Hey guys, Got hit in the back by this lady last week.. Went and got a quote from a local panel beaters, came back $852.. I've tried for the last few days ringing the lady's mobile, also called house phone twice and left a message with her husband to call me back but still havent heard anything back and i wanna get it fixed because im going for a re-spray real soon.. Whats the best way to go from here? Called up RACV they see her on there but she hasnt made a claim, they said if u cant contact her or she refuses to make a claim i have to seek legal advice.. Dont know how much thats gonna end up costing me though anyone know what to do from here?

Just tell that to her or her husband.

Please be prompt in making the claim, I need to get this fixed quickly. If a claim is not raised soon ill need to continue with legal proceedings against you.

Just threatening her should get things moving hopefully. Othewise talk to a solicitor.

Some lawyers only charge if they win a case and will have a free first consultation. Usually alot of small local lawyers. Work trying to find one to have a quick first talk with and find out where you would stand.

But yes, of course you dont want to have to spend too much. I know court costs can often be claimed back as well if youre found in the right (obviously are).

One thing first though is you should check with her insurance company what time frame she has to lodge a claim, as if she legally has a month to lodge the claim, you dont want to press matters beforehand as its pointless.

Ahhhh yeah didnt even think about that! Can get her on the legal costs.. But yeah i'll go ahead and ring her insurance company again and find that out.. Think i'll go and get 2 more quotes as well, if i had to take it to court would they need more then 1? I was thinking just get the highest amount and take legal action on that since i'll be getting paid out anyway..

I see your in the SE, any suggestions on any lawyers?

you could use one of the services like Slayer & Gordon. as dogknight said above they only charge if you win the case. and when you win they take a certain percentage out of what you win, only problem is they don't act as fast with the case. but its worth a shot getting a free consultation done to see what can be done about it.

knock on her f*king door, and show her and her husband how serious you are about getting ur car fixed...

sometimes people take kindness for a weakness, so they might think by u only calling that ur just a nice an simple person, f*k that, knock on the door raise ur voice if u have to....

lol she lives in fkn mt. eliza.. dunno wtf she was doing in the south eastern suburbs but ahh well.. i just wanna get the cash, not so fussy about getting it repaired (can use the money towards the re-spray its just the rear bar needs to get aligned a bit where the lights are)

i'll call tonight around 8-9 she should be fkn home by then since i called last time in the afternoon and she was at work.. and i'll tell her i need that claim done.. ill give her some time if thats not done i'll have to take it further.. she seemed like a nice lady like 50'ish so i thought she'd be co-operative not so dodgy! :banana:

Don't you have any insurance of your own? In that case, you simply make a claim on your insurer, and they take over the worry.

I was planning on getting insurance next week because mine expired and i didnt bother paying the renewal.. sucks tho would be nice to not have to do all the chasing up i couldve just got it repaired and gave the repairs to just cars to chase up

Hmmm it actually aint that far its just the next suburb past Frankston.. but if i rock up and its the husband going wife isnt home wat am i supposed to do just go home? If i go i'll go on a weekend to make sure she's there, thats if she doesnt pick up..

Yeah 3rd party wouldnt have covered me but since not my fault insurance wouldve taken care of all this sh!t for me if i called em up and told em what happend

Just rock up, tell whoever answers that its costing "X", shove the quote at them.

Then tell em they have one week to come up with the cash and/or make a claim or you'll be back with a lawyer and a court appearance.

And tell them you'll report it to the cops too... they wont do anything but that sometimes jogs people :D

That'll scare em into action, if it doesnt then lawyer up i guess and send em a letter

She says I was waiting on your quote so that I can send it to RACV and launch a claim on your behalf.. I just told her nahh this is how it works.. call RACV now and lodge a claim then call me back with the claim number. How'd she expect me to give her a quote when she never calls me back! Man some people really sh!t me..

had a similar issue when a truck hit the camry. he provided all his details but refused to make a claim. so basically we took the car into the panel beater, panel beater fixed the car and then they got their lawyer to issue a letter of demand to the truck driver. this is basically a legal way of saying "pay up cheapskate or i'll see you in court". you shouldn't need to hire a lawyer, your panel beater will be able to take care of it if they do insurance work. also it always helps if you report the crash to the police as soon as it happens.

man when and if they respray your bumper... tell them your not happy with it, and they will have to respray the whole car!

Kaz180: Have to call RACV, they might want me to take it to a RACV preferred repairer.. i did that before and they refused to give me a quote unless i had the claim number.. tight asses i had the day off so i needed it done then!

    • The cam I am actually putting in (a few posts up) is actually smaller than my current one. At least duration/overlap wise. All the chop stuff I hear just sounds like an engine running badly, because it is. I then envision driving it around in 1st gear and being massively sad about it bucking to the beat of said chop. There is an idle video of someone with a similar cam floating around the internet, but mine is a custom cam (so is his) so it'll never be the same, plus the fact exhausts are entirely different. What I want to do is put some bullet mufflers/race mufflers in to replace a couple sections straight pipes that currently replace the two extra cats that I don't need. But this is even further down the line!
    • I can tell you now, when the bracket that the little hydraulic ram attaches to snaps, with a subframe, and V8 from an AMG C63 on it, it sounds like someone letting shotgun off right beside you. It leaves your ears ringing, and a huge thankfulness that you never ever put a body part under something heavy that's only supported by a hydraulic lift...
    • Still not a guarantee fix. I used a high quality butyl-mastiq (the black goo that's not really silicone nor polyurethane, same stuff they use from the factory that just spreads out like melty cheese), and I still get lots of water on both sides of the trunk when raining or washing the car. I also suspect the factory spoiler rubber gasket might not be sealing well, so I'm thinking of adding a thin layer of grey silicone around the bolt holes on both sides and see if that's where it also leaks from. The biggest issue is that these cars don't come with a drain hole on each side like other coupes and hatchbacks.
    • I hate it, but maybe he could paint it Monster jam style and call it...godzilla?
