Coming home from Geraldton on father's day I come up to a building site (roadworks).

Pass the first few signs preparing to stop and the normal stuff - 110km/h zone, first speed sign down to 80 so I slow down to 78 and in the opposite lane BOOM lights come on and I'm signalled to pull over. So I do - me being pulled over in the Skyline is a weekly occurrence - and then the day comes WORSE! (Cop) "Why are you speeding sir?" (me) "I don't think I was but if you say I did then I was. What's the speed limit?" (Cop) "60 in a work zone." (me) "Ok." --- He starts writing the ticket. I was about to leave when the older cop in the car started barking commands at him like a dog. He comes back and says "I notice you have a mod done on the back muffler any others?" (me) "No, it's just the pipe." (cop) "Open all the car." and he did a full body lookover on me and the ride.

Drive off and I pass a 60 zone sign which made me feel even worse ......... Get home and I started thinking droping the speed limit speed limit from 110 to 60 is just way too deadly. People will fish tail on the the brakes so Icalled ATM (the roadworks people) and she said, "Hell no, we are not allowed to do that it's against the law. It would have gone 110 to 80 to 60 to 40 stop if you need. We are not allowed to drop it past 40, that's the slowest."

The ticket was for doing 78 in a 60 zone - $150 and two points.

But i will be getting the gear or a letter from ATM and fighting this ticket all the way.

I am positive I wasn't in the 60 zone and it's like them charging me 78 in a 80 zone.

yeah multiple speeds within close range of each other is dodgy

the traffic mobs usually do a good job, its often when they have been moved by other people, and dont realise the implications

i went past some road works on thomas road in byford the other day and the speed limit is 80 then to 90 - but they had dropped it to 60, but the thing is the 80 sign was still visible on one side....

That's where you went wrong. If you think you weren't speeding then you don't admit to it. Hell even if you were speeding you still shouldn't admit to it.

Why didn't you contend the ticket with the officer at the time? I don't know how you could just sit there, admit to speeding when you weren't and drive off with a ticket after no contention. You should have said that you were in an 80 zone and then got the coppers to go back and look at the speed on the sign. Pretty sure it would have said 80 as when you left you drove past a sign that said 60.... they wouldn't normally have two signs along the roadworks that both say 60 (unless there is an intersection nearby).

Glad that you're fighting the ticket, but you started doing it at the wrong time and now it is going to be a lot harder and more expensive to do so.

Dino, badluck but if you know you're in the right - stand your ground.

I got done on Tonkin Hwy coming back from Serpentine on Sunday, 129 in a 100 zone - cop was nice, I was nice (I didn't even bother trying to argue it, I was blatantly speeding, got caught and accepted the consequences) and they didn't decide to be assholes and check my car over :thumbsup:

342Four I know that section right there, they had some impromptu traffic lights there on Sunday.

Quite a few people challenged the speeding tickets from the rail works on the freeway. From what I heard, more than a few were successful. This may be the stuff of urban myths, but it would seem reasonable that you could say that where they stopped you, you reckoned it was an 80 zone - hence your speed. You can contend that the signs you passed did not show a 60 zone, or if there was one, it was only on one side of the road (it needs to be on both for a multiple lane road). There should be sufficient precedent of poor sign placement on roadworks for you to argue that there was no clear indication that you had entered a 60 zone. The fact that your speed was 78 can even be used to back your claim that you thought you were in an 80 zone.

Now reasonableness and the law do not necessarily go hand in glove, but you definitely have grounds to challenge it. If it got to the point of them asking why you did not challenge it at the time (which it probably wouldn't), then you could argue that your past experience, given your age and car, meant that it was best not to argue with the cop on the spot.

If you are in the RAC, you can get legal help through them.

yea if i am in the wrong i will say so i was thinking that I was in the wrong so I took the fine after all the dust had dies down and i had time to think on the the subject. AndThe last thing i wanted to do is press this ticked off cop and start on him. I love me ride 2 much.... to get a yellow and or In pounded. For beening a punk kid with a kewl ride. :yes:

great NEWS the fine i got on this day was pull and called off with out me going to court :dry::dry::P:laugh:
