So I've got my car advertised in a few places, just seeing what sort of figure I can get for it.

I've had 3 people test drive it so far and 2 of them have gotten fines!!

I usually do the whole "give me keys to your car and your wallet" while they go and drive my vehicle for 5-10 mins.

In hindsight, a very foolish thing to do. But regardless, I've filled out the declerations and will be chasing up a JP to sign them in the next couple of days. All I know about the people that drove my car is their first names. I don't know where they're from, what their surnames are, what they do for a living. Nothing.

The problem is, i don't have the best driving record and I'm worried they're just going to think I'm making shit up and I'll get in trouble anyway. Which would be a massive problem as I'm on a prohibited license at the moment and though its my "full license", I only have one demerit point.

If I was to cop more points due to the stupid actions of idiots driving my car I would devastated and it would mean (at least) 12 months loss of license (i think).

What can I do? Or, what should I do?

How did the people contact you? Can you not get in contact with them back? I know most are not likely to admit they got the fine and give you there details but you can try.

Personally, id be seeking legal advice. You might end up in front a judge, with proof you have had the car advertised from date xx/xx/xxxx and the judge may reason with you and possibly just give you a slap on the wrist. In hindsight, they could not believe your story for one iota and off to the bustop you go... Sucks to hear about this mate. When i last sold a car i didn't let them test drive it without me in the car but for not one person but two, to get fines, and i assume not purchase the car, its really a kick in the teeth isnt it.

They with many people on this forum are heaps going to believe you...

ballsy to just let someone take your car? wtf :S

in all honesty, you've put yourself in a difficult situation and i'd think that the easiest way to go forward would be to sign a stat dec saying it was a family member/friend driving, then pay the fines for them plus reimbursement for their demerit points

i guess it comes down to how much you value your license, will be a big stretch for a judge to believe you with a bad driving history and that you were silly enough to let someone take your car without you

I think it will be hard for you to prove it considering you wouldn't have a contract signed etc, like when you test drive a car in a car yard, unless you can contact them and ask to pay/ take the points I don't think the odds are in your favour. You may be better off asking family members to take the points and pay the fines... Hope it works out mate

These are camera fines obviously, get the photos of them...hopefully there's a noticable difference in the driver's stature in the photo and hopefully you don't have tinted windows. That way you can atleast have some evidence to deny it was you driving at the time, even if you can't find the driver/s responsible.

I would not let anyone take my car without me in it (the car and keys they leave behind could be stolen). In NZ your car can be seized immediately and impounded for three months for exceeding the speed limit by more than 50km/hr regardless of whether or not the driver owns the vehicle (not that hard to do 100km/hr in a city zone) so I would be laying down the law to any test pilots. Also I would want to see their driving licence and write down their details before letting them near the wheel.

Regarding the tickets get a copy of the relevant legislation (may be in the small print on the ticket) and/or see a lawyer. For example on a speeding ticket i have it says "You give a statutory declaration

1. Identifying the driver, by giving the name and address of the driver or such other particulars within your knowledge as may lead to the identification of the driver; or

2. Establishing that you could not identify the driver, after taking all reasonable steps to do so"

This could include supply to the police any numbers which may be left on your cell phone if they are from the culprits. You could also supply copies of any for sale ads etc to back up ypour explanation.
