Made the calls today, Spoke to the seniour sargant who told me to go see the guys at the pits and they can help me without having to pay. Guys at the pits didnt want to know of me until I payed them their $. Spoke to the seargant again who spoke to the officers and then told me that the yellow sticker stands and that my only option is to seek legal advice and/or file an official complaint in writing requesting damages to be payd. In either case I have to take the car over the pits again and pay the $.

The official complaint is deffenitley a goer...

Will call for some legal advice and see where I stand to...

Another example of well looked after cars been targeted because of its "label".

It is a shame that they targeted you. You've had enough on your plate to then cop this (pun not intended)

Just wrote a letter to the Officer In Charge Of Traffic Enforcement Group stating all the facts from the first yellow sticker to the last including car break in and saying that I wish to resolve this issue without the need of a formal complaint if possible. Its in the mail first thing morning.

If that does not get a reasonable response then formal complaint it is.

Either way, no matter how you look at it, there is nothing we can do about it! This is what happens when people like us ignore it for so long... think of it as womens rights, nothing is going to change unless everyone stands up and says something, but, that will never happen so we just gotta deal with it... same as oil, everyone just takes it, so they get away with it... anyways, could go into alot more detail but ill stop whoring your thread, sorry man...

RE: Grievances regarding a Vehicle Defect Notice

Dear Sir/Madam

I write to you in regard’s to the defect notice that I received for my vehicle (1989 Nissan Skyline GTR) on the 11/06/2008 around 11:00am.

I have just had the vehicle passed by the Vehicle Examination Centre at O’Connor on the 06/06/2008 where it was deemed road worthy and the previous vehicle defect notice removed. Previous defect notice had the following items listed on it:

• Modifications to comply with vehicle standards act

• Wipers to be rectified

• Tire on the spare wheel to be replaced.

On the morning of the 07/06/2008 between 12:00 (midnight) and 6:00am my car was broken in to and several items were stolen some of which include the drivers side seat and the gear knob, rendering the vehicle un-drivable. Police report number for that incident is: ############

I had managed to source and fit a replacement window and replacement factory seat by the evening of the 10/06/2008, however I was unable to source a gear knob at the time.

On the morning of the 11/06/2008 I had to go to Lakeland Senior High School to deal with a computer issue that they had and had no transportation but my own and was unable to pick up a gear knob until later that day.

Upon leaving the school I was stopped by Constable Collett and Senior Constable Endall of the Traffic Enforcement Group and they proceeded to inspect my vehicle. I informed them immediately that the vehicle had just passed an examination at a Vehicle Examination Centre and presented to them the invoice that I received for doing so. I also explained that the car was broken into and that a replacement gear knob was being picked up later in the day. The officers then proceeded to issue me with a new defect notice that lists the following items:

• Spare tyre to be fitted (rectify) - not required for road worthiness

• Wiper blades to be rectified - As inspected on the 06/06/08

• Exhaust to be inspected - As inspected on the 06/06/08

• Gear stick to be fitted (rectify) - Stolen on the 07/06/08

• Wiring to be secure (rectify) - As inspected on the 06/06/08

All of the items listed are exactly the same as when they were inspected at the Vehicle Examination Centre on the 06/06/2008 with the exception of the missing (stolen) gear knob which was being replaced later that day.

Immediately after I received the defect notice I consulted with the Vehicle Examination Centre and was told that it was not a requirement to have a spare wheel in a vehicle.

I feel that it is severely unjust that the officer issuing the defect notice had no regard for the fact that the vehicle had already been examined only a few days prior and deemed road worthy. I also feel that it is unjust that I am getting punished for having my gear knob stolen and therefore not present at the time of this incident. Especially considering a replacement gear knob had already been organized and was to be installed soon after the incident.

I have since spoken to the Senior Sergeant in charge of the officer’s who had issued me with the defect notice and was told that there was nothing he could do, and that I would have to get the vehicle re-examined and therefore also pay the examination fee again. Again this does not seem fair.

I do not wish to make a formal complaint against the officers at this stage as I hope to resolve this matter without the need for one.

as for Guy's comments about not being able to do anything...

with legal advice or if you actually get a Lawyer, thing is... you can try to get compensation seeing as though you've lost time for work and whatever...

especially if your car is roadworthy and they can see that there is no reason as to why you should spend an extra $80 or so dollars to get another check...

get them to pay for it, and all legal costs to be covered if you can sort it out with the right advice, try it man worth a shot

Yep, best way to do it.

THen its dated etc.

So if you bring them to court over it, you can bring a dated letter to prove that they recieved your letter of compliant on a certain date. =)

Usually they have 7 days to reply but not sure about this... Could be different when dealing with the police. (I delt with consumer protection... which i had to send the complaint by registered post).

Just go into the post office and ask them, and they will sought it out for you im sure.

Why did they pull you over and what did you say to them.

THey pulled me over mostly because they were bored i assume... I was doing a whoping 40kph in a 50 zone when it happened.

Was as polite to them as possible as I always am.

Reverse to front door

Proceed to turn your tyres illegal by instantly wearing them past the tread indicators on the spot

you said to them that you was picking it up later on that day, but how do they know you was serious? what if you been driving around for couple days already without one and just thought of that excuse on the spot??

and even if you tell them your car just got broken into and stuff stolen, when they pulled you over they probaly thought ur talkin sh!t because windows were all good.

can have a go at me or what ever but to me, i reckon its a slight chance your gonna get off.. because you admitted driving without a gear knob

Not having a go but genuinely want to know how driving without a gear knob is actualy dangerous...

Yes driving without a gear knob is dangerous...then again it depends on what is dangerous. You can be yellowed for just about anything...unable to read the shift pattern on your gear knob- Lets say a cop, other emergency service personnel or even a mechanic or dare I say ...valet :( has to move your car an emergency or whatever he may select the wrong gear (reverse) and launch your car into bystanders. That's why gear knobs that aren't embossed often come with a stick on plate for the console.

    • The MX5 has had some annoying rattles in both front doors over bumps So I installed fancy pants door bushings, which stopped all of the rattles with the windows up, but........with the windows down there was still rattles, so after some googling,  and a chat with MX5 Mania, I got some new door to glass weather seals, all the rattles, windows up, or down, are gone now Shout out to MX5 Mania, the weather seals were on sale, and when I head to Dural to pick the up they even fitted them for me for free I did see a "really" nice Blue NA sitting out front   and this Black NC PRHT that looked like it has sat in the sun for its whole life and never had a wash, the clear coat was non-existent, an it looked horrible, really horrible, but, it had a nice turbo kit with over 200kw, the thing went like a cut snake, bagging the rears through the gears and dosing like a champ 😍 But, as I've always stated, I am keeping my NC na, I'm happy with the current power the car makes In other news: MX5 Mania do a drive in drive out turbo kit, the only minor additional part recommended for boosting my car, as it sits now, is a oil cooler, and that bonnet vents are definitely required for track use Aftermarket version look a bit to "racecar" spec I wonder how Focus RS bonnet vents would look?????
