Hey all,

I'm a owner of a R33 GTS-T. I've had my baby girl for only 5 weeks, I brought her through a car yard.

I've just recently been pulled over by a defecting officer. He defected me for my B.O.V. at first then he did a search of the car and came across my turbo timer, and gauge (which was sitting above the dashboard). He did mention about my tinting but wasn't sure due to he had pulled me over at night, but also he didn't have a tint defect little machine thingy hehe!. He didn't write that on the defect notice though - thankfully!.

Due to the car being under warranty still, I rang the car yard to explain to them that they have a problem. I told him what happened, at first he aka Ameen ( car yard manager ) told me he'll take off the defective parts, but is not taking responsability of taking it to Regency. Now, when I got pulled over, the police officer informed me it's not my problem at all - it's the car yards and it's the car yards responsibility to take it there and deal with it. So I got on the phone to Consumer Affairs ( I've had problems before with the car yard prior to the defection ) and explained what the car yard had said. Dave ( Consumer Affairs bloke ) had informed me also it's the car yards, I also told him that they are refusing the responsibilty and I'm unable to deal with this car yard on my own anymore. Dave also said to just inform the car yard that I had informed C.A. and that they had said they must do it. So I did!.

I was on the phone to the car yard, Ameen then said he'll take the responsibilty but he'll keep the defective parts. Before he said anything else, I replied with, "the next person you'll be hearing from is consumer affairs!", then hung up on him. Explained AGAIN to the Dave. While I was on the phone to Dave, Ameen rang him. Dave put myself on hold while he spoke to Ameen. Dave came back saying, "Agreement that they'll take responsability, give you your parts, etc etc. If you pay for new suspension for your car." Then he carried on explaining to me it will be unfair for the car yard to fork out money for suspension when I knew it was lowered. I still don't understand that. I've had quite afew people come to me saying that I shouldn't have to pay a cent, but in all honesty, I just want my car fixed and all that and get them out of my life. Anyways......

This morning I took the car down to the yard for the day so they can take the defective parts off plus fix some problems. I finally got the car back at 4:30pm. On the way home I had noticed my speedo wasn't working, there's ciggarette ash between the speedo and the clear plastic cover over the speedo, the windows won't zap up now once I've turn't the car off ( previously I could turn the car off, and still able to zap the windows up ), my ciggarette lighter doesn't work and they've taken off my turbo boost controller when that wasn't on the defect notice... and one last thing that I've picked up tonight ( but mind you wouldn't surprise me if there's other things wrong with it ) and that last thing is, the car is running really bad now.

I'm running up walls with this car yard, I'm that stressed out because of the bollix I've had to deal with that my boss is sending me home from work because it's just effecting me bad... that's why I'm here..... They think I'm a young female, that I'm stupid. I had a slight go at the mechanic when I was picking up the car. A.J. was starting to explain about the boost controller and I just jumped in and said, "oh what?! another lie?". He instantly said, "I don't have to put up with this sh**, you can deal with Ameen for now on. I don't wanna know anymore."

I don't know what to do anymore.. they're screwing me over, and I need help badly... I'm near on in tears all the time, I'm too nice to stand up and say something. Friends & family have told me to get a group together and protest. I've also have been told to get a lawyer and get a law suit. Another one is, is to ring MTA ( car yard is 'APPARENTLY' MTA approved ) and put in a complaint. I've also been told to go to the media. With the media, I can't... I'm way too shy. What should I do??? and can any of you people could help me out in anyway or anything at all??? Advice, anything... I'm seriously desperate.

Someone provide some help for this girl....

The only cars that should be sold in car yards, IMHO, are stock ones, not modified ones... for this very reason.

On the other hand by accepting trade-ins like cars like this it helps us out in the sales department when we need to let go of our ride.

If you want to buy modified, a car yard should be a costless ticket thru regency, if it is within the warantee period.

iv herd this same story prety much word word with a mates car last yr.

in my eyes like i said to my mate dont let the yard touch ur car after uv taken it as they wont b happy with it returning so parts will go missing or shit will happen like in ur case with the windows my idea would b to just go throw regency ur self an just walk away from the yard unles u have the time etc to bother, id think it would b easier to just walk away.

boost control etc are also a NONO an even if the cops didnt get everything on the sheet ur car can still fail wen u go throw as they will pic up more things than the cops will. so dont think ur safe just coz it not on the bit of paper

the pits refer to the pit they make u drive over for an under vehicle inspection.

As far as getting it sorted, your pretty much in a self dug hole. Your lucky you got so far with the car yard.

Buying a modded car to start u knew that it wasnt std, so u shouldve taken it on the chin and gone to regency and got it off defect. It wouldve costed a little, but im sure if u took it to Shaun @ Boostworx to get it back to std he wouldnt leave the car running like sheit.

All i can suggest is if the car is running, and std, take it through regency. If it doeesnt pass, get the problems fixed until its off.

Then go see Shaun @ boostworx, and tell him the problems about the car and see what he says. You will have to spend a bit of money now to get it running and on the road. I think u have cut all ties with the caryard now anyway so dont bother going back...

*what modifications does it have which you can clearly see that you would deem non standard?

answer these questions and then we will be able to help you out. forget about the car yard.

It seems like you have done the right thing in contacting c/a. just keep bein persistant in what you are doing. the car is still under warranty. also the fact the car was returned for work to be done to it and then has come out with all those f**k ups is bullshit too. keep at them and let us know how you go, also which car yard is this.

as well as suspension, which would mean regency.

Consumer affairs wont help with a refund as the car was in working order, and are not obligated to refund as the car working order when she bought it. They dont know where she was, or what she was doing when defected.

Mel - its obviously you've had a really bad experience with the car yard. I would be looking to get a refund, and go elsewhere. They had the opportunity to correct things, and make the car roadworthy - which is their legal obligation. Instead they have farked around with the car, and I wouldnt trust them anymore. Talk to the Office of Consumer Affairs again for support, write them a letter stating whats happened (document the facts), and let them know if you cant get a full refund you'll send the letter off to Consumer Affairs and the MTA. Thats my advice - get your money back and go elsewhere.

I hade a mate with the same prob, he got a vn commy from a car yard it come with 6 mounths warranty. That night driving around he got a defect for Rear lights tinted, Low,no interiour light,loss seat and no clamps every 600mm for amp cable. He took it back to the car yard and hade them pay for every think to get fix As by law car yard cant sell non road worthy cars. Only thing he hade a prob with is getting the parts back that they chang to get it road worthy. So might be easy for you to change them your self. Its all a c**t but the fine print on the papers is what get's ppl

sorry if its harsh but i tend to agree when buying a modified car that we know is defectable you cant cry wolf after that

no doubt you are taking it hard on yourself. hopefully you have close friends and family that will be able to give you some support.

well done on taking the car yard on. continue to let ca and mta know and ask them what are your options. i agree with trav33, if you can get a refund somehow then i would. From day one they already screwed you around whats to say they havent screwed you over again while they were working on your car to get it off defect.

...i wouldnt trust the safety of your car after leaving your car with them.

I got pulled over by motorbike defecting copper.. but to clear defect, it's a regency job.

What exactly needs to be returned to stock?

engine mods got to be ripped off (which have done, minus intercooler, fuel regulator, apexi computer, killswitch), suspension needs to be raised, tinting off (which has been done - front windows have been done, coupe windows still have the tint) - with the fuel regulator is it illegal or... ?

What modifications does it have which you can clearly see that you would deem non standard?

fuel regulator under bonnet. Body: mags (but not defectable - 18"), intercooler, tinting and lowered.

Did you get the "defected" parts back from the caryard?

Yes, I eventually got my parts back after afew discussions with C/A and the car yard.

As for "just walking away, because I need about the car" that's not the fact. It's the fact they are very unco-operative, and f**king up my car more than what it is. I had noticed they've also f**ucked around with my front window seal. I'll place a pic to show you all.. I'll also show you a pic of my front window chip they TRIED to fix but made it worse than what it was.

Motherf**ker!!!! I just went outside to take a pic, and found out the camera has died.. so I'll recharge the batteries over-night and take a pic for you guys tomorrow. This will show you an example of what kind of crap I'm dealing with.

Out of curiosity... When purchasing the car did you know what was illegal or not?

I tend to think maybe you didn't, unless your mechanically minded or cluey with cars etc the majority of people don't even realise the skylines can't be lowered due to regency's stupid ride height measurements being within only a few mm of factory ride height.

i'll speak to the people at work, i know that we can get in a huge amount of trouble for selling a defectable car.

cubes it doesn't matter if the customer knows its illegal or not its the yard responsibility to sell a car that is legal and not just tell the customer. We got a huge fine for putting a sticker on the front of a crossfire instead of the supplied no plates. even though we explained to the customer that its illegal, we still delivered the car like that.

id forget about the car yard and cut your losses, you need to concentrate on getting your car off defect, get a list of parts you need and id be happy to lend you any parts i might have laying around.

Rascal, can you elaborate on the "running badly" part by any chance?

Also, I thought most car yards give a 3 month warantee and that warantee is void only if the car is modified after it has been purchased, so if the car had already been modified, it should be their responsibility surely...
