well well. today i was wrongfully booked for speeding.

heading south on the f5 between narellan rd and picton rd, i was doing maybe 110. i rarely speed on the f'way. overtaking a few slower cars, i saw a green citroen come up behind me doing at least 130, probably more. as soon as i cleared the cars i moved over into the left lane, and about 5 seconds later noticed that fkn unmarked purple ss (anyone from around these parts will know it), on the side of the road behind some armco. although i am on P2 i wasnt worried and assumed i wouldnt be booked for 110, so i just tapped the brake and kept going. checked my speed, maybe 108. in this same few seconds, old mate in the citroen flew past me in the right lane...

as we got closer friendly policeman leaps onto the shoulder and points at the citroen, which is now in front of me, indicating it to pull over. almost immediately the citroen merges in front of me, then slows down and pulls onto the shoulder and stops. i continue on my merry way, cursing the police and feeling sorry for the citroen.

then to my horror, the partylights start up, and drive straight past the parked citroen and eventually catch up and pull me over. i thought it was some kind of joke, and indicated as such. policeman claimed i was doing 122 and he got me when i changed lanes. i said there is no way that was correct, knowing from past experience they rely heavily on you admitting guilt. i asked them about the citroen, and they said they had seen it, but apparently got me on the lidar, not him.

cue bullshit about my exhaust being too loud (it isnt), defect for rear tyres (fair enough, they are almost slicks, but i have rego soon and was just waiting for that). the cop wasnt too bad, thankfully didnt check under my bonnet... but eventually came back with the 2 tin's, $238 and $79, and claimed if there was even 1% doubt over which car he caught, he wouldnt have booked me *loud scoff*.

now, i fully intend to take it to court, even if only to waste their time, and hopefully get my full licence in the interim (because this will be a suspension otherwise). but im actually confident i will get off it because:

-no sign before the radar trap, which reeks of revenue raising, not safety.

-cop claimed i was changing lanes when he "got me", therefore its a moving target, AND changing lanes TOWARDS the lidar will obviously cause a higher reading than your actual forward speed. (lane change of 4m/s = 14.4kmh)

-the citroen pulled over and stopped all by itself, how big an admission of guilt do you want?

-the cop didnt tell me our discussion was being recorded, until i made a point of asking.

-the cops said they had no video of me being "caught", but it is my understanding that there should be footage of them once they switch their lights on. therefore, they will have captured the citroen pulling over, but they chose to ignore it and target me. (there should be no excuse for a failure to produce this footage)

-i vehemently denied all wrongdoing in the recorded interview.

-the defect penalty for the tyres doesnt actually indicate i have to replace them, its just a fine, which again reeks of revenue raising with no regard for safety.

any advice welcome!

Have been booked before? (non-defecting related)

but YES,

take it to court, represent yourself, tell the magistrate what happened, and YES, you are pleading guilty, the cop was beyond the reasonable of doubt that you were speeding unless he has shown you a photographic evidence of you speeding, plus you said the cop was recording the conversation? is that right? is so, he HAVE to tell you this scenrio/case will or have been recorded, and WILL ask for your permission if you wish this to occur.

As you the defects, you have to deal with it.

But if you can put up with a good fight in court, 95% of the time, the magistrate will let you off, and will saying like "don't come back"

but then again the worst case scenario is pay the fine.

claimed if there was even 1% doubt over which car he caught, he wouldnt have booked me.

lol he sounds pretty sure of himself, wonder if he's willing to write a full apology if he was 100% wrong.

lol.

He won't write a full apology letter, cops deals with hundreds of cases like this one everyday, and if they

are the wrong, it will be a simple statement, then goes in the archive

for failure to display p plates, twice, one of which was so trivial i got off in court.

on friday, i am in court protesting a burnout that never happened and the cops couldnt have seen, even if it did happen! i better get off that or i will go berserk... and bonus, then i can claim repeated victimisation by police lol.

i have terrible luck with cops.

why do you think i should plead guilty? i dont believe i am. and when i pleaded "guilty with an explanation" to the p plate crap, i got off the fine but bloody rta still took my points. hence in this situation, i may escape the fine, but will still lose my licence.

:D

Oh ok.

Plea guilty obvious you have committed an offense, under the common law, if you can't simply say that i don't believe im guilty because the police has the powers to believe in arrests or in this case to pull you over and fine you with a ticket. Then again this matter will be dealt in a local court, as you maybe aware of, the magistrate have to deal with shit loads of cases like yours

each day, if you plea not guilty, he/she will most likely to re-schedule to another day.

Good luck with your case on friday, hopefully it won't be a busy year for you mate :D

i dont understand what you mean at all. if i wasnt speeding why should i plead guilty?

oh and i know what happens if you plead not guilty. they set a new date, wasting another 2 months, and call the cops in to give evidence. its nervewracking, since they are prone to lying, and the magistrates are prone to taking their word as fact. but i will demand to see the video footage, if they cant provide it... would seem rather sus, no?

if nothing else, at least the cop will have to spend hours writing a stat dec, and look like a fool when i ask him tough questions in court. oh and worst case scenario is maximum fine and $70 court costs lol.

So they don't have any evidence on your speeding offense at all?

and there were no proof of burden to backup what the cop was saying "you were doing 122"

just a little "122" on the back of the HANDHELD lidar. which as we all know, could have been from any bloody thing and doesnt prove it was my car doing it. esp, with several other cars in close proximity.

It's not really important if the car is 'hoonish' but more so the driver,

because on the day, it is the person who'll be representing him/herself in court, not the car.

If the judge sees you as an upright citizen then the ruling will go more so in your favour.

Dress smartly and be punctual, that's my advice.

1. They don't have to put up signs for the radar trap. Only for fixed cameras.

2. You're and idiot if you haven't replaced them. Bald tyres are so dangerous and can cause major accidents.

Waste of time.. I'm pretty sure even if you do get your full license they will back date it.

You just said it. Why complain.

Everyone seems to have such a bitch and moan when they get caught.. Sesh.

Once again Corrine, If you don't have anything useful or nice to say, DON'T BOTHER SAYING IT!!!!!!!

gt-ahhh! - according to myself, you have quite a strong case. If it is as straight forward as you said it is, i don't see hwy you would lose. You are most likely suffering from age discrimination.

It has happened to me before, i was gonna get the cop in a lot of trouble, but it aint worth it. I was driving home one night and went through an intersection at 30k's next to another car when the light changed to orange, and then red as my front wheels went over the line. I crossed the line before the car next to me, but the cop decided to change direction and follow me for 500m before he pulled me over for a random breath test.

Told me a ran a red light light etc etc and i asked him if he got the rego of the other car as it would be only fair to charge the 70yr old female driving it too.

He directly told me that as a P plater, i am an easier target and that they would defiantely go for me first - i was driving my mum's corolla FFS...

I told him to his face in a polite manner that it was harresment and i didn't appreciate it. I asked the cop for his full name and badge number thingy and told him that as soon as i got home, i'd be back up at the police station with my father and my lawyer.

He said there was no need for that, and that he would let me off without a charge or any sort of recording.

thankyou. the car is not particularly hoonish, its a nice clean r33, although he didnt walk around the front to see the fmic and all that crap.

and i agree completely re: court. i have been a few times now lol, and you can plainly see the disdain given to bogans by the magistrate/judge. whereas i wear a sharp suit, have a nice tidy haircut, and my speech is clear and articulate.

mind you, in a past hearing, the police prosecutor pulled up info on his laptop about gtr's and rattled off all this rubbish about how the car is famed for street racing and other hoon activities (i own a gtst). and went on to suggest i bought the car so i could be a hoon. naturally, i had a chuckle to myself. and answered all his questions with straightforward "no, thats not correct". they usually try to make you angry and hope you make a misake.

well actually i wasnt complaining about the tyre defect. "fair enough" would indicate this. i agree with you that they can be dangerous, but what is rather stupid is that theyre not actually forcing me to replace them, i just have to pay a $79 fine. im pretty sure i will get over that... and the state gov will enjoy my money more than i ever could...

i also realise bald tyres can void insurance, so it is in my best interests to replace them. right after i use them for mad launches at WSID.

"when they get caught"...

mate i WASNT speeding. im pretty sure you would have the shits if you got booked for some other wanker who OVERTOOK me right in front of the cops. and then pulled over all by himself!

god, its not like i was street racing and complained that i was done while the other guy got away...

thankyou for your bitter and largely unhelpful input.

kind regards to everyone else.

It was useful..

If you have a problem with my posts just ignore them. You always have to whinge about everything I say. It's really starting to become a bore.

P.s it's spelt Corinne not Corrine..
