Because the laws say it's up to the officers' interpretation, all they have to do is present the facts:

2 cars take off hard from the lights and proceed to speed.

That's racing. Sorry your car got impounded, but think about it like this:

What if they find you guilty of lying under oath? You're f((ked. Gaol time bubba.

Cop it on the chin, you've been caught like many others.

M3Boy: Firstly, I respect the way you've been handling this, and not "cop bashing" like so many others here. It sounds harsh that you've lost your car for a seemingly minor offence. However, the latest "anti-hoon" laws are very strict on any antisocial behaviour on the roads, so you shouldn't be surprised at the outcome.

Heres what you do buddy, speak with Mr Soarer and get your stories straight, get a lawyer and deny having raced the soarer, instead this was a situation of confusion...you really needed to get into the lane the soarer was in, you werent racing just needed to get into his lane and make your turnoff and rather than waiting for the soarer you wanted to get in front of the soarer. As long as you didnt wheel spin the most they can do is get you for acceleration, they obviously had no idea how fast you where going....so it should be okay.

I'm sorry but no intelligent person would believe that crap! You say you wanted the other lane. Hang on, M3Boy said that the other lane was running out (which is why he let the other guy win - sorry - in). Hmm a bit of a fault in your logic there.

Now, lets assume these are 2 mildly modified cars, capable of reaching 100km/h in 6 seconds?? Well, M3Boy backed off at about 90, which means they'd been going for a good 5 seconds by this time. Most intelligent people would have realised by this time that they weren't going to get the lane that they wanted (that was about to run out anyway), and backed off well before.

Also, as it was the other guy's lane that was ending, he can legitimately say that he wanted to get in front before his lane ran out (whether that will earn him any respect in court would be arguable). All that M3Boy can claim is that he either:

a) wanted to block the other guy from getting his lane, or

B) wanted to race.

Either way it doesn't look good for M3Boy, and trying to use GTS26DETT's argument is frought with danger. Let's not forget that magistrates aren't idiots. They can often see through plain lies.

INASNT: why is it that you keep getting harrassed by cops? I have only been pulled over once in the last 8 years (whilst rushing my son to hospital - and the cop let me off). Thing is, I've been driving XR6's, turbo Skylines and now a WRX. Surely they attract these "jealous" cops more than the boring cars I drove in my silly youth (when I did get pulled over a few times, but never harrassed or unfairly treated)

OK I'm a 36yo old fart too. The cops can't tell that from behind (or beside me either, because of dark tinting). Why then is is that they never even look twice at my WRX. Could it possibly be the way I behave on the streets:rolleyes:

Your antics here are nothing short of childish, and you're an insult to our profession. I hope you conduct yourself a bit more professionally at work than you do here.

By all means, M3Boy, if you feel harshly done by, then go to court and let our justice system decide the outcome. Don't think that telling lies in courrt will get you off, though. As said before, lying under oath is a serious offence.

This is the illegal street racing law that came in a couple of years ago in action. I remember there was a big shit fight when it was enacted.

Sorry sport but he got you fair and square.

You may get off with a slap on the wrist when you go to court, you may not. I sure as hell cant say.

a. I'm not surprised you don't remember. I guess some people are just more forgetful than others??

b. you probably have hassles with the cops because of your attitude. If you turn on the attitude when pulled over, the I am not surprised you have so much grief with them.

c. why are u so angry??

Chill man!

Ozzy

Ozzy, i didnt give them any attitude, i complied with all requests nicely. i wasnt a being a dick to get them offside, but their story is really wrong. Anyways..I have to wait and see.

By the way, Im not going to court becasue I want to fight it, ive been summoned as the cops gave me a court notice on the night straight up - so no choice. I dont have an atitude problem at all, nor do i really wish to go to court.

Tks EnricoPalazzo.

M3Boy...What EnricoPalazzo said...my last was referred to INASNT.

With reference to your problems, it looks like you have them in hand. I admire your maturity. It is an admirable trait to take responsibility for your actions. Best of luck, and take onboard some of the valuable, MATURE advice given here by the more level headed members.

warps - all of what you say is probably true, however if you have a good lawyer you can get literally away with anything. Lawyers are the lying scumbags, you just pay for them to lie for you :D

i'm with the angry sri lankan.. cops can often judge on appearances and if their job sucked as much as theirs, you'd be angry too.

And as "crime fighters".. pft, all cops are useful for is pulling over cars - because a) its easy B) it makes the government money c) requires no real investigive work d) they get to drive fast and be big macho men and its all legal for them e) they can appear to be doing something and "case solved" in that time it takes to pull you over and give you a ticket.

With previous experience with buglary, car theft, and other things I've seen happen to others (not done..lol) cops could not give a crap about you or your posessions. But then again they deal with scum everyday, its hard for them not to see the clean from the true scum

Geez Where do you live Communist North Korea?

Oh I forgot they don't impound cars there not even their not that stupid.

I can just see them implementing that system over here. It would be all out war with the police.....

Dude I feel for ya and hope this all works out.

New comments added in italics

i am more educated, have a better job, get lots more $$ than them so they aint even a thought 99% of my life!

Theres that winning attitude they see when they pull you over.

i'm with the angry sri lankan..

Who is Srilankan, what if i posted...

"He's Srilankan...that means he is a wannabee homie who thinks hes a tough guy just because he is black?"

First a disclaimer...i dont believe this, and i sure as hell dont know ppl on this forum just because they post here from time to time. Its just an example of what has been repeadtedly posted on this forum, only i have changed the main players

You'd probably want to kick my ass, or pitty me for being such a fool. Either way what ppl post about police tells me they have no idea about policing, and still have a little to learn about people both as individuals and collectively.

As for blaming Police for crims walking the streets, or backward ass laws, i think that the courts and politicians responsibilities. Laws are passed, Police arrest people who break that law, courts judge and sentence the accused/individual

m3boy...it sounds like your bad luck may be changing for the better as the police paperwork may support your position... again best of luck getting the car back

Sorry, ill try my best to butt out in the future:(

your dads an ex cop isent he? thats the only reason you keep sticking up for them isent it???

lol...not quite, he was a butcher turned meat distributer. :D

I just happen to know a few police, and ill concede im probably biased in their favour as its only becasue i have an idea of what they endure in their jobs, and what they shelter much of the community from, some truly horrible crap.

That said i still dont know a whole lot, and knowing a few police doesnt mean i know anything unique or know more then other people. Its just that i perhaps see what they put into their jobs, and are forced to endure.

... i dont know, maybe i need a schooner and a night of promiscuous behaviour:D

any word mate...... personally it sounds like your going to have fun proving what happened... basically in the world of law its a car hoons word versus a Police officers.... not easy to prove other wise unfortunately :D:(:D

I dare say that whatever happens you are going to be in for a lengthey stint without your car. It sounds like what you have said is the truth but ultimately there were 2 cars speeding simultaneously which by law would constitute a drag race :D:(

If what you say is correct about the Police officers story being totally different to what happened i would suggest being 1000% sure and then asking that the Soarer dude be called in as a witness to what happened..... Once again hard to prove as its your word versus the Police, but if the 2 of you come in with the same story you may be in with a slim chance. having said this, dont talk to the Soarer dude, let the nights events come from his mouth without "getting your stories straight" Trust me the judge will know if the 2 of you have spoken, thats why they are judges, they can see straight through this stuff.

Did the Police record what happened on the night??? maybe you can ask that the recording of the incident be used in court to back up your claims..... that would be the end of everythig if you have this as evidence.....
