Cough i call harrassment and discrimination of import/skyline oops i forgot "HOONS" drivers... there has got to be a way to show them, considering on the basis there knowledge on such cars, or even testing there worthyness on current adr and dot laws/regs

Slightly off topic but is there some sort of book or a section of the traffic act/legs/regs or something to veiw ? like where do the cops get the guidelines to assess what is and isnt within the regs? Just one thing from experience dealing with regs/acts/legs is that it can be read in many ways and i aint gona sell the gtr just because the cops got a hard on for them. theyd have to get rid of the other cars they import from china,korea,usa,europe too. Any help as to where the cops get the info from would be appreciated.

The police derive their power from numerous different legislations. In QLD the primary one for road use is the "Transport Operations (Road Use Management Act)" found here: http://www.austlii.edu.au/au/legis/qld/con...t/touma1995434/, however that act gives broad sections that correlate to other pieces of QLD and Cth legislation which permit a range of things. Examples can be seen below, such as the s requiring you to stop, open your bonnet etc which many people believe the police can't do without a warrant..wrong.

"(1) An authorised officer may require the person in control of a vehicle to give the officer reasonable help to enable the officer to effectively exercise a power under this Act in relation to the vehicle.

Examples of requirements for effectively exercising powers--

1 requiring the vehicle to be held stationary on a weighing device to enable the vehicle to be weighed

2 requiring the vehicle's bonnet to be opened to enable the engine to be inspected

(2) An authorised officer may require the person in control of a vehicle, or a person who is in or just left the vehicle, to do or not to do anything the officer reasonably believes is necessary--

The act continues for a long, long way and I can gaurantee that the polices power is broad, very broad and is intentionally so.

However, having said that, it's still (now) a courts decision to take into consideration the laws, regulations and policies of parliament when contesting or hearing any issue of such a nature and hence if you have a good case or a reasonable excuse you stand a chance. Of course, this still requires time, money and patience. Things most Joe Blows don't have.

Many have tried, most have failed. Unless you are getting pulled over all day, everyday, and the officer basically tells you they are targeting you. The chance of proving this is slim. The issue is one of bias or some kind of prejudice which is effecting the officers ability to impartially perform his job (that is handing you a fine). This is a high bar and unlikely to be met. Discrimination is fine, they are able to target specific types of car drivers, so long as they don't discriminate on the way they issue fines. For example, you and a commodore are both in a bay, same problems, same potential defect and yet they blatantly discriminate against you for being an import. Such an example would be arguable, but again unlikely and would probably simply result in the commodore being fined, rather than you being let off.

Best chance of defeating any fine is contesting it and proving the issuing officer either; hasn't correctly tested the car and/or has incorrectly fined you for something that is dot approved and/or not prohibited by law.

Ultimately legislation is law, so unless constitutionally invalid, you're stuck with it. Sucks, but it's the way it is. Imports have a stigma, parliment is making policy decisions to the favour of the "general public" and thus anyone driving an import gets reamed.

no one has yet mentioned anything about mod plating though, surely if you have a modification plate on your car for everything that is not a stock item then there can be no contest unless you are driving dangerously or speeding.

The cop can still be an asshole and say you might have changed your mods since getting the mod plate and you'll get done anyway even if it is all legal. Which means you would then have to go to court and take time off work because of that officer. It's a great system :yes:

I don't get pulled over at all hey. Niether do a lot of others on here. And I used to go to all the 'hot spots', and never got pulled over then either.

So it begs the question, are you sure you arent doing anything wrong? Or are you sure your not trying to grab attention?

true that, i could take the boss along he will get them to pay for his time and mine....or not. but when you in court and you have everything to prove it then the judge will most likey get pissed off....if he is a c**t, then go to today tonight...i am sure they would an unfair story.

you just drive a camry that why...i reckon i my ugly head was in the passenger seat you would get pulled over....we should try it sometime.

i dont get pulled over as much anymore. they have a new tactic. i have been followed on one account by a black aurion cop car (had portable lights on dash) for about 10-15min. they were tailgating and everything just waiting to catch me out. but kept my revs down...was careful of road rules.. and they peeled off. my bro and i got a chuckle out of it as well.

this just goes to show that you are not TARGETED....well atleast not all the time..

if u drive like a hoon u are asking for it.... there is a time and a place for that....when no one is watching.

To the OP sorry to hear about all that, hope it goes well for you.

How can your steering wheel be defected? Next time they probably pick some more lame excuses, like your AC isn't working = your car is defected coz it too hot in the car which could lead to you getting dizzy & crash... :cheers: or your radio is not working = your car is defected coz you can't hear their constant propagandas on Hoons, so you will probably speed more & crash... :rofl:

So far WA cops aren't that bad (at least from my experience), no cops have bothered me with my stock R33... yet.

Was driving on freeway @ 75km/h (in 80 zone) saw a cop aim his speed gun at me & he look disappointed afterwards :cool:.

Then there were times when a cop car would follow me around, while I was still driving my skyline like my family's Camry (5km/h under limit) after a while they get tired and would overtake & speed off, may be I should report him for speeding :sleep:.

So are POD's illegal now? I was thinking of getting one to get that suction sound, but after hearing this, maybe I should just use my money & get a computer upgrade for my gaming rig instead, cops can't fine me for that... or can they?

pods themselves as far as i know are legal as long as secure and covered (85%) or some crap, i got away with it through dot with just a cover ontop not down the sides, thats with the DOT. that was 2006 since just made it slightly more box looking and effective. Steering wheel im guessing the ol doesnt meet adr specs, and for those who have had airbags, definetly a no no as you are removing a common safety feature of the car. I heard something along the lines of exposed metal area on steering wheel or ammount of it??? someone might clarify that area for me a little more...

Keep in mind my car is bright red, is an import, I'm sure the police are quite aware of that.

true that. i have been pulled over once when i got defected he was a nice dude and fair enough what he did me on i have no complaints, and the time was late one night he followed for a bit and gave me a breathaliser and asked a few questions. other then that i havent had any problems. but then again my car isnt outrageously kitted or modified.

i know if you factory steering wheel has padding or a air bag you cant change it unless its for one suitably attired. dont know about that metal showing stuff. as for the pod issue there are different stories all round. looks like i will be making an air box for mine.

we've been suffering from this for ages now in ipswich shire. i got given a notice to appear for my steering wheel months ago cause there wasnt anything else. i was following 2 cars behind the patrol car doing 40 in a 50 zone which pulls over lets all cars go past then stings me. calls it a random licence check then blatently states "we didnt pull you over cause you were hooning but because you're driving the kind of car that is driven by hoons." they took 15 min to do the 'licence check" then gives me back my licence and says the steering wheel isnt adr approved. the car at that point had been through 3 rwc in 2 statesas well as compliance. its an r32 so no air bags or anything to worry about, still standard size etc they just HAD to get the skyline for something. when i tried telling them it had been through the pits at qld transport and compliance and rwc he started saying maybe he'd write me another notice for the wheels.....16' rims, said he believed they were bald....the tires had just been put on the day before. took another 15 min to write notice for court.

so i went to court and gave them all the documentation including a stat dec saying it was the same steering wheel as when the inspections were done and the prosecuting officer at the courthouse was like "WTF????? dont worry about it ill take care of it." so all sorted with no fine but still had to miss a day of work to go to court as well as being pulled over for half an hour with everyone shaking their heads and pointing fingers when id done nothing.
