A Victorian man has become the first driver to permanently lose his car under the state's anti-hoon laws.

son of rajab, 43, pleaded guilty to four counts of driving while disqualified between January 23 and February 14 this year.

Under laws introduced in July last year, drivers caught drag racing, doing burnouts or committing other "hoon" acts such as reckless speeding and driving while disqualified, can have their cars impounded for 48 hours for a first offence.

They face a three-month impound order for a second offence and the permanent confiscation of their car for a third offence.

Victorian Police Minister Bob Cameron today welcomed the magistrate's order.

"These tough new laws hold hoons accountable for their actions and hit them where it hurts most - by taking away their vehicle," he said in a statement.

Yeh i heard this too, was so funny, the news report i heard mentioned that it was a fastback 1980 corona.. I guess because of word association this would leave more people to believe it was a fast car or something? I dunno but my 50 year old dad laughed for like 10 minutes on hearing it was some old guy in a piece of crap car

Well there you go, proof that they aren't just targeting import car drivers, they are targeting everyone no matter what car you drive.

does it depend if the cars in your name or not????

if it is not your car then you can go through court to have it so the car isn't confiscated. the same as if you owe lots of money on the car. you can go through court to say that you owe heaps of money and then they would make you sell the car.

so do they confiscate on the spot or give you notice first? I they give notice first then i guess you could just get the ownership transferred on that day and say that your mate bought it off you that morning.

AFAIK, it doesn't matter who owns the car - if you are caught, the car goes. So if it was your mate's car, chances are he won't be your mate (or you won't be his mate) for too long.

amendments to the Road Safety Act 1986 gave police the power to immediately impound or immobilise the car driven by a person they reasonably believe has committed a hoon-related offence

I read this as "I don't care whose car it is, you were hooning"

they have to leave a loophole so that if someone has owes the bank 30k for a car and gets it confiscated they can't just stop paying the loan and the bank can't reposes the car to get their money back, or if it is a hire car, the hire place would lose a car and only get a few hundred buck from the deposit back.

And if a person is found guilty of three hoon-related offences inside three years, their vehicle can be permanently forfeited by the Court.

this is a quote from that media release. it is decided by the court. so the court would see that you don't own the car, and would order you to sell the car.
