New Car Purchase Nightmare!

Hi all,

Well as most of the regulars here would be aware, Chefstagea (adam) and myself were flying to sydney on Monday morning (yes Aus. day), to pick up the S2 260RS he's interested in.

So far he's:

  • Paid a deposit
  • Paid insurance (got it sorted prior so we were covered on the drive home)
  • Paid for 2 one way air faires to sydney
  • Purchased some bits and peices incase dramas mechanically occured on the way back (hoses belts ect.. ect..)
  • Put his current car back to stock for sale and pretty much have a buyer lined up for purchase this week when we get back
  • We'be both organised time off work aswell.

As hes a cheff and its sat night hes at work... AND GETS THE FOLLOWING MESSAGE AROUND 9pm:

"Hi Adam sorry it's late, had some bad news this weekend I will be flying out of the country tomorrow night I have to put off the car for the forseeable future. I will refund any costs you have incurred for flights and your deposit. I will only be able to access email from tomorrow as phone wont work over there, send me your bank details. Please acept my apology I cant say much more than that right now.

What shall we do? Is their anything we can? Dudes not answering calls or anything.

I think that the only thing that you can do is hope that he is true to his word and he refunds the money......

Otherwise, consumer affairs, Police, etc.

Technically you have a contract, but unless you like parting with 1000's of dollars in lawyers fees I'd advise you to forget that avenue.

Good luck.......... next time pick a reputable importer. If this was a private sale......... not much that you can do, 'cept hope!

OMG, that sounds really dodgy chris. Did you have any other personals on the seller? Address etc?

I can't really offer any help other than to say sorry to hear that. Surely if there wansn't something dodgy going on he would have rung and atleast had a discussion with Adam and organise for a relative or someone else to complete the transaction. Not that hard really, honestly sounds like a cop out unfortunately.

Bet Adams peaking.

At the very least lets hope he can recoupe his money.. well most of it.

wow... that's f**ked up... why is the sale off though, delayed understandable, but to call it off all together? That sounds shite. And if a deposit is received I'm pretty sure that's a binding agreement isn't it? He'd have to proof that he has to leave the country or something. At the same time, I suppose you don't want to piss him off too badly or he might bolt altogether. I'm really sorry to hear that Adam, and you too chris... ;)

Full refund of all expenses helps a little i suppose.

I have a saying that if you wanna lose your faith in society, just sell a car. I guess the same happens when you're buying too...

In fairness to the seller, there may well be a medical emergency that meant leaving straight away, and he has offered to refund you your money - he hasn't just disappeared, it could've been worse.

I'm off to Japan on a buying trip in a week or two - let me know if you want me to look around for you chef :D

the ad could be interpreted that it was still up for grabs even though a deposit was recieved. maybe he got a better offer?

all sounds a bit suss to me.

yep it was that 1... thats what i thaught... were still guna go to sydney i rekn.... and if theres ne thing nice over there then mayb buy! thanx nick!

For the cost of a couple of airfares (if he doesn't end up refunding you the $$) just don't impulse buy ok! Worth importing an Autech through at about the same price and driving around in your stock (now) S2 for now.

      I’m also conscious that e85 is slowly being phased out. Not all United’s have them anymore. Can’t take the risk of being low on petrol and assuming the servo will have it.

      MR HAMMER has said his piece. Painted up to avoid Rusty Rusty. Actually lines up well. (i.e it lines up the same as the unmolested GTR guard). Turns out the GTR Strut brace does foul on the bonnet vents ever so slightly. May need a little bendy bendy if intended to keep using with a strut brace. So spacing it out to clear the FAST102 is not an option. Annoyingly, the bonnet vents also foul on the heater lines running over the engine. Given this engine does not EVER require a heater, a delete loop is going to be used. Don't worry, the defogger uses the AC. The heater is basically "Do not use the aircon and turn the fan on". It will still be effective, I promise.... once I get the system regassed... Will have to revisit with unvented bonnet I suppose, and suitable strut brace. There's plans to do this and other things tonight and bleed brakes (there was a weep) and put the bumper back on, and take Good Friday morning - Because troubleshooting on the side of the road limping it home at midnight tonight is ... not very smart.

      Thank you all for you assistance. I contacted Nistune regarding the support for the RB20DE along with my ECU Code (23710-10U00). They do have a map for it and added the RB20DE as a purchasable option now as well. They also added Malta as a Billing and Delivery options as this was missing. I was honestly amazed at their quick response and action, it took less than 24 hours. I also looked again at direct fit options for injectors, just in case I were to replace them. DeatschWerks seem to use a Bosch EV14 base and makes ones that fit mine at 440cc lowest, but also have 550cc at the same price. I tried looking for other direct fit options and managed to find one (also Bosch EV14 based) which includes a plug and play adapter on ebay. Did a small test with a Noid Light on the troubled injectors and all seems good, so they are pulsing properly electrically. One weird part is that they are missing on the same two cylinders as before I got the injectors cleaned. Mechanic also found this weird as he did not label the injectors and it is unlikely to have the faulty injectors be installed in the same cylinders.
