Just Got Done Speeding

Ok i just got done speeding

im on my P1's and ive had them since last year july

not at all proud of it i just wanted to get home

doing 118km/h on the freeway which is 100.

he gave me a $332 fine but said that it is a caution for breaching my p plate conditions

he said i got 2 demerit points, but he also said that its up to motor vehicle department to see

if i will be disqualified

anyone had the same situation?

have i lost my license?

Yeap, pretty sure you've lost your license.

- P plater cant go over 100km/h

- P plater cant go more than 10km/h over the speed limit

It's been a long time since I knew anyone who was on a Probationary license (about 12 years)...

But back then, if you breached conditions, you ended up in court.

(I didn't end up in such a situation personally, but I knew a few who did)

If you require your license for work, then a letter from your employer may assist in reducing any potential disqualification period.

You will just have to wait & see what arrives in the mail, if you already have a few infringements against your name then it doesn't look too good.

GL & we've all had 'good' reasons for breaking the law. But remember the law doesn't see it that way...

The offence you have comitted is 118km in a 100km zone. Due to the fact that you are P1 licence holder, you have also comitted another 2 offences, being breach speed limit by 10km/h and going faster than 100km/h.

The officer does not have discretion like he may have with fail to display P plates or fail to present licence when required. Because you have been done breaching the speed limit by 10km/h and going faster than 100km/h what happens is when the notice goes through the expiation notice branch they will forward it onto motor reg who will then send you out a letter informing you that you have lost your licence for a breach of condition. You can then appeal for a good behaviour bond if you have not lost your licence in the last 2 years. I think the form comes automatically. If you do this you will be unable to drive between midnight and 5am and only have 1pt, if you stuff up again, you lose your licence for longer.

However ENB and Motorreg are notorious for lack of communication and not forwarding these sorts of things onto each other, so the best you can hope for is to get lost in the system.

Unfortunately, I wouldn't hold my breath on the 'lost in the system' theory these days. The new Registration & Licensing software in use has pretty good coverage of all bases...

How important is your licence?

(assuming it was by a radar gun) You can contest this in court and have a good chance of winning but it will cost you for $$ for a good lawyer. I believe the standard method is to ask the police for the guidelines of use, a certificate of compliance and a certificate of callibration for the radar gun. I essence you are challenging the accuracy of the gun and the procedures used by the user. (all of which I have been lead to believe the police are reluctant to produce)

There are specialists in this area and their advice should be sought.

Well im starting just a job at hungry jacks on wednesday cuz for some pocket money. im still 17 and i also go to marden senior college

full time so i need to get to school. i guess i can catch a bus but i hate public transport... plus i live in the hills and marden is near magill

i talked to the cop after he gave me the fine and asked him how far did he get me from and how far could the gun go

he said he got me around 400+m away and that the gun could go around 600+m on a good day

Appeal the disqualification in court, and 9/10 you will get it mate.

I lost my license twice on P's and I never actually was without my license.

yeah if u do appeal i have a feeling u have a decent chance of keeping ur lisense, tho u will have 1 pt,

so if u can do it it might be better off to not have ur lisense for a while and have 4 points when u get it back?

Good luck with the first one. The new units must be calibrated every time before they can be used. The only chance you may have is that where the officer was positioned in relation to where you are may have given an inaccurate reading.

i got done for 80 in a 50 but they didn't have proof of the speed and did me for "exceeding speed in built up area" which was 3 points , then i got done for no p plates in my dads work car when i went to get dinner, and the cop at the time said the usual shit that "its up to motor reg to decide" , and well 100% of the time they disqualify you.

i got a letter of disqualification in the mail a week after i paid the fine saying id lost my license and that it was a breach of my probationary conditions.

i took it to court and had a letter from my employer and the judge was forgiving and understood what had happened and gave me my licence back

only shit thing is im on 1 point for the next 2.5 years but i don't see it being a problem as i learnt my lesson when i got done for 80 in a 50 and now i dont

speed anywhere no matter what.

On the topic of radar. IN Metro adelaide they dont use radar. You arent allowed to use mobile radar in built up areas or as the radar reflects off all sorts of things and they would be unable to prove wether it was you or the car behind you etc. or the car going int he opposite direction that was doing the speed.

In metro areas they use hand held lasers which are basically point and click and they can prove who was doing what speed. And yes on a good day I believe they can hit 600+m.

You could possible challange the fine in court, however with teh laser the only thing you could possibly dispute is the certificate of calibration and/or wether range tests are done every morning. However after some issues and cases lost in regards to radar technology i believe Police management are hot on ensuring that range tests are completed every morning with every police station have a laser range painted out and the certificates of calibration redone months before they are overdue to ensure no overlap.

Your best bet is to appeal the loss of licence before a judge and ask for a point back, but you must be willing to drive like a grandma for 2-3 years as if you stuff up whilst on your good behaviour bond you will pay with an even longer disqualification period.

possibly 6 months , then you'll have to do your final drive again with an instructor and will be on your p's for a couple of years.

Yeah sure mate, I can guarentee that no person will ever recieve a fine for breaching the speed limit by 2km/h let alone get branded a hoon for it but why let facts get in the way of a good rant

The poster admitted he breached the speed limit by 18km/h, doesnt deny it. Hes not a bad bloke nor is he a criminal, but the fact of the matter is he has breached one of the rules of the road by more than just a trifling amount. It is good to see he is more concerned with accepting responsibility for his mistake and going about trying to get his licence back.

Pepsinator I am off work for a few days sick, I know a lot of this stuff off the top of my head but unfortunately not exact numbers etc.When I get back I will see if I can find out some more details for you re this matter and avenue of appeals and/or what happens when you get your licence back.
