Ok guys im after sum input/experiences/options/ideas

a few months ago i got hit on the side of my R32, slow hit where the other driver changed lanes and bang got me....

well she admitted to being at fault and so on, my work colleague was in the car with me at the time....

Now that its gone through insurance and so on, she now claims that i changed lanes into her, no police where called onto the scene as it was small damage and no one was hurt, plus i was on a lunch break from work.

Now my isurance company (Famous insurance) claim that my colleague in the car with me can not be used as a witness, and that i might have to pay my excess because things like this its had to know whos at fault, blah blah blah which is BS i think........

Wat leg do i have to stand on ????

Im going to get a stat dec writen up by my mate for him to sign and also signed by a JP would this be enough ???

As i do not want to pay the excess and have a claim on my record for an accident i was not at fault for....

Im shitty at this other driver as she claimed its her fault and now switching the story around, f*kn BITCH !!!

anyone been in the same situatuon before ????

wat other steps can i take to get this in my favour ????

Would it be tooo late to goto the cops and get a statement down with my work colleague as witness ????

my advice is. whenever anyone runs into you. if they admit fault at the scene make them sign something on the spot, or even use your phone to record them saying it. so many times it happens, people say "oops, sorry my fault" then when it comes time to pay for your damage, or their excess or whatever they have a change of heart and decide to screw you. unfortunately you don't have much to do here. it's her word against yours basically.

The cops are no good to you here.

I found Famous not to be really on my side with my claim. Again not my fault at all and the woman in that case stood by her admission of guilt.

The stat dec may help. Give it a go. I had to get really forceful with Famous to get my way but still got partially ripped off.

Also, ring the woman up and, being very nice and polite, tell her you are not happy she is changing her mind. Tell her you will take it to court knowing that you will both lose on costs because of the principle. Hopefully she will think you are a nice guy and do the right thing.

i was thinking she might come to her senses but famous spoke to her for 30min and was practically abused for the whole 30min by the drivers mother, brother and herself so i doubt these kind of people would have a change of heart......

you can always take her to small claims court but to be honest as it's just her word against yours unless you have some other kind of proof it was her fault (pictures etc) then you are not likely to win. and be aware that even if you do win the courts will direct her to pay you, but she may still hold out and not do it.

is this famous classic car insurance you are on about??? i would do anything but reccommend this company!!! i made a stolen car claim on my first skyline, which was stolen and torched! this was like 4 years ago, maybe a touch more. the car ( r32 gtst) was insured for 24 at the time, i had owned it for 5 months. the payout i got ( after a 15 week wait, mind you) was only 6000 due to the fact the car "depreciated" and all the excesses!!!

i tried appealing through the independant insurance ombudsman, but jack! they are a company based on an island somewhere in the carribean or something, not an australian company, therefore that particular government agence would not help

I had a similar situation but i got hit by a taxi... when he tried to back out of guilt.. i sent him a copy of the statement he had signed on the night of the incident... apparently he'd forgotten.

Good luck with this dude......and when you go to court, do not use the word SUM in your statements unless you're adding things up. :rant:
