Hey guys i was invloved in a nasty acco with my skyline yesterday i was t boned coming out of a t intersection the other bloke was doing about 60 km a hour when he hit me. I can't remeber shit coz i was knocked out cold. But i went back there today and there where no lock up marks till where old mate hit me. This bit of road its not uncomman for people to do 70km in this 60 zone, so it was quite posible that i just misjudged the blokes speed and cut in front of him. But the marks are really weird coz his tyre marks start after where he would have hit me and they run up the gutter and just nudged the telegraph pole. So he oversely did not see me. which is hard because there is shit loads of visson there. So my question is is the other bloke gonna be hit with a fine also or is the sole blame going to be placed onto me. I can't argue with anyone becasue i was knocked out and can't rember i will try and get some pics up in the next couple of days

fine? depends. If cops came to the scene, could give neg driving to both drivers. If cops were ther & you were injured, they may ramp neg driving up to drive in a manner dangerous (inflicting harm or something). If no cops were at the scene, I seriously doubt any fine/penalty, other than insurance.

If you were out cold & taken to the hospital, they would have taken your blood, as a matter of course if you are in a MVA. They should give you a vile sample too. Hope you haven't been drinking, as it could be you who has the explaining to do.

Just glad nothing worse happened, though concussion is pretty f**ked up, & your memory just prior to the event may be gone, retrospective amnesia.

cops where there, ambos cut me out of the car and i was in hospital for most of the day. I realy can't see them charging me if neg it should only be something like not giving way corsing a acco or something and i rarely drink anyways. last time i drank was 3 weeks ago lol

As far as I know when ever cops give penalties for MVA's the first thing is neg driving regardless of anything as there was some form of negligence on the parties at fault to cause the accident. Then the penalties roll on from that depending on the circumstances such as drinking blah blah blah

its hard to explain what happened. I can't see myself pulling out infront of a van i say what would have happen is that i have seen him at the last sec and stoped just before i entered the intersection and his tryed to avoid me but in the process acutally colected me full on by trying to duck in behind me who knows.

we need more info mate. was it at a set of lights? did you have a stop sign? or a give way sign? did he have one? were you turning lef? or right? or was it a 4 way intersection where you were going straight? was he going straight or turning too?

it was at a t intersection with a give way sign i was turning right and the other bloke was coming down the hill to my right. There was plenty of visson i will post up some photos tomorrow which show it pritty clearly. His skid marks only start after the spot where he hit me its wired like i said kinda hard to explain to

shiet~! wat an idiot to coming speeding down like that, musta been speeding for sure if there was such a big gap and he suddenly hit you whilst u were turning.

Gotta be careful in situations like this, it'd be your fault for making careless decisions.

However, if he was speeding its 100% his fault!

So im pretty sure if you could explain to the cops that the other person was speeding, it'll be at his fault.

cant coppers tell if he was speeding by judging the scene of the accident? like the tyre marks, positioning of the cars etc?

Did you have the give way sign or did he? like others have said if he was speeding his fault, but if you had give way and he is found not to have been then your fault. Really depends on evidence because its not what you know its what you can prove at the end of the day.

Sucks tho, glad you werent hurt to much... is the line a write off? t-bones usually are arent they...

Yeah i say it is a write off the driver side looks like its pushed in pritty bad and the roof is pushed up to i will know tomorrow when i speak to the smash repairer i say its 95 % likely.

i had the give way sign. the tyre marks start where he would have hit me and that was behind the stop line its almost if he swung to miss me becasue he was thinking i was gonna cut infront of him but instead cleaned me up becaue i stoped and than hit the ankers after he hit me. WIERD :D i will let you know what the cops think tomorrow they haven't contacted me all weekend and this happened firday morning so i am ringing after i get back home from the doctors and from getting my shit out of my car.

Hmmz, sounds like a tough one to diagnose over the net mate. At first glance it appears to be all your fault but second look not so sure. It would depend a lot of where you both were exactly in relation to the intersection but the possible speeding I don't think will be a factor.

At it's most basic level, you were supposed to give way and it appears you didn't. He might have made some crazy crash avoidance move which went wrong though.

hey guys heres acouple of photos of the car and where it happened. In the photo you can clearly see there is plenty of visson come down the hill thats what i can't get. The other one shows very clearly old mate didn't try to stop but alo bob i think he tryed some crazy ass shit to miss me but coleted me instead

From the damage to the car it looks like you're pretty lucky to survive that with just a bit of concussion! That's definitely a write-off - if the roof is buckled, especially like that, they very rarely bother to fix it. Also, the door sills are equally as bent, as is the A-pillar.

Where were you coming from in the intersection, and where was the person who hit you coming from? If you were turning right, from the Give Way sign, into the intersection to go where that white Magna wagon is, then I'd assume you'd be at fault.

Even though, your in the 'give way' position, didn't you say that you didn't see any cars coming from the right before you left your line? Which means the other car was definitely speeding down the hill or not paying attention. Its his fault!

    • Sadly I can confirm if you are actually seeking to drift, you will quite easily spin up one wheel. Even if you're going in a straight line. I am not entirely sure of the metrics/terminology here but there's only a certain amount that the helical will actually spin both wheels. I've seen it on video with my own car where two lines of smoke switch over to just one after you really get in to it. Unlike with a clutch diff where you can keep your foot planted until the car regains grip, in my experience with the helical you want to be utilizing traction control allowing LIMITED slip or lifting (partially) when you start to spin up both tyres with a Nissan helical. Which makes them pretty sub optimal for drifting duty. That said... this is probably a helical on numbers alone. Just put the Kazz in

    • Unlikely, as per Greg's post. This is not helical diff behaviour unless one wheel is up off the ground. Shimming what? You don't "shim" a mechanical LSD. Probably not in the sense that you have heard of people "shimming" a diff. And the process that Nissan f**kwits call "shimming" a diff involves super-preloading a VLSD cartridge against the side of the diff to create a friction/wear point (in a place that it wasn't supposed to have one) to make the sloppy, useless, viscous diff into a hybrid viscous/mech abortion. In case it isn't clear, I consider the process to be stupid. Nike.
