-_- Give me a break. It's been my dream car since I was a little kid selling all my brothers cars on Gran Turismo 2 just to buy a skyline.

The idea was to get the GTR roughly 6 months before getting my blacks so I could maybe work on it a little. To own a R32 GTR would complete my life.

Was planning on getting an exemption. I would like to try and possibly be as legal as possible. I'm thinking if I were to throw on L plates and drive with my brother who has his blacks, would that be legal? In the case that he is taking me on a few "lessons".

What do you mean by cover?

if you are driving a restricted vehicle on your P's then the insurance company may give you a policy (so the car is insured), however in the event of a crash they may simply refuse to pay out. meaning you effectively have no insurance. if someone

as for getting an exemption, i don't like your chances. "it's been my dream to own one" isn't a valid excuse. you got your licence well after the laws came into effect, so no chance of saying you owned the car before the laws came into effect, and you are buying the car once you already have a licence, so it shows that you bought the car knowing full well that you couldn't drive it. long story short, you have bugger all chance of getting an exemption.

Low goals? Come on... It's one of the best things I've ever looked forward to. All of my friends and such are excited as shit to be 18, I couldn't really give a damn. I'm more excited for a GTR :D

I think the loopholes still work... Well I'm pretty sure they do, even though the 'loophole' is something I'd legitimately like to do. Don't want to reveal too much though :/

the loopholes in the system are being closed all the time. if it was a loophole that was around a few years ago then you can pretty much garantee that it will be closed by now.

Fair enough, well It's worth a try I suppose. I have nothing to lose. Otherwise it will just have to wait. I'll have 2 whole years to muck around with it :P

I have been sent a fine for negligent driving and only just received it today from the police. The fine incurred a $353 fine and from what I've been told it's 3 demerit points... I don't see what I had actually done wrong, so why am I being fined? Can I argue against this?

Well for them to send you a fine after being t-boned in a roundabout by someone who was supposed to give way to you seems rediculous. This indicates to me that either you have not been honest in what you have told us here or there has been a mistake.

If the other car was already in the roundabout before you entered, then you are stupid and it was your fault. If you were approaching the roundabout speeding (and they can prove it), then it is your fault. If you were driving normally, entered the roundabout as normal, the other car did not give way and crashed into the side of you, his fault and you should argue it.

If this situation was as simple as it looks on your drawing and on the location of the damage on your car, then it would be cut and dry, other car at fault. Thats why I think there is more to this than you are letting on.

There's nothing else to it :/ Both the police officers which were taking care of the situation both seemed to know what happened just by looking at it and given my story which is literally the only story they can base the accident off of as "He NEVER seen me".

He did either not stop where he was suppose to (kept rolling, entered the roundabout and never? looked)

He seen me and thought, ahh he will wait for me... (still not giving way)

As I've stated many times, it was too late to avoid collision all together so I tried to make it as bare minimal of an impact as I could, and as you can tell by the impact, he must of had his foot down...

I even said to my friend in the passenger a second before it happened, "What the f$&k is this guy (bang) doing?"

As for the fine, apparently EVERYONE gets them, but no one bothers to fight it. I'm definately fighting it.

My friend had a car accident a few months ago, he was exiting a car park, and it's sort of like a cork screw, roads were wet. The back end slipped out, 180 and hit the gutter, screwing the control arm.

5 minutes later a police officer arrived. 10 minutes later a police officer also lost it around the same bend. My friend still received negligent driving...

No I did not.

I have been advised on a few good solicitors so I'll get onto that asap.

EDIT: Received a response from State Debt Recovery:

'

We are yet to receive the details of your penalty notice from the issuing authority. Once we receive the information we will place your penalty on hold and refer your email to the appropriate unit for processing. This may take several weeks. We apologise for any inconvenience this may cause. '

So are they telling me my demerit points won't be deducted yet? and the fine won't raise in price?

Sorry to hear about your loss, and to cop a neg driving fine on top of it is a pain. The only thing I could think as to why the cops gave you a neg driving fine would be if you told them the other driver was stationary in the middle of the roundabout then in their reckoning the onus would have been on you to avoid hitting the stationary car. I guess it depends a lot on the honesty of the other driver as he might of lied and claimed that he and you both entered the roundabout at the same time and claimed you were speeding so he braked to a stop to avoid a collision.

Hope he didn't lie and owns up to it but in case he has lied then best of luck with getting it all sorted.

And yes definately argue against it.

If the insurance company did not charge you an excess then, in their eyes, the other driver was at fault. I would not be stressing about this too much. It must simply be an error.

Oh wait, did Julia Gillard recently announce a "getting t-boned in a round-a-bout tax"??? Look at the fine again, maybe thats what this is, or Officer Plod didnt quite make his ticket quota last month and thaught he would give this a try.

Well I have several witnesses him admitting fault. Also the damage suggests he NEVER attempted to brake, how do you get that type of tbone damage doing 10k's, you get what I'm saying? It appears he had his foot down at some point.

I would say his insurer didn't charge an excess because he is going through a solicitor and have not seen the police report.

Plenty of people change their story after the cop the fine but the police report will have both testimonies.

I got the insurance payout before I even received the fine so it makes no sense :/

I want to know who the insurance company representing the other driver is then! I will sign up with them today, if they are willing to pay out and accept responsibilty for both vehicles before the 'at fault' driver has even been identified.

So what you are saying is, that once it comes out that the OP is actually the one at fault in the accident, the insurance companies will then be sueing him to reclaim their costs?

Does the insurance company that you work for generally pay out large sums of money before establishing that they are contractually required to do so? I am pretty sure that a negligent driving charge would normally be enough for the insurance companies to challange payment. What if the police report, that they have not yet seen, states that the OP was drunk out of his mind, no drivers licence, only 3 wheels on the car and travelling at 490kph through the roundabout???
