ok so i sent an email today after not getting a reply.

"13 unhappy customers, not willing to pay anymore as price quoted in Aud"

at my work we deal in Usd all the time, and definatly do not ask for more money when the dollar is Up. we live with it.

I'm running into problems.

with no way out other than getting a refund of the last payment, and maybe but unlikely one from acpt. (but i doubt that very much as the shafts are made.)

he (Sts, street to strip, Paul) is not in no way going to make up the difference.

says its mentioned on his website (which i never looked at or contacted him through) about the exchange rates (http://www.sts-forum.com/ half way down dollar sign..)

which only really stirs the pot more as i was quoted in Aud not in usd.........

if anyone feels like some light reading, send me your email address via pm and i will forward you on all the emails between us.

Was the $1400 AUS a definite quote? I would want to think so or am i missing something?

No where does it say "We will quote you on a group buy the price stands as long as the dollar holds up, if not the consumer foots the bill" or words to that effect!

There are two options.

1. A full refund including original deposit ($1400AUD total).

2. Delivery of the driveshaft with no further payment.

If one of these are not met PM me details of the supplier and all your communications with the supplier. If the driveshafts have been made then I expect a response from the supplier within 5 business days. Based on the response (or lack of) and the communication you provide I will decide what action to take from there.

And Piggaz, you only paid $1300 correct for the lower rated 1000hp shaft

this has to be a joke, how is it that a receival of payment is not a binding contract of a definatively quoted figure? Andrew quoted the shaft prices as rated per hp application, which dropped now once paid in advance for deposit on our behalf this f#$%nuckle thinks he is intelligent by trying to pressure andrew in to fighting for the extra dollars as he knows Andrew is in a tight predicament with 12 people. QLD plates, search plates address or turn up at his shop. We've all waited patiently for USA side to get their digit out, now its done this fool thinks he can manipulate the situation.

i'm not the kind of person with patience at the moment either eh. anyway, this is a current email (also using my work email while i am here) i'm not going to forward on my details for my bank. i dont think that is a good idea.

For the 4th and LAST time, please provide Bank Details for this refund.

If I have not received those details today, I will be sending the funds to

ACPT and you can sort things out there.

What an arse hat..."I will be sending the funds to ACPT and you can sort things out there." He wants the profit but wont handle the deal. Have you seen his pictures. He has a pic of John Wayne in the background...cowboy...yup he is that.

So what is the final additional charge Andrew? How about we just complete the deal through ACPT and send them a complaint regarding the type of person they allow to represent their company. Get the deal completed then pass on to the ACCC.

i think it may be around 100 bucks each (is what he is saying), there was a drop of 15c in the dollar, on the final amount of $10480 which amounts to more $1572 aud.

I am not going to be bullied or be coerced by any other method to doing

something that you are not prepared to cover yourselves and that is your

guys responsibility.

If you want to take this to a legal adviser go for it, I have, and I am well

covered. There is absolutely no case for you to have me take up the short

fall that you guys should take up yourselves.

Everyone knows that if an order has not been fully paid for and unforseen

costs occur outside of the suppliers control, let alone a drop in the

exchange rate, extra payments are required from the purchaser to finalise

the deal.

My legal advisers tell me that I am being more than reasonable and

cooperative under the circumstances and have provided excellent service.

My options as I outlined before do NOT include me making up the difference

for you guys, and will not, you make it up yourselves.

All my other customers, both Car Clubs and non, understand this and have

paid the extra required. I have had no other problems, nor cancellations or

refunds during this time of the exchange rate dropping and many customers

have been affected.

The only problem is with you guys trying to shaft me.

I'm contacting you on beahlf of the group buy organised through Sts for the skylines,

We are running into problems with Paul, as he quoted us $1400 & $1300 Australian Dollars, i have this in writing, most of the members of the group buy are not happy.

There was never any mention about the exchange rates, nor was there any effort from him to even send the balance over while the dollar was falling.

i'm not sure where we stand, as legally we the customers have had no indication that the exchange rate would effect this deal, or that we were paying in anything other than our Aussie dollar.

i have copies of every email between the two of us and can not find anything in writing to confirm his view of the deal.

This is really pathetic, someone acts as a distributor for a product and does this. Something has to be done. I am at the point of just paying the $100 and getting the bloody shaft as we need it asap. File a dispute with the ACCC etc and let them piss all over him. he isnt going to budge he is just threatening you on the refund and trying to intimidate so you pay the rest as he knows you wont be able to handle 12 unhappy people.

12 actually :P i thought i had 13 involved but i dont.

i've asked him to do the math of whats owing a few times, but no result as of yet.

i will get you to all pay into his account to avoid issues along the way.

You were quoted in Australian dollars, and he must therefore stick by his written quote.

Why are we paying more? No one has given reason why we should be paying more yet. Until I have read the correspondence from the supplier I won't be paying anything.

Where exactly are the driveshafts at the moment and what amounts have been paid to who?

the problem he is saying, is because of the split payment, $6000 deposit and then $10480 with a drop of around 15c he is suddenly out of pocket. also saying that a split payment does not fall under the rules or something.

10x 2000 hp shafts @ 1390aud and 2x 1000 hp shafts @ 1290aud (sorry i got mixed up before saying 1400 and 1300)

15656 was the total in usd at the beginning @ .95c

6000aud was paid @ 95c which is $5700 usd.

leaving a remainder of owing $9956 Usd. with us only having $8384 usd @ current .80c rate.

But alas, we wernt ever quoted in Usd or had any mention about exchange fluctuations.

a rock and a hard place!!

will await what james says about the whole deal tonite when i expect a reply from him.

Exchange rates aren't your problem and they aren't our problem. We were quoted in AUD. Unless there was some specific mention of variances in exchange rates in either your quote or in terms and conditions as provided at the time of the quote by the supplier then the prices as quoted stand.

another option may be to sit on the deal temporarily (if you're prepared to wait) and see if the $AU recovers in the next month (which it will to a certain degree)........might be a way of cutting some of your losses.

You would've had him if all the money was paid up front but unfortunately deposits alone don't secure price on international deals..........no different to dealing with Nengun who also quote $AU and can change it on you overnight without warning unless all monies are paid, they don't need to issue the fine print regardless of currency quoted.
