bought HIDs and found one of the ballists was faulty, sent it back straight away and its been 4 weeks now and he has still not sent me the ballist back. he claims in on its way and i should get it any day. tonite i got defected for my head lights. ive asked the guy to send me the ballist asap. but he wants $10 to send it, which ive got no way of doing because netbanking requires a minimum transfer of $20. and mailing him the money would take ages. i dont have any other means of transport so im pretty much out of luck. i got defected while on my way home from work. my shifts are 12pm till 8pm.

so my qusetions are, should he be paying for the delivery of the ballist back because its covered by insurence and it was a faulty product supplied by him, and is he responsible for my defect because he refuses to send the product back.

He is responsible for giving you the replacement, but not for your defect as you shouldn't have been driving with stuffed headlights.

yeh i figured enough. but should i be paying for the delivery of the ballist back to me?

So wire him 20 bucks to shut him up, get your ballast, fix your lights and be on your way

It's only small change

Better than running some kid over cos you're driving around without one headlight

Technically he is responsible for sending the replacement unit under warranty, unless it is not under warranty or in his sale he explicitly state that customer has to pay for warranty claim's shipping. If you want to know what type of legal standing you have, you can call dept. fairs trading and they will advise you (assuming you want to take it this far). As to the defect.. no thats yours as you choose to drive the car with defect headlight.... Another point you might want to remember is that if your car does not come with factory HID and complied with it then HID is illegal on your car as well. So next time when you have a full set of HID, blues can still defect you on it. :(
