Can't get victim of crime as its basically only for like bodily harm etc, can ask to seek compensation though from the alleged to get things fixed etc do just have to wait until the cops give me a call to come get it I guess

A lot of you may remember years ago when the laws first changed from an automatic theft charge to an illegal use charge (much softer penalty, if any).

...and it's all because some smart arsed lawyer set a precedent in place by successfully defending some little thieving prick by convincing the judge that he merely 'borrowed the car' and had full intention of returning it.....what a load of cock!!

That does indeed suck, but I wonder if a decent lawyer can't prove that he wasnt intending to give it back, since it was already stripped... in that case it may open up a precedent that it is in fact a crime, and the psychological trauma of having ones pride and joy violated (not to mention the inconvenience) wouldn't warrant compensation? Granted it'd be a very very low compensation but still something is better than nothing - and compensation lawyers generally work for any case even if it gets rejected, as the crown pays their expenses for compensation claims (even if they represent you and you lose, they get paid)

-D

Edit>

I can only speak for myself but what ever parts you get back I'm sure a few of us will be willing to come lend a hand helping you put shit back together and have a chin wag

+1 yeah if theres anything I have that can be used, I'll help out...

God there is some scum in this world. I wonder if he’s behind any more of the cars going missing around town? Good news you got it back though, hopefully it’s not too painful getting it running again.

Regarding the compliance plate, does that write the vehicle off or do SAPOL just not worry about that (I'm hoping they dont)? Just when mine was stolen a few weeks ago I had to check compliance plate and sticker straight away and if it’s ripped off then its voided (just what I told).

Good news on getting it back. my guess is that the cops only found it because they were raiding the house for drugs.

unfortunately my 32 GTR is still missing since Oct 6th :(

Who are theas guys http://www.rtsengineering.com.au/ are they good know there shit? i have a veilside/endlessR 32 GTR that i might try and get on the road?

:whistling: haha yeah its a pretty cool sig tho

how the fk could a lawyer argue that someone stole something with the intention of returning it??? Its clearly stealing cars, stripping and re-birthing.

Only if their services have been engaged as a result of a successful application to the government for Legal Aid. The legal services commission do have their own lawyers, but under certain scenarios I believe they can engage a private firm to act on their behalf. Legal Aid only gets involved if they believe you case has serious merit.

Simple....they even gave it a name...It's called a "Joyride"....therefore (according to existing law) it's not technically theft.

As I said earlier, this is a different case because parts were stripped off the vehicle and it wasn't abandoned.

Do what does it mean I can do?

If its the original Japanese Vin plate (The one with your original japanese vin BNR32-****** and other fine details) thats going to be hard to get a hold of. Hopefuly they can search for it if it was not thrown away but i work for Nissan and have never been asked for one and hope i never do hahahaha. It would just be so difficult to get ask someone where to order it from.

What types of security did your car have without going into fine deatils and specs over forums? (i.e. immobiliser ect ect)

    • Nah no bearings, just slip fit.  Would be a reasonably challenging but not impossible job to modify it to run bearings but I'm hoping that's not necessary as I may have well built one myself if I end up spending hours modifying it!
    • Brumbys with good shells are bloody expensive, I've looked at 2 "cheaper" cars, and walked away from both,  plus after some research spare parts are fairly sparce I'm starting to think that I missed the boat on finding a clean one that is straight (ish) and without alot rust I'm starting to think about a old Hilux as panels and other parts are much more available as they sold tens of thousands of them I use to be indecisive but now I'm not sure
    • A Brumby would probably fit a big metal toolbox in the back... this is how it begins
    • Picked up a new OEM boot seal for the MX5 today as the old one got ripped a bit by me being a idiot by seeing if I could fit a large metal tool box in it, it didn't fit, and ripped the seal with the corner of the tool box I am still waiting on time to get the cams and new balancer installed, as well as the repairs to the boot Time will not be an issue soon though
