There is no straight forward law as there are many factors in all collisions.

The law does not exist.

My mate is a cop and has just confirmed by SMS that there is no such law but a set of rules

that must take in all factors of the law.

So you make that what you will but there is still no straight forward rule

stating the driver at rear is at fault.

Dont really want to enter into an argument here but the purpose of the Traffic Rules and accompanying regulations is quite clear

and given the circumstances of this accident if they are reported correct, a Taxi driver drove into the rear of a car which had stopped as lawfully required for a red traffic light, its pretty near inconceivable that any court would find the driver of the vehicle in front, to be in the wrong given these circumstances

I've had years of frontline Police experience, and now work for the Justice Dept and do have some idea of what I'm talking about too.

Your mate is correct that all circumstances have to be looked at but from what I'v read here so far the circumstances are pretty clear

Ok guy,

Went to pick up car this arvo from the panel beater. (5pm)

when i pick up the car, briefly look at the rear section where i got hit, looks okay, everything looks fine around the car.

friend says he want to test drive it, so my friend help me to drove back the car, and i drive my gf's car back to city.

stuck on Kings Way for a while.(6pm)

then went we arv at the car park, i sit in the car and notice a big arse crack (approx 20cm) on the front windscreen... from the bottom right all the way cross the middle. the impact point its below the bonnet so its definitly not sandblast for sure.

my friend say he didnt notice while driving back city as its kinda dark too...

called up the panel beater straight away, but as its almost 7pm so they closed, left voice message on their answer machine...

i am just conerning becauses i didnt notice the crack when i pick up the car at panel shop, until 2 hrs later....again will call them first thing in the morning about this matter....

how likely i would be getting the windscreen replace from them? and is it easy to source it in Melb?
