Technically the cops arent allowed to impound your car if it is on your private property. Like in your drvievway, if its on the street they can.

I'm sure they could take it if he didn't offer it, court order, warrant etc. It would only dig his hole deeper for not cooperating.

He has to take it to the depot himself...wonder if he'll get charged $300 odd like me and the other guy did.

The cops apparently got his plates as they're personalized and he was infront of the guy who was infront of me that got done, but I have a feeling the other guy may have dobbed him in or accidentally told them (hes abit dopey). As I said in the first post the officers said "trick your mate into coming back here and we'll go easy on you" thats him, I just said I didnt know him well, friend of a friend, etc.

I plan on lawyering up, have been in contact with Michael from MK Law, seems like a top bloke, decent price, so far so good, have to wait for summons to really start sorting shit out though. As for the other guys, one wants to go it alone without a lawyer, the other I'm not sure what he wants to do.

Call your lawyer and see what he says, he might have to put something in place to stop them from erasing it after 28 days just in case the summons has not arrived by then.

Any updates? I got defected for the 5th freaken time....starting to freaken piss me off.

5th time huh, and let me guess, you are going to put everything back to stock to clear it and then put all your defect items back on again, maybe you should look at options to make your mods legal and get rid of the ones that are not needed and attract attention.

The guy who got away and then later notified his car is going to get impounded and him get charged went down to east melbourne police station yesturday to give his statement. The officers said it will most likely be a fine, maybe suspended license and the whole thing was a petty issue. He wasn't too clear on what they are charging us on, he said they said something to do with running a red (because of the hook turn), however I don't see how that warrants a court appearance so there would be more too it. He come back feeling really good about it, I told him he doesn't realise they just tell him what he wants to hear then they will dirty up their act in court. Havn't heard from Melbourne council about CCTV it's been nearly 2 weeks, so I'll be giving them another call monday, then if no response or action is taken I'll talk to my lawyer about it and get him to make them chase it up.

The officers also said it was 7 officers word against ours. Complete bullshit, only 2 were in the car following us, the other 4-5 were only there after we'd been pulled over. There was nothing to see going through St Kilda road, Exhibition st or Bourke st and until that hook turn at Bourke and Russell St.

All I can do really is wait for a summonds in the mail, spoke to a local officer the other day, he said it could take anywhere up to 12 months for it and also said that could work in my favour - show I've been on my best behaviour since... although the only thing I've been done for was speeding 25Km/h over which was over 12months ago...but I guess that will probably still go against me.

Since I've been caught I see so many morons out there, speeding, "dragging", doing fully sick skids, and I think how the f**k did I get done for dragging racing from a dodgy hook turn and these people get away with blue murder.

In the mean time you need to create a paper trail, don't just call the Melbourne City Council remember people are slack, sent them off an email making a request cc to your solicitor as well, it looks better down the track like you made some sort of effort and it may stick a boot in there ass and get them moving.

This is the one key thing to save all the drama's... I'd be ringing each and everyday until it's done, lawyer chasing from day one etc etc.

Footage will be the only thing to save you as mark my words, the cops WILL lie in court as a group. I've been subjected to it a couple of times so you need anything you can get to back you up

Yes I have also had cops blatently lie in court. Even so far as to say out loud to the magistrate that we said this and that in our recorded statements when we had not - and could prove so with our own copies.

Our lawyer was adamant we should cop it on the chin for the minimum penalty and not waste court time for something so petty, so we were not able defend ourselves.

Seriously as the other guys have said - GET YOUR LAWYER TO OBTAIN THE VIDEO FOOTAGE! It will be the only way you can prove your case... once it is gone you might as well just cop it all on the chin.

Going to court without a lawyer is case suicide. Always, always get legal advice for any matter heard by a court. Even most lawyers don't represent themselves in court. You're not allowing much time at all for case briefing - as has been said, get on it already. The court will also take into account your inaction on the issue if there is no evidence of you making an effort to get things done in a timely manner...this will work against you.

Don't just take "we'll call you when we find something" from your enquiries...because people could not give less of a shit about your sympathy case. You need to bring in the big guns from the start.
