since he was over the BAC level, his insurance (if he has any) shouldn't cover him, which means in the end you will most likely be paying for your damages but not his. you could probably try and take it to court but that would only mean time loss and headaches. wait till you go into the police station to sort stuff out before a claim is made to the insurance company and see if you can strike a deal with him.

otherwise, a couple bricks through all his windows would be a lovely present back to him

First of all - sorry to hear what had happened to you.

I know it's heart-breaking, but keep your chin up mate - unfortunately, you hit him so it will be your fault entirely as far as insurance is concerned - your best bet now is to get the cops on your side and provide this statement to YOUR insurance company.

What YOUR insurance company will do is subrogate - which means, they will indemnify the other guy as far as they feel it is deemed appropriate and then will seek to recover from the third party - with consideration to what had happened and him being drunk at the wheel - they will try to push for a bi-lateral agreement which may help you get some money to fix your car. I recommend you to call your insurance company and have a good chat with one of their consultants.

Like some members have suggested, I would keep a log of all discussions (including time/date and notes) and just see this through mate.

It's quite strange - I too was driving on Springvale Road (minutes away from the police station) and this Toyota Aurion speeds up and plonks itself in front of me - I didn't pay any attention as I was so tired and I never engage in street drags anyways... then he slows down on purpose - it's a 60K road and yet he's doing like 40K - I knew it was trying to tease me... I was like WTF is his trouble... so I changed lanes... he speeds up and overtakes me... I still gave him benefit of the doubt and thought it was coincidental - so I changed to the original lane (left) - the guy does it again... so I knew it was trying to tease me... soon I had realised what he was trying to do... he was trying to make me speed an "HOON" so that I can get snapped by the speed camera's in the area or worse get pulled over by the cops and either defected or fined for speeding...

So kept cool, drove slow with him... and the bastardd follows me all the way to Princess Highway... so I sped up (seeing that it's now a 80K road) - and wined down my window and shouted "what the helll is your problem?" He turns out to be a guy in his early 40's at least and he replies... "you bloodddy hoons, with the new laws they'll put you away sooner or later..." I was like, what the heck - he then winds up his window and ignores me - soon we parted ways but that was so stupid... I don't know if you guys notice this, but some times (especially with older drivers) - they give you this stare as if you're a thief or a criminal for driving a sports car. One of my friends got called a "blooddy racing driver wannabe" by a older woman when he was next to her and doingl ike 40K .

There was a radio broadcast (I think someone's posted it here in the Wasteland section or something) inviting people to call in and voice their opinions on the new Anti-Hoon laws... most of them were older people - all complaining and laughing in victory as if they're targetting not just the ACTUAL HOONS (and I must say, these minority bastards gives us a bad name) but also ANYONE that drives a performance car.

It's sickening, really is... so yeah buddy, you were either in bad luck or you were framed by that idiot ... nothing better to do then pick on us... just because we drive performance cars doesn't mean every one of us will drag, speed and kill people and ourselves... sickening, purely sickening!!!

I'm sure he wished he could buy a Skyline when he was young, but he's having a mid-life crisis and wants to get a "true" sportscar to impress the young ladies ie., the mighty 200kw Aurion instead of a Camry.

Come to think of it, his driving should qualify him for dobbing him in on the hoon hotline.

Not too sure if you saw my previous post in this thread, but i dont think this is quite true spunky munky, as there are cases where the person who got hit is found to be at fault. Either way, check out my previous post for an example! Having said that, it is heartbreaking. My old corolla was hit by a taxi driver It cost me $18 to fix the damage. Couldn't even tell it had been hit. It looked like new. Then i got a letter from the taxi owner claiming $5500 worth of damage to his taxi. Lying dodgy bastard. It is heartbreaking indeed.

Basically, he was in my blind spot, and I cut him off in order to turn right into a street. If this gentleman was driving eratically, quickly got into your lane and slammed on the anchors, you could argue the same point right?

what most people dont realize is that leaving a "safe braking distance" also applies when you pull in front of someone.

LOL, that has happened to me before whilst driving a truck, some f**ker in a barina thought he would play games and kept hitting the brakes, in the end i get pissed off and hit him, i got a couple of scratches on my bull bar and he didnt have the balls to stop.

i do understand that by law im pretty screwed but i feel as if theres still some hope for me to get money for his alcohol limit.

just thought i'd share that i remember when i said whos gonna fix it since it was your fault he replied

" wheres your number plate" turns out that it fell onto the floor so i ran back ( cause we turned down a small st to talk) and gave it to him. he took out the excisting screws and put my number plate back on and told me its fixed! your mum wont even see the damage. f@#ken smartarse -.-

i do know that my damage isnt nothing major major to be pointing out on the forums but the whole idea was just to point out to all the sau members out there that love your cars and to know how shattering it is to have your baby hit and not look the same anymore to just be patient and drive safe. keep an eye out for everyone on the raod and i do find it stupid how skylines are stereotyped as HOONS. because i know not all of us are like that.

to take care of your car if like a great hobby and drive sensibly (petrol prices as well but i know that sometimes doesnt stop us)

just good for everyone to be aware and dont do the mistakes that others have made, so im hoping that this made some impact on some of you guys driving out there.

Yeah fair point buddy... it can go either way... but we're talking in the circumstances here - but do hope the bloke that caused this problem does cough up some cash for this poor guy.

Funny things happen on the roads and it's funny who the cops always tend to hold an unbias stance... guess it's their job to.

I know this accident most likely had a lot to do with being over the limit, but you should consider the fact that you were in the right lane of a multi lane raod, sitting beside another car so that this guy could not overtake. When he indicated his desire to pass (with a flash of high beam), you braked in front of him.

The accident would most likely not have happened if you had been keeping left and the guy had just been able to speed past in the right lane.

I know that if i come up behind someone who's sitting directly beside another car on a 2 lane road, and i'm not able to overtake, I may flash my high beams to indicate a desire to pass. Often the car in the right lane will complete their overtaking manouver and pull back in, or will drop back and let me past.

Occasionally they'll put on the brakes, just as you did.. I would usually think they're trying to be a smart-ass and drop back until a siutable overtaking oppoutunity presents itself.. When it does, i'll pass and just think "what an idiot".

If this guy had done the same, you'd have been ok, however the beer has obviously made the outcome quite different in your case.

Police should forget all about other offences for a few weeks and concentrate on enforcing the keep left laws. If you drove around europe in the overtaking lane, you'd be run off the road within a day.

i think i the law is and correct me if im wrong that u must always stay in the left lane unless overtaking.

but not sure if it applies if your doing the correct speed limit. cause usually the slower people that drive under the speed limit are in the left lane.
