AGE
OK, cause I hate searching the Vicroads website, Say you ran out of Demerit points, and took the 12 month 'be a good driver thing', then coped a saftey camera fine for 1 point. That would cause you to loose your license for 6 months. Then say after that 6 months, you found your license (it was behind the fridge the whole time)....how many Demerit points do you have? My understanding is that they 'reset', except for that 1 point that pushed you over? Is that right? (and yeah i know you technically don't 'have' 12 points to lose...your allowed to accrue 12 points ) Link to comment https://www.sau.com.au/forums/topic/294493-demerit-points-and-not-being-able-to-find-your-license/ Share on other sites
baby34
your physical licence hasn't got nothing to do with losing points. What yo're trying to say is that you have 1 point left remaining and u got done by a camera.. I highly suggest you find someone to take that 1 point for u. or you lose ur licence for double the amount of time it was suspended for. Either that, when does the 1 point expire? if it expires soon, just pay the fine AFTER you get ur points back. R31Nismoid
lol Age - loosing the plastic is irrelevant to the situation If you were on one point for 12 months. And were then pinned one point - you be walking for the next 6 months my friend. After that you get the full 12 back again... At least it's summer. Could always be middle of winter and p|ssing rain/cold! Charles89
So in this case, after it resets, he'd have 11 points left? paulr33
true in actual fact, when you agree and "opt" for the "12 month good behaviour" you already have your points back. so at the time you agree, you revert back to 12 - even though you haven't lost it (the licence) and you get 12 - minus the points you just lost. so regardless of your desired decision either good behaviour or instant-loose, the points are reset at that date Link to comment https://www.sau.com.au/forums/topic/294493-demerit-points-and-not-being-able-to-find-your-license/#findComment-4914275 Share on other sites
Charles89
Sorry to hi-jack this, but I've got a question regarding my points. I'm currently on my P's, and P platers gets 5 points. And I'm wondering when I'll get my points back. I've got done for speeding twice, both times lost a point, because I was less than 10km over the limit. My first offence was in Dec 08 and my second offence was in July 09, so do I get back 1 point in Dec 09 and another point in July 10? Or do I get back the 2 points if I don't commit any offences until July 10? So you'll be waiting until December 2011 and July 2012 before you get your points back. UNLESS you get put on an option notice, in which case at the end of the 12 month good behaviour or 3 month licence suspension you will "get back" all 12 points instantly instead of waiting 3 years. The only thing that confuses P platers is this 5 points in one year thing. But that itself is pretty straightforward. It's just an extra rule on top of things: unlike full licence drivers, you can't lose more than 5 points in one year or you will receive an option notice, i.e. suffer the same consequences as losing all 12 within 3 years. They do this because as P plate drivers it is seen as more serious that you should lose points that quickly...and really...statistically...if you're losing 5 points in one year, you aren't going to make 12 last over 3 years are you...might as well take that licence away for a bit to slow you down. Though I really do wish people would refer to demerit points as something you earn/get for committing offences. It's not that hard a concept to understand. You start with 0 points, you earn demerit points along the way. Savvy? W0rp3D
when does the 1 point expire? if it expires soon, just pay the fine AFTER you get ur points back. From my research (i was in the same situation) once you pay the fine the points will be back dated and you will still lose your license for 6 months. Birds
Yep, points count for the day of offence and are recorded as such. Otherwise you could delay payment of the fine by constantly nominating another driver and receiving fine re-issues until you have a spare point to give up. Thanx guys. Oh and this was last year when i couldn't find my license. So for the past year I've had a clean record and 12 points! The milky bars are on me!! But if my offence was in Jan 10, then I'd be on 4 points for 12 months and 5 in total right? Another thing, lets say I was to get off my P's now, does that mean I have 10 points left or do I start it clean with 12?
