Nah from an insurance POV the Mazda would be at fault due to the bike already being in the lane. The driver of the Mazda should be aware of his surroundings at all times when merging and not just in the prior head check.

Bike hasn't done anything wrong by going in the next lane and speeding up.

ahhh yes. undertakes a car (illegal) then blames car driver because when he looked it was clear.....

waits for shit storm...

Passing on the left on a multi-lane road is not undertaking and perfectly legal

Passing on the left on a multi-lane road is not undertaking and perfectly legal

and this is why the drivers in australia are some of the worst in the developed world.

also last bit of trolling for the day.....

The rider of a bicycle must not ride past, or

overtake, to the left of a vehicle that is turning left
and is giving a left change of direction signal.
technically the car was doing this as he got level with it. so in the eyes of the law he is undertaking and therefor in the wrong....

Whilst I fully agree, I must give in to my inner Ozzy and tell you to 'Gobackhomethen you pommy git' :P

i love ya man! and you know im more aussie than you, cos chevy, but this is ridiculous man... the bike isnt even in the left of his lane! i agree with birds on this one...

May as well keep feeding the troll...

Do you not understand "And"? The car is not turning left -and- giving a left change of direction signal, he's changing lanes.

And most developed countries have the same rule, except it's for passing on the right for the LHD countries.

Yes the bike could have positioned himself better, but doesn't make how he rode illegal

Also he started changing lanes prior to indicating, so still the driver is in the wrong.

True dat.

The first thing I got taught in the HART rider training course was to never sit in a drivers blind spot, and to never travel in the left lane. Car drivers have issues seeing a bus let alone a motorbike in their left mirror.
