With laws like these, I'm surprised that everyone haven't all ditched their proper jobs & all become thieves.

Also +1 "catching" that flamin mongrel.

Should of beat the f**k out of him until he was unconscious then a few more hits dragged him to the end of the street and either of left him there or called a ambo for him and go back home put your feet up and relax, Then deny anything and everything. Goodluck mate.

You don't have wait for the first punch.

If you felt that you were in danger its perfectly legal to do a preemptive strike.

Thats bullsh1t....i punched f**k out of a bikie who ended up in intensive care for a few days when he and a few of his bonehead brothers threatened me outside a nightclub. I was outnumbered but ended up knocking one out and giving another one a few before getting away after the bouncers came to assist me.

Because i threw the first punch i was the protagonist/instigator....sucks but thats how the law is written and how it must be obeyed.

I spend thousands of $$ to keep my ass out of gaol over the whole debacle.

thanks for the support to every1. but yeh got picked up by the po-po this arvo took me in for debriefing of what happened. then yeh took me along to a local court along with pr*ck. found me guilty on all charges for assault and malicious wounding ..apparently I hurt the dude bad, a total of 17 stiches in the facial area, broken nose and a few ribs fractured and lots of bruises. but the judge only gave me 3months of good behaviour *phew* and a slap on the wrist. the guy recieved 18months community service for compensating for the beat up he recieved and have to pay for property damge of a total $500(window replacement)....overall all is well and ends well.

good job mate. From his injuries, it looks like you were pissed off. He deserved every bit of it. I had one of my cars stolen and a set of wheels on my car taken aswell. All you do at night before you go to bed is think of what you would do if i caught em. lucky you, you got to get that chance. Does that mean you now have a criminal history?

You went to court on a sunday?? And they caught the guy on a friday??

Doesnt this sound like the quickest solved case...EVER. Also i didnt know courts were open on sundays...

or u could set up cameras, role play that night with one of ur mates, making sure the camera sees him punchin u first, then they cant put the shit on u

Just for the record, there are laws to cover this, it is illegal to use CCTV on even your own driveway, front lawn, etc without a clearly visible sign stating that the area is under serveillance. Its the same kind of law that puts the owner of a house at fault if a theif cuts his leg on the broken glass forcing entry. Its f**ked!

Sounds like you might have gone a little overkill, but I can't blame ya, I would have been blind with rage myself.

Its good that you didnt get jail or something more extreme than "just behave for 3 months, ok??"

yeh fairfield court is jst adjacent to fairfield police station (30sec walk) got taken to station for statement record then got escorted to court, it was quick case and pretty straightforward case...its not like it was a mastermind criminal act didnt even require a public defendant on my end anyway. and yeh didnt think it would be open but apparently it was.

I wouldn't be surprised if the guy actually went to the cops himself & wanted to sue the OP for bashing him... seeing how we have the "protection for scumbag" laws around.

I remember reading from somewhere about some thief who broke into someone's house but injured himself in the process, & a few days later the owner of the house got sued by the thief & he demanded the owner pay a compensation for his injuries. Talk about f*cked up...

you are allowed by law to use 'reasonable force' to subdue a criminal or make citizens arrest - disregarding the emotive comments so far posted even the Police can get charged for assault if they use unreasonable force in making an arrest , so if you want to know more about what is reasonable force just google case law on reasonable force or go the Attorney Generals website (NSW Govt) and search

you plainly admit using excessive force, and it would have been obvious anyway to the attending police so thats why you got charged

but most peeps would have been very angry so its easy to understand that he got a few extra hits

but you can't maim kill or hospitalise someone just cos your angry is the theory and its basically sound - what would you think if someone bashed one of your family members senseless and caused broken limbs just because maybe he tripped in the way of the person who then got excessively angry and violent - you wouldn't be happy

Big "SELECTA!!! " to you.. id love to catch someone doing that.. oh the things you could do before calling the cops.. not necessarily violence... just mess with his head... freak him out a bit... or alot.

a close friend of mine got assaulted by her "boyfriend".. its a shame she was in qld at the time... the delightful things that were going through my head.. had he been in newcastle... he'd be a messed up man by now. she wont tell me his address either.

but anyway... good on you for giving it back, will make him think twice next time.. but be careful as he now knows where you live, he may come back with 5 of his mates off their heads on ice... its all good and well to do what you did... but hopefully he doesnt come back.

If he made it to the copshop with those injuries then it was a fair effort id say?

.. but be careful as he now knows where you live, he may come back with 5 of his mates off their heads on ice... its all good and well to do what you did... but hopefully he doesnt come back.

+1, Maybe have some mates over regularly for a while or something. If he was trying to steal your car then im sure he would sink as low as returning with friends of the same league :D

No did most of the work after 20min or so the came round n had the guy jst sittin there.

well lucky you caught the guy, unlucky you have now been charged and convicted of assault. I will give you one piece of advice. whenever you are dealing with police in a criminal matter and you may have done something wrong, DO NOT SAY ANYTHING. DO NOT AGREE TO BE INTERVIEWED. DO KEEP YOUR SOLICITORS NUMBER WITH YOU. and DO CALL YOUR SOLICITOR AT THE FIRST AVAILABLE OPPORTUNITY.

Basically in an interview even if you are only trying to prove your innocence you can and most likely will incriminate yourself to some degree. unless you are absolutely 100% blameless then you will never exonerate yourself in a police interview, you will only either incriminate yourself a little bit, or a lot.

I think had you thought carefully about what you said to the attending officers, and had you sought legal advice before making a statement then most likely you would not have been charged and almost certainly would not have been convicted. as it stands you've lost out.

I was recently involved in an armed robbery in the convenience store beneath my apartment in the city. I was outside when a girl ran passed saying "there's a guy with a gun in the convenience store" I didn't want to go in, but when I got close I could hear the store worker getting bashed and he was screaming. He had fought back and the gun was on the ground and the robber was on top of him bashing him behind the counter. I ran in and king hit the bloke and he rolled off, the convenience store worker grabbed a bottle and smashed it on the blokes head, then picked up the gun and ran! as the robber got up I decked him again and he went down, so off I went too, we shut the door behind us and now the bloke was trapped. he was pulling at the door for a bit, then gave up and went inside and came back with a pole. he then proceeded to smash through the glass door, so we opened it and gave him a nice kick through the door. he then got up and charged past us but luckily we were able to tackle him and restrain him with help from a few bystanders who finally put down their mobile phone cameras to f*kcing help us. anyway police arrived thinking the convenience store worker was in on it as the gun was stuffed down the back of his pants!

I got advice, made a statement and it worked out ok, but it could have gone bad. the robber claimed he was a razor blade salesman who was there to sell razor blades (yeah at 9:30pm on a friday night) and that the deal went wrong and the convenience store worker pulled the gun on him!! and that we then both bashed him. luckily his bullshit didn't hold and luckily he didn't have aids (as i was covered in his blood). but if they'd bought even part of his story I could have been in deep shit just for helping someone out. so whenever dealing with the law, be careful.
