gdogzgtr Posted June 4, 2008 Share Posted June 4, 2008 I believe that the bouncer has gone too far, obviously I can understand where he is coming from as I deal with the same drunken idiots also but your never justified to kick someone on the ground. Now I don't know this bouncer but I personally have seen other boucers king hit people just for copping verbal abuse. I have even had one about to fight me and the only thing that saved me been assaulted was having my badge on me. One of our main sayings is "The success of an operation will be judged primarily on how force is avoided or minimised" It's much easier for me as we have OC spray which avoids alot of physical confrontation, handcuffs etc I can guarantee if that was member of police force he would be charged and loose his job. On a similiar note I was working in an area of our police communications Saturday night in town and the amount of fights/brawls and assaults is insane I monitored every job in metropolitan melbourne and about 90% percent of jobs were fights/assaults and at most stages of the night all police were tied up dealing with them. There is a major lack of frontline police and I personally don't feel safe to go out in city. I grew up going out in Frankston and area's like that and never had any issues and never felt unsafe but ther is definitely a different feel/culture nowdays and it's only going to get worse if you ask me. I still don't approve of hitting someone while there done in any situation. I've seen a few guys get bashed by a 3 bouncers on 1 patron while he was on the ground. The bouncers were also using small batons. Not sure what they did but its too bad something like that didn't make the news (it happened about a month ago near Flinders street station). Everybody has that " Button " inside that if pressed the right kind of way will result in uncontrollable rage...And yes I am guilty of what the bouncer did also once.... Why? well I copped a cheap punch in the face from a guy bigger than me when I wasnt looking...Rage took over...Before I knew it I kicked the guy 6 feet across the floor...Do I regret what I did ? GTR_STEALTH Posted June 4, 2008 Share Posted June 4, 2008 Yes, definetly agree that just because the Crowd Controller was verbally abused and spat on doesnt mean he is legally justified to give him an ass w00ping. Crimes Act 1958 Section 462A. A person may use such force not disproportionate to the objective as he believes on reasonable grounds to be necessary to prevent the commission, continuance, or completion of an indictable offence or to effect or assist in effecting the lawful arrest of a person committing or suspected of committing any offence. In this case the patron is guilty of assault if he did indeed spit at the CC or even just threatened to do so. Also, if the patron was seen by the CC assaulting or pulling someone out the car then he can go over and stop the patron from doing so as ( i would) believe on reasonable grounds to prevent the commission of an offence against the other citizen. However, The CC used disproportionate force which means he too is guilty. So as i said in my first post here; morally the patron deserved an ass w00ping but legally the CC is guilty... I doubt many of us would be able to endure the kind of abuse they recieve in our workplaces on a daily basis. It's always been the same, average little man gets drunk, then somehow thinks it'd be a good idea to pick on the largest man in the room. After being baited for an hour or so large man loses the plot, little man ends up crying and large man is labled an animal.
