I left my car at the caryard where I bought the car from around 530pm for new head unit installation on early tuesday morning. I went back to the caryard at 930pm as I just realized that I have left my mobile on the car. Guess what, my car was not there. where would it be? the owner of the caryard drove my car back home!! I know nothing about the law, but is he illegal that driving my car without my permission? at this stage, anything that I can do about it?

I have put $10 worth of petrol into the tank before I handed in my key to the caryard runner, and the odo was reading 7.1km after I parked my car perfectly in the caryard. I went to pick the car on tuesday around 5pm, the odo was reading 72.1km!!!!!!!!! I started the motor for a min, and it just shuted itself straight away. I was told by one of the staff that my car is running out of petrol, not even a drop in the tank!!

My question now is does it harm any engine parts or any fuel system? if it does harm my engine or anything else seriously, I promise myself that i will sue him for sure. So guys, please let me know what what would it be happen to my car, as I do really really worry about my baby stagea, i just love her too much more than my gf.

lol.. nothing like a quick run on wakefield after a head unit install!

You won't be able to get him. As far as you know, there has been no daamge inflicted to your vehicle.

My question is to you now, Why would you go back to him.... and ... for the installation of a head unit? lol seriously? These things are PISS easy to install.

One more thing, the moment I opened my door to drive my car back home, my babe was in P, but the foot brake was off, it means the transmission itself locked my car on the ground, and!! it was on the slope!! does it harm my transmission or gearbox??.............guys............is my babe f**ked? is it neccessary to change to another car??? this car yard is located in QLD Springwood..

ok let me have a go at this.

1. You need proof stating that you are only sending your car to install the headunit at the caryard?

2. You will need to prove that the ODO was reading 7.1km when you handed the car over to the car yard. ANd receipt for the fuel that you put in.

even if you make it to court the caryard people will say that the headunit was installed at the boss's home. In my point of view dont bother cos you got a weak case. Cos you dont have hard evidence to back you claims up for the ODO read out. But i might be wrong.

Look just treat it as a lesson so be more specific and detail next time.

i would definetly sue

your car should be transported via flatbed truck at all times even around different parts of the yard

and your atleast up for the cost of new tranny now its been left on a slope in p

yep i think it will be hard for ya...id get pro help...advice of some sort...

if you didnt give him authorisation to drive it around - then he has no right to do it. Are u sure it was 7.1 and not 71 when u left it there? its gonna be hard to prove it. I am not sure about this, but if he let it use petrol till it was bone dry - there shouldnt be any problems its just using petrol. But if it was something like a coolant usage, and there was none left, then its big problem.

maybe, just ask him why the petrol tank was empty - and then not take it back there anymore.

You have seven different opinions on this post. you will get seven different opinions from seven different solicitors, and ultimately seven different legal outcomes. the result - which ever of the seven lawyers you select he will be the ultimate winner as you WILL pay.

Unfortunately these types of events do occur in the motor industry and "proof" is an extremely difficult fellow to grab by the tail.

Unfortunately this response is of absolutely no benefit to you in trying to ascertain which course of action you should take.

i suggest you go back there and abuse the shit out of the C()t. Let the steam out and get it over with. The stuff you mentioned about the gears and stuff wont hurt. good luck buddy

Let me put it to you this way. From a legal point of view, what are you trying to achieve?

Criminal outcome - what did he do?

civil outcome - how much damages are you expecting to get? how much will it cost you for legal representation?

I agree, I think that you should front him and ask for the cost of the fuel to be deducted from the install. Or better how about the cost of hire for the night?

Having the auto in P on a slope doesn't affect it at all. The trans has a dog lock on it. (To be honest I hardly ever use my park brake in and auto). Just make sure that you dont put it in P while the car is moving..... THAT doesn't do them any good (they usually survive though)!!!

Oh and like Cy says Dont EVER go back.... EVER.... and don't forget to tell EVERYONE, of course you can always remind the DH that we ALL leave a reputation behind us, better to be a good one, me thinks. :(

You won't get him. I had a similar issue with a previous car that had 70 odd kays racked up on it and I got it back with a spongy burnt feeling clutch. There was nothing I could do.

That just burns my blood. My car came back from compliance with about 1000 ks extra on it. What did they do? a few trackdays? drive to qld and back?

I dropped my daily to the local garage to service because I was too lazy with a full tank of fuel, and it came back empty.

No respect. Imagine if I got my hands on his car. Rally driving through the bush with the airfilter removed for max induction noise?

not really - sometimes business owners can be stupid and let themselves open up for much slandering. Just gotta look for it :D - not slandering through sites like this, but through their own stupidity. One business had to close up its public forums cos of the havoc that was caused by a few customers bad experiences.....

Edit: they shouldnt have had a public forum and said "positive, negative, neutral comments welcome" - idiots :(

firstly ...he should not have driven ur car without ur permission...but then again..think about what sort of legal compensation u looking for ...a full tank of fuel? the legal cost will outweigh any sort of compensation ur likely to get...so best is to just stay far far away from that dodgy business....and let ur relatives, friends, neighbours, footy team, local grocer, drunks at ur local...and anyone else u might bump into... to stay clear of that place...word of mouth travels far and wide...and given time...u might just hurt his business enuff.
