Speeding Ticket Question.

i got a speeding ticket the other day... and when i was apperantly clocked doing 20 over the limit the police car was actually driving towards me on the other side of the road.. i was just wondering if anyone know if its possiable for the police to actually take a accurate reading while they are travaling 60+ speeds or so they have to take it from a stationary position... i didnt think much of it on the nite but now i am wondering...

Mate, sorry to hear that... speeding fines are always a kick in the back...

I actually had the same thing happen to me - the copper was driving towards me and then he did a u-turn to fine me etc... from my understand, there's a certain distance the cop has to be at whilst pointing the "speed-measuring gun" at you before it can give an accurate reading... I actually asked a family friend of ours who's a cop and he says that the police car doesn't have to be stationary when recording your distance (although it would be more accurate) - but they have to point it at your vehicle (whilst you are driving) for a certain amount of time / distance in order for it to read accurately... without being there with you, it's hard to comment on your situation in particular... however, I would write to Civic Compliance in your state and try to get the notice revoked as from what I assume - if the cops are in a distance that you can eye with your eyes (would be within a few hundred metres max) then I suppose the chance of them recording a credible and accurate speed would be 'questionable.'

you could ask for clarification, but it's pretty much futile.

From what I understand, the speed detector is hooked into the car, and uses the car's spedometer to calibrate itself and detect your speed.

But even if this was not 100% accurate, there is also a provision which allows officers who are experienced to "estimate" your speed. If they have the accreditation, they can book you on personal observation, and unless you have witnesses to back you up, you're cactus.

with 20 k's over, you're up the creek.

You can try to appeal, but realistically, unless you are 100% sure you were not speeding, it'll be a waste of money.

It sucks, I know. I have had about 3 speeding fines in my time, but all were at the 15 or below bracket.

I haven't been able to get out of any of them.

I even had one where I was booked in a tiny town near mildura for doing 62 in a 60 zone. The cop was right on the street sign and I got the letter in the mail. i even appealed saying that there must be a tolerence, which they said there was, but the cop estimated that I was travelling at 67 anyway, and because he was accredited, the fine stuck.

That pissed me off a bit, but it's the world we live in.

Oh, and I wasn't even in the skyline then, but my pathfinder, so it wasn't so much targetting me, as it was hitting quotas.

you've got buckleys chance of challenging the fine as the cops DON'T have to be stationary. i found that out the hard way, sucks hey

Drive slower, that'll fix it.

And it is true that all a police officer needs to book you for speeding is their opinion on how fast you were going.

But it is also true that the speed detectors work when they are driving along towards you.

Im sure the cops have got better things to do then make up speeding fines , if they give u a speeding ticket do u really think they are going to risk losing their job for somebody they dont know?????

True dat - that's right... whatever you do (as fair as the system sounds) you don't have a chance in hell.. just pay it and move on... man, they chase me as if I was naked chick covered with honey or something... LOL

radar can be used from moving cars, so yes they can ping you even if they're driving in the opposite direction. only highway patrol cars have the radar pods though.

And further to this a police officer can book you on his "opinion" of how fast you were travelling, as mentioned before.

No camera/radar/laser/flux capacitor required.

So pay the fine, you were speeding. Be a man. Take responsibility for your actions.

If you was speeding just pay the fine and get on with it . If you wasn't speeding still pay the fine unless you want to spend mega$ to defend it and when you win the cops DON'T pay your legal costs , it sucks big time but thats how it is mate. I know all about it been there and done that more than once .

I don't know the law in W.A. but I can tell you in NSW a cop ( experienced HWY patrol cop) can book you on a visual estimate even traveling the opposite direction at any speed , even around a bend, I have seen it done .

From what you say you got done by a silver eagle radar , the aerial is mounted on the rear window of the car ( drivers side), the screen in the car will have the cop car speed and the target vehicle speed . Under the cops own guidelines the silver eagle radar reading shouldn't be used if there a is another vehicle within 200 mtrs to the target vehicle and the radar should be held on to the target vehicle for a minimum of 3 seconds.

The cop wont care about using it under guidelines though, if he thinks you are speeding he just gives you the ticket because he knows you won't take it any further .

Dont have to be stationary and can be clocked comming either way .. however needs to lock on for a minimum 3 seconds .. which is why you brake hard when you see one.. thats how i got out of mine .. he was pretty disapointed too

Id also ask for backup photo etc to prove it ..

And no they cant book you on visual assumptions .. and in nsw they have to have video or radar readings to back up claims .. But this is obviously dropped if they see you driving at insane speeds.. but they've got little chance catching up then dont they ..

Sorry they can book you .. but the fine will be thrown out in court .. well if you dont drive a skyline or modded car obviously because we are prime targets.

Not only they can book you on a visual estimate but the magistrate will more than likely go with the cop . I have seen it done and the driver even had a gps in his car that showed he was not speeding , the magistrate went with the cop and found him guilty in Parramatta local court .He then had to lodge an appeal ( cost more money )and he got off because the cops desided not to "offer any evidence".

This is what I would do just so that you get it out of your system and know you've done all that you could to save a buck - and what's more this proces (up to this stage is still free of charge) ... write a letter and send it to CIVIC Compliane or whoever the traffic road authority group is... explain your case - talk logic, facts not emotions or anger as it will do you no good... give them 2-3 weeks to review the situation and they will then write back to you advising their decision on the matter... 90% they will say no - you must pay your fine and will also include a standard paragraph stating that you can have your case heard in a law court etc... if you get this response, the war is lost - pay the goddamned fine and move on with your life... however, if they decide to revoke the infringement and let you go - then you're a happy chap... nothing to lose and what's more, you can delay the fine for a couple more weeks so I guess there's no harm trying... but struggling is futile IMO...

ok.. thnaks for the advice guys... im pritty sure i was speeding.. it was for a good reason but i dont think that matters... but i dont think i was goin 26k over.. i wil see what i can do but i will prob just pay the fine and move on... was a bad nite for me... wasnt the only fine i got.. lol.. usually i keep to the speed limit and drive very sesiably.. but yeh i guess it was just a bad nite..
