Jazza r33 , I will put it this way . If a milkshake (good one nightcrawler) pulled in front of you and all of a sudden slammed on his brakes in front of you (road rage or whatever) and you had no where to go except up his ass end , as far as the law is concerned, you are to blame. Now if you would accept this , OK, if not , well then you might see where I'm coming from .

Secondly I dont tail gate and allways try to keep a safe distance in front of me (this is why the call these accidents)

Thirdly , I'm not stupid mate and dont like being told by someone 10 years younger than me how to drive. (telling you this in a friendly manner)

And last of all , Im not shirking my responsibility and blame , and all of us still arent mentioning what could be lurking in our rear view mirrors before we brake hard ie SEMI TRAILER. :thumbsup:

yeah no worries at all Michael - if they pulled in front of you, then you can quite legitimately claim it to be their fault - and the law sees it this way too. I am not sure how you would go about proving it though - but I would plead bloody murder than take the blame if that is what happened if I was you! Worst thing is it affects your future insurance premiums - $300 is nothing now, but if they jack up your insurance by $300-$500 for the next few years you will be spewing - especially since it seems it wasn't your fault. Sorry if I jumped to conclusions. :thumbsup:

it is the common reaction of most drivers to veer away from a car that's slammed on their brakes!

but i myself don't tailgate! even on 60 rds i like to stay 3-4 secs away from the car infront but then it can't really be helped if your on a busy road! i just drive with my foot just on the brake ijust in case!

but for some reason people like to tailgate for some reason! everywhere i go i get tailgated! i don't know if it's because i'm a P plater and they're screwing with me or that's just the way they drive! i get tail gated to the point where i can't even see their number plate in the rear view mirror anymore and i don't wanna go any faster because i'll be speeding!

anyways import s13 sorry to hear buddy but your car has criminal cooties all over it! hehe

Already checked with insurance company and they said premium wont go up just excess might go up $200-$500.

I have had my fair share of speeding fines, undue noise and failing to keep left (last 2 were harrasment in my view(tailgated by un marked cop cars)) so I have 9 points and dont loose any for another year.

The worst thing is that I might get an infringement notice in mail for failing to keep a safe distance from the car in front or for unsafe lane change. (my car was out of control (that last one is bullsh#t))

these acrue 2 and 3 points so we will have to see what happens.

Bottom line people,this was an accident unlike what happened to Kyes car , that was just plain CRIMINAL

Exactly right nos man, regarding reaction to turn out the way. This isn't allways possible though.

If we had been to advanced driver training , we would all know that the proper thing to do in that situation would of been to ram into the car infront because you could brace your self unlike when I spun out of control in the path of the other traffic. I was lucky it wasnt a truck ! I could of ended up under it's wheels like in 2 fast 2 furious. Mince meat in other words.

Sorry mate I think you've got me all wrong. I was not referring to situation where you get cut off will make comment now that the scenario you described that you made no mention of being cut off, if you were cut off then no I don't believe it was your fault. I that case unfortunantely a witness is you're only hope of having blame taken off of you, which is shit admittedly.

Unfortunantely you don't have to be tailgating to be too close to the car in front of you & this is something many people don't seem to understand. Unfortunately you probably thought you were back far enough to safe & you'd be far from alone in that situation, I don't really blame you for not know that so much as the driver education system, people all too often don't know the limits of their car until they end up in an emergency situation &/or have never been taught how to handle it & this is wrong. I'm sure its not a good feeling having landed in that situation & you'll be more cautious than ever as a result & I'm not saying I for one will admit to having made a major driving error in the past.

I underestimated loss of grip due to wet weather, didn't make it around the corner, hello light pole. Should have driven slower & should have got a wheel alignment too. A costly mistake, but lesson I will never forget. I screwed up & I'm not affraid to admit it. However if I'd learnt to drive my car better before going out on the open road it would never have happend. It wasn't a big crash, but enough to change the way I drive forever.

I'd also like to make comment that just because I'm 10 years younger doesn't automatically mean I'm not as smart a driver as you. Knowledge is more important than age. I have been passionate about cars motorsport & driving in general from a very young age & was shocked at how easy it was to get your license in this country even before I got mine. I also otherwise have one of the cleanest driver records around with my only offence being one speeding fine in 8 years of driving, & then only because my speedo had been thrown out due to new wheels being slightly bigger. My father also has been employed as driver for over 30 years & never had an at fault accident, he taught me very well & taught me a lot more than any driving instructor ever will. I learnt nothing from mine & he was one of the better ones out there.

I never called you stupid, that was you're own interpretation & self defensiveness kicking in, which I've seen so many times from who knows how many people I see it as normal, & hold nothing against you for that. I make no apology for my comments.

And yes I do look in the mirrors for trucks as well as cars & am all too aware that they can't stop anywhere near as well, so I find it quite scary when one of these big suckers sits right up my crack. I try to get out of their way ASAP, it's just not worth the the pain & aggrovation as I'm sure you're all too well aware.

I don't believe you're a bad driver, but don't think you know it all either, anyone who thinks they do is full of shit.

In fact I think it's high time we all did an advanced driving course, myself included. Everyone has something to learn no matter how long they've been driving.

I agree with Jared in that if the government really gave half a shit about the road toll they would make EVERYONE do a defensive driving course ASAFP, and those that don't pass take their licences away.

In my opinion it should be a vital part of getting your Provisional licence.

Why the govt doesn't agree is a total mystery to me.

it would be very kaotic if everyone was just forced to take the defence driving course! but i do think we should all do it but maybe give time lines on when you have to do it? i wanna do the defence driving course but i can't afford to right now!

yeah but imagine if the government ran it and it only cost you $50 to do? How cool would that be, and we would all be significantly better drivers with cheaper insurance (insurance companies love people who have done these courses since they don't have accidents anymore) and we would all live safer driving lives.

But yes at the $300 odd (from memory) these are now it is a bit rich. But what price can you put on your life?!

i don't think they'll run it for 50 bucks because they'll most probably look at the revenue and charging it 300 bucks or whatever the price normally is! and they also have the power to force people to do it as well! i don't know how it'll work but i doubt they'll ever do it unless alot motorist get parliament to discuss it somehow! but at their point of view to solve the problem of car accidents they'll just start making more rules than do something like this! they're campaigns clearly show they're trying to get rid of bad motorist and fair enough! but what about the motorist who aren't bad? they still get into accidents because a lot of them just panic and shit when shit happens! just like when i first got my car, i locked up my brakes because the guy infront of me did! and i didn't know how to downshift then! but if i was taught how to deal with situations like that i wouldn't have locked my wheels up and nearly hitting the dude!

Sorry mate, but it won't be the last time someone younger than you knows something you don't, & it only happens more often the older we all get. I DID NOT say that I know more than you, just that maybe I know something you don't. I'm sure there are more than 1 or 2 things you could teach me too. Car's & driving just happen to be what I am most interested in outside work, so I do know a fair bit, but not to say I know everything, I don't & I know it. I can understand you being upset I know I would be too, I nearly cried when I crashed my car.

I didn't get around to saying it before (it was getting a bit late last night), but I would like to commend you for trying your best at avoiding the accident even if it didn't turn out that well for you. However you may have avoided much worse injuries had you just done the old brain freeze & just hit the brakes & shunted the dumb woman in front of you, who clearly was driving too close to whoever was in front of her. After all, rear enders are one of the easiest crashes to have, which is why they happen so often.

I am not singling you out as a problem driver, if that's the only/worst at fault crash you've had in 20 years of driving you must be doing something right. Apologies for upsetting you more. My message was intended for all not just you, please understand this is not a personal attack & don't make it into one.

I hope you & your car make a speedy & painless recovery from this bad experience. I don't like hearing about anyone crashing & if this message gets through to just 1 person & prevents them making a big mistake then to me it was worth it. I hope you can eventually feel the same.

Come on mate , the memory is'nt that bad.

The car will be a rightoff by the way . When I went up the curb, it stuffed up the drive shaft's etc, but the car is ok from the front window back. Still it was only a $1600 work hacker.

If any one know's of a daily hacker for sale under $1000 let me know.

By the way jazza, Ive never hit a stationary object in by life. Wait a minute , thats a lye. I hit a stationary car on my push bike once LOL (22yrs ago) It hurt LOL, me and my bike LOL.

Now to make matters interesting , I got a letter in the post today , fine for dangerous lane change.

1stly , they got the offence number wrong (a155 which is to fail to give way at a T junction or to drive on a tram line) I dont see a tram line going down main north road around elizabeth.

Secondly the lane beside me was clear of trafic which is why I tryed to aviod the collision and when your car is slidding out of control , where did the traffic cops come up with that one .

I went down to the elizabeth police station yesterday arvo to try and clear this up , but there was a que of people with only one pen pusher there to handle it . When he finally got to speak to me another copper came out to takeover for him so he could speak to the other 6 people in the que (which was getting bigger by the minute) and this guy didint know what to do so I ended up wasting 45 mins waiting for him to come up with an answer. What do you know, no answer because he couldnt work it out either. You will have to wait till i can speak to a traffic officer he said. You and I both (all of sau) know what that ment, They are all out revenue raising .

If anyone out there knows wether this is right please let me know (following statement)

If I pay the fine but wish to take it to court like it says on the ticket , I pled not guilty because I didnt drive on tram tracks,and wasnt at a T junction , will this get thrown out of court and I wont get the acompanying 3 demerit points (only got 3 left). Something like double jeopardy

Well I'm glad you're not too upset about it Savage, sorry to hear the car's stuffed though, at least it wasn't worth too much.

Man that's a seriously long cue for the cop shop though, they must have their hands full up there. You should come down to Sturt police station, barely a cue at all there & several on hand. I don't know how well the charges they've laid would stack up in court, would think they need some sought of proof of you performing a dangerous lane change as opposed to one that you're attempting evasive action. That they've stuffed up the charge may even be enough to get it thrown out of court, I'd speak to someone professional for advice before doing anything more.

That's about as much as I could tell you. My only experience with collisions wasn't so bad in that the guy that hit me was deacent enough to admit fault.

Considering the amount you have to have done ImportS13 your repairs seem rather cheap. My rear end damage was also fixed by Doyles & cost about $2800 & you could barely see the damage!

savage GTR - yeah my excess at the moment is 300bux but im sure when insurence finds out about the quotes im getting it'll go up abit :) but im getting nearly a full respray so im thinking about foring out some of my own cash for a new colour and the rest of the body work done!

JazzaR33 - yeah i know it sounds alot more then it really is if you think about it. the rear quater windows alone are 1200bux a set so theres a fair bit there.

lets just hope insurence doesnt try anything dodgy on me :)
