.

They took points from me years ago, i beat the case, and i checked 12 months later and the points were still there.

This is when i find out the systems are not linked... and turns out lots of others have had similar problems getting the points removed (if your not guilty)

Jus a bit of info :domokun:

last time we got a fine, maybe 1-2 years ago now.. I paid off like $10 a fornight/month for ages (via bpay ).. dragged it out for months.. then they just sent a letter saying they don't accept part payment, every time I made another payment ;)

it wasn't til the fine was completely paid that they sent a letter saying the points had been applied.

Pretty sure I rang the info line at least a couple of times whilst paying it off and checked and there was no points there yet.

The TIN is cancelled when you contest it. Therefore the infringement is no longer valid when u take it to court. If the notice was for loss of licence different rules apply. My points have not been added and I have had it checked.

In my experience point are only ever added after you pay...hence u usually recieve the letter in the mail soon after.

i can't see how i can drag it out that long as i got pulled over and fined (already have a due date) but i'll still give it a try

damn....

thanks

If it hasent already been said, easiest and a legal way to drag out paying a fine or loosing license or points is to contest and take the matter to court. Once you do this it takes around 1-2 months for the court date to be sent to you, which is usually atleast another 6 months away from the date you get the letter stating the court date. To avoid going to court just pay the fine and take the points/license loss a few weeks before the court date. That way you give yourself around 6-7 months of delay and the court date gets cancelled.

3 points is lost after the fine is paid.. try this shss ya didnt here it from me.. over pay your fine by 10bucks ring up the agency say you've over paid your fine they send you out a cheque..dont cash the cheque points dont go on your license..

you see legally the points can not be placed on your license until the transaction is completed so if you never cash the cheque the transaction is never completed and yes it works I've tried.

haha nice. Loop hole which helps us

at the time i was doing it i didnt care it was that or loss of license...but lets be honest here the department of infastructure or whatever there called dont give 2 shits about your points its revenue..they still get their cash and while your on the road they still get more..so they dont really put a lot of effort into this..

I an numerous mates have done this without any problems to date..and or combined driving time would be around 40 years lol so im sure its not too a big a problem..

ohh and if it coems back and bites me now I have all my points back :P so I can handle losing 3 lol

you just ring and say you accidentally over paid I said i hit the wrong key on bpay while paying.. i mean look if you try it and it works good stuff if not you get the 3 points u were goin to get... theres no harm either way is there

if someone else has tried this recently and can prove me wrong that it doesnt work go for it.. I dont want to be giving false hope only saying what has worked for me.
