Yeh it's this. There's stupid loopholes that allow them to get away with it. If the car is registered they can defect if, even if its on a driveway. If they have the believe that it'll be driven on public roads( which they do due to registration) then they can defect it. Technically shopping centre car parks are private property, they'd still defect you there.. What difference does your driveway make.. It's shit, but that's Vic

same as ay ay ron said, if its not behind a locked gate/garage door OR on another vehicle/trailer then its fair game.

if its being towed on a car trailer/flat bed (or even parked stationary), they can defect the flat bed or the trailer but not the car on it, thats how the rules work here #summernatsdefectavoidancetactics

Does someone actually have any legal reference to back this up?

This was discussed on another forum I read, and some lawyer girl replied this this when discussing driveways and the road rules which may apply to a residential driveway being a public place:

a. Umm no, it is about inspecting the Roadworthy condition on private residential property.

q. Which road rules are you talking about? Because many of the road rules do apply regardless of where you are.

a. Road rules do not apply on private residential property, they only apply on roads and road related areas (as defined by your state).

Go ask your legal team Aaron, say this stubborn Asian guy that says you can't reposses the car as its on private property

Though I'm assuming you guys can becuase something to do with taking back something that is now your property due to default payments

The Driveway leading up to the council footpath is Public property

Beyond the footpath, the Driveway on your land inside the 'boundaries' of your property is private property

My brothers problem is probably that he was seen driving it 15 mins prior, I'm guessing considering the timing.

But still, you get home in a skyline and you think you're safe, maybe not now days.

Don't get me wrong, I used to love skylines but thank f**k I don't own one of these things anymore, I just couldn't handle the headf**ks sooo annoying and too busy stressing about defects / EPAs rather than enjoying the car when driving it. #subtlefordfanboy/bogan

BaaaaaAM. We can repo from behind an unlocked gate, even on private property. But if its locked we need a warrant.

I doubt the police wouldn't be able to If we can..

NZ is worse, lol we can physically break into the house without a warrant and do as much damage as we want to the lock/door/gate/garage to recover our assets lol
