Year and Month of manufacture on 15 year cars.

Before the end of the year the month of manufacture ruling in ADR 89 will take affect on 15 year imports in WA as well as other rulings.

So since R32 GTR's for example where made from July 1989 you cant bring in any until July 2004 in month by month not in Year of manufacture blocks.

THIS IS A FACT NOT A RUMOR OR A STORY.

I have heard a lot of storys in the last couple of months but this has diferent motives behind it including.

Slow down flow of imports out of Japan is being pushed by the same people who pushed RAWS.

Since a lot of people dealing in suspect cars cant do it with RAWS they have moved onto 15 year cars due to less control and the government notice the numbers.

A few people are getting around Motor Trading laws with the limit of cars they can sell without a dealers licence.

The limit will be on the amount of cars coming into the country under every scheme 15 year or RAWS and so on it will just take time to work through everything. Just look at personal imports and Race Rally requirements.

I think you'll find nowhere does ANY importer gaurantee that the ruling won't change or that by jan 1st they can import thier cars. It's always been a case of "Buyer Beware"

that said, I'm sure prestige and other importers will notify thier clients as soon as possible... when they get official word.

IMPORTANT

We have received written confirmation today from DOTARS that their application of the 15 year rule will change on 1st October 2003 from a year only designation to a month and year designation. For example, this means that a February 1989 model would be eligible for import in March 2004 and a November 1989 model would be eligible for import in November 2004.

Most affected will be models such as MX-5's, MR-2's, Celsiors, 300ZX's and R32's as these were only made from June 1989 and onwards. Some RX-7's, Supras and other models made in early 1989 will obviously still be eligible for import in early 2004.

DOTARS have never applied the rule this way since 1992 when it was first introduced, however they have obviously decided to do so now to slow down the import of 1989 models in early 2004.

All we can do is to act on the best information available and to warn of the risks prior to purchase, which is always our approach for all customers, then to supply updates outlining any confirmed changes to the rules, which is the purpose of this e-mail. 1989 models will still be sent to the Mailing List, and as usual it is up to customers to determine the risk and timeframes for themselves and to make their own decision.

A phase in period and / or special exemptions for those that have already bought vehicles relying on the way that DOTARS have applied the rules for the last 11 years, would be an obvious, reasonable and responsible approach. However, at this time neither has been indicated by DOTARS and no further detail has been supplied other than the above information.

I pity anyone that coughed up for a 32 earlier this year and has got to have it sitting outside for 12+ months. You'll find that any "importer" that did you such a deal will absolve themselves of all responsibility. I havent bought a single '89 car to stockpile for this precise reason. Also bear in mind that the feds wont even accept an import approval till the car is 15 years or older by the month so it'll be more like 3 months after the build date that you'll actually see the car.

Actually if you had it in writing from your "importer" that the car is eligible for import in January 2004 then you'd have good grounds for a full refund - or legal action to recover the costs.

How F&%^CK*D off would you be if you had allready purchased a 1989 vehicle in J and cant ship it until mid next YEAR, especially paying 2003 prices and storage in J. I guess those few whom fancied themselves cruising along Westcoast HWY in Summer with the top down in your new Mazda Eunos Roadster may have to settle for trying to work out were all the water is leaking in from your roof "mid next winter"....

But its not all bad news because according to some? 2K will buy you RAW compliance on a R32Skyline????? put the crack pipe down dude ,try 4-4.5K

And too think the stormtrooper tactics shown by our Federal friends was bought about by a particular importer whom the Feds were made aware of with 150+ 1989 vehicles in J all redy to lob in Jan........

Greed+ slickness= Buyer beware??? not really good enough is it!!!!

At least it will give his clients more time to save up for there insurance...they may even be over 21 when there new car arrives.

The 15 year rule was always a 15 year old car not 14 years and 6 months and any body that sold cars on the pretence of bringing in early 2004 and not disclose everything I wonder how they sleep at night.

Especialy when you had people like GTAAH telling you over and over that their is going to be a crack down on 15 year rule after RAWS started up.

I told a lot of people but not many wanted to listen, as what would I know I only talk with the people that make the rules, enforce them and work with them on a daily basis.

At least one Broker I know of told customers from the start this would happen and looked at VIN numbers for month of manufacture to help exact date of manufacture.

It is being greedy on both parts and not high lighting the grey area looking for the customers money only that has lead to thiis.

I can tell you now complaining wont do any good as It will fall on deaf ears. I was even told that you should have a current bill of sale to import the vehicle not one 8 months old.

I just cant believe that anyone was stupid enough to cough up for a car they wouldnt see for 8 months. You get what you deserve I say. I was telling everyone that this would happen and I wasnt the only one.

I agree GTAAH, you really have to wonder about the thought that was put into this, did anybody read the contracts? fine print?I wonder where a "registered dealer" would stand if he was holding deposits on vehicles promised in Jan and un-able to deliver them as promised, some as late as Dec04/Jan 05?. I hope the new house is at lock-up .May have to settle for faux marble instead of the real thing, help pay for some of those legal bills that will start rolling in!!!!!

you know, most of the importers work as brokers, not dealers, so at no stage do they own the car.

also, its worth remembering that new car dealers take deposits on cars all the time and can't deliver at the original schedule.

All the legitamate dealers that I know do own there own stock,thats the major differance between a "dealer" and a" broker" in that because a dealer owns and sells his vehicles he is responsible to provide the vehicle in a specific time schedule and in as described condition or can face stiff penalties under the "fair trading"Act. The brokers get around these responsibilities by not owning the vehicles therefore cant be held accountable when things go "pear shapped".

I can could accept as a purchaser waiting 2-3 months for a new vehicle from a dealership, normally because the colour or options chosen are special order, but 12-18 months for a 15 year old vehicle!!!! i dont think so.

we may have to get together one day as I would love to have a beer with Duncan!!!! sorry dude could not help myself!!!!
