Bad luck re: car...Bet the Bastard truckie had a chuckle to himself as he climbed from his truck into his honkydore ute for the drive home.

It'll give him something to tell the boys around the bbq for the next 10 yrs or so.

I think you should get some legal advice....

Just because you are in the wrong doesn't give some else the right to hit you...for instance...if your are parked in a no stopping lane it does not give someone the right to rear end you...Every driver is oblidged to avoid collision where possible...I think the law changes when vehicles are stationary as well...The truck driver has admitted he did not see you...this is an admission that he was not taking care and paying enough attention to what was in front of him. He can't say that you didn't stop because he did not see you...Do you have any witnesses that will vouch that you were stationary when he hit you?

Once again get some advice...

No one has the right to hit anyone but he is in the wrong, he even knows he is in the wrong.

I suppose you could question the trucks speed but even then without any factual evidence like tyre marks on road or a hand held speed camera from a cop how would you prove it.

Rear ending is a completely different argument as it's general road knowledge that you have to always have enough room for the speed you are travelling to stop without hitting the car in front of you in any situation. It's chalk and cheese when comparing to someone pulling out in front of you from a side street.

Shit happened!

My old gtr got hit in the BACK by an old man on King st Glenwaverly at at least 70-80kph. Those has been to the Glen should know what's the average speed there.

Anyway, cops rock up, said its my fault, gave me a fine and they were going to give me a defect because my car was out of shape but lucky they had a call on their CB so they jet off.

That old man never contact me again. I didn't want to push my luck any further because the COP stated that is my fault on the infrigment so there were more chance of me loosing if i was to take the matter to court. I copped a big repair bill and lucky Master Panel Beater Dirty Whore YLWGTR II did a great job on it :/.

That's not right!!!...

Unless you're in reverse... ...Anyone that hits you in the back IS AT FAULT... ...Unless they can prove you've done something that caused them to hit you from behind... ...eg, change lanes and slam on the breaks... ...And that is still hard to prove anyway...

Damn man only saw this thing a few weeks ago!

I know at this point words really cant justify what your going through, but at the end of the day like others have said be thankful it was only the car and not yourself!

From the pics it doesnt look to be anything major but then again pics can only say so much.

Has it been declared a write off or is it repairable?

I wouldnt bother pursuing it in court as you where in the wrong. He could have avoided you but didnt have to so he had every right to hit u if you where over the line which sucks..

Another lesson learnt, at least you know it wont happen again as you will be very very cautious from now on.

i'm confused, why does everyone here say what a c*nt the truckie is? fair enough if your driving something that big with a bullbar on the front, but do you really believe he would smash into another car that hard intentionally? there are some f*ckheads out there in trucks but i've never met one (and i deal with heaps of these guys at work) who would intentionally slam another car.

without asking them directly, i cant see why you'd risk your job doing something like that. most of em have done it their whole life, why would you go and smash your truck, potentially lose your current job and give yourself all that trouble finding another job just coz a car had its nose out 30-40cm?

maybe not so much that he wanted to hit the car intentionally but because he was driving carelessly. trucks always over shoot things, misinterpret other things around them and at times are pretty dangerous. not because they want to be but because how they are driving the bloody things. so many times have i seen a trucky try to beat a red light when its on amber and finding out that he cant so on go the brakes skidding at about 80kmh and over shooting the line at the traffic lights.

And how do you come by the fact that truck drivers are dangerous "not because they want to be but because how they are driving the bloody things" i believe that sentence alone sums up how much of a f**king idiot you are, go look up the word contradiction.

But as usual you are just another tosser who drives a car and assume because a car can pull up in a short distance a truck can too, you have no understanding of how these things work or what it takes to drive one, i would also put money on the fact that when a truck is using two lanes to turn you try to go up the inside of them because "they are not allowed to do that", please do, coz after a B double has gone over your bonnet, rolled, spread his load all over the road needed 3 cranes to put it back on its wheels and the massive clean up, you get fined and have to pay for every thing involved, i will be laughing my f**king arse off.

all i was saying was that the trucky might have been misinterpreting the guys gtr...as he said the trucky said " he didn't notice it there"...then why the f**k did he hit the gtr if he wasn't being careless? why would you ram into a stationary car for? why not slow down to see if you can manouvre around the car if you think its in the way...obviously he wasn't thinking these things and off in his lovely little own world.

maybe you're the type to run into a stationary car?

my cousin's dad is a truck driver for sims metal. never had a accident and never been in shit for driving his truck. thats what 30 years of driving a truck has done for him. on the other hand truckys speeding, trying to beat a red light etc isn't so smart for truckys to do considering what they are driving.

and no idiot i always give way to trucks when ever i can cause i know if i get to close i could get f**ked up.

Why was he driving carelessly? Because he didn't want to swerve onto on coming traffic or didn't want to change lanes and side swipe another motorist to avoid hitting a "GTR"! Pfffffffffffffft.............wake up and stop dreaming!

GD2ILA: Sorry about my mis-post before, didn't intend to have a go at you. Was more having a go at the people who have no clue and wrongly advise others to spend thousands on legal fees, just to loose the case.

Some people just think because it's a GTR they have right of way. I bet if you were behind a car that had the misfortune of doing what you have done, and you where just reporting how the Camry in front of you stuck his noise out into an intersection and it got wiped clean by a track, the same "legal advisers" will be bagging the shit out of the Camry driver.

It's an unfortunate accident, that's why we have insurance, and i'm sure it will be back on the road better than ever.

what so you can't slow down and and analyse the situation? who said anything about swerving? i'm pretty sure when you wanna slow down and turn you press on the brake to slow down right and not stay on the accelerator?

common sense and reality are a different thing. Common sense says you shouldn't try and lift 160kg attached to a metal bar over your head. yet we give the person who does it a gold medal and congratulate them.

get a grip. the OP is in the wrong. The whole reason you're taught to stay behind the line before you get your license is for this precise reason. Just like cutting in front of trucks and slamming on brakes, they will rear end you. Momentum's a bitch, and no amount of 12 piston Brembo's can pull up a truck fast enough to avoid a collision if you don't give it enough space. What's to say if he swerved to avoid the car that was in the wrong he wouldn't have hit another car and killed someone?

You shouldn't bring your personal prejudices into this, just because you've had bad experiences with trucks doesn't automatically put the OP in the right. By god, the number of times I've seen asshats poke their fronts halfway into the lane while waiting to turn into it... If I drove a shitter I'd be half tempted to plough into em instead of swerving to avoid em.

Best thing you can do is take the insurance payout and fix your car up or buy a new one.

but for example when you park your car in a super market and you turn in but you over shoot to the left abit and u know ur gonna hit the car on ur left. do you keep going? hopefully NO.

you reverse back out and you correct it because u've analysed the situation. this is what the trucky should of done if he was paying attention.

what i'm trying to get at is how do you RAM into a STATIONARY car? you would have had to be careless or just not paying attention? doesnt matter if its a GTR or a excel. either way if it was ur car getting bashed in you wouldn't be happy.

At the end of the day i feel sorry for the guy, but as he has said him self he was in the wrong, but you and others seem to want to blame the truck driver, im not going to say he could have avoided it, un like you are, because i was not there and dont know the full story, just like you, but stop signs are there for a reason, as are the white lines on the road, if you want to take the facts and some how turn it into something else you go right ahead, but i know you as much as you know the details of this incident and i am sticking by the statement that you are a dead set f**king idiot.

If you were trying this maneuver in a car weighing as much as a truck, with as little surface contact area as a truck, and at anything over 60km/h... I doubt you'd have little choice in the matter whether you wanted to hit the car or not.

its a truck you're talking about, not a light car. its hard to control under brakes, its hard to slow down and its hard to make split second decisions in.

What if it was a blind bend where you could not see them till you were on top of them, trucks dont have an extra foot of space in there lane on some roads, he comes round the corner and you a foot out then bang, your nose is gone.

    • I have an Elite 2500, honestly most of this has been a lot of smaller tasks chasing little details and a whole lot of life getting in the way of bigger projects. I don't mind too much looking at a spectrograph vs having audio knock ears. 
    • Nah nah nah nah. Don't do it. It's not all about the full throttle power delivery. The main "street fun" and drivability gains from smaller rear (in this case) is how you will have boost available from a low rpm when yo just roll onto the throttle. Think jinking in and out of traffic, coming out of roundabouts, etc etc, where you just want to roll onto the throttle a little and have the spooly noise from ~2000rpm and a swell of torque. More of what you've already achieved by going to 2.5. And then, towards the tail end of 2025 you can pull the turbo 4 out and put in a V8 like we originally suggested. :P
    • Cheers for the info mate, I'm old too, 60 years old next May, so a more linear delivery of the 0.86 would be better as baking tyres and snapping heads isn't on the cards for me or the car I assume a more linear power delivery would be better for engine and drivetrain reliability as well, IRT the torque load at lower RPM???, as well as lower EGT's???, if my understanding of that is correct, have I got that right??? I've only got a really basic understanding of turbo sizing and all there characteristics  Cheers for the useful information 
    • What kind of power delivery are you after? If it's nice and linear, the 0.86 would be better. If you're after bake tyres and head snaps on boost the 0.64 would be fun. I'm boring and old, so linear power is preferred. Lately I've been watching videos on Z06 Corvettes and super charged Mustangs.... 
    • I’d go the smaller rear just because you’re staying on 98, if e85 I’d go the bigger one
