wilorichie Posted February 10, 2012 Share Posted February 10, 2012 Hey Guys Firstly, this isn't about a dodgey buyer or anything. Money isn't the problem (Sorted already)! A nice young fellow (Like myself! ) has just purchased my car from interstate. He arrives in Brisbane on the 3rd of March (to live here) but currently has family living here. After reading the transfer of registration papers, it doesn't seem to out of the way to have his family come and pick-up the car rather than me waiting 3 weeks. He said he doesn't mind either way. But I would much prefer for things to move along a bit faster because we need to sort out our new car as well. This is what I have planned in my head. 1. Receive a signed document from him stating he wants XXXXX to pick-up the car on his behalf and store it at their own choice of location. At which that point the car is no longer my responsibility or under my ownership. 2. Make the receipt for the buyer stating the usual details about the car being sold. State that the car is being pick-up by XXXX (above) person on behalf of the buyer. Usual details.. car/date/time etc.. 3. XXXX comes and picks up the car. Stores it at their own home for the buyer. 4. Once the buyer arrives in Brisbane, have him meet-up with me again to sign the registration papers. The buyer can then change official ownership of the rego. Number 4 is the part that is worrying me. How long does the buyer have to change registration to his own name once the car is sold to him? I'm not so much worried about them taking a fine under my name etc... as I will have a signed receipt stating they purchased the car on this date @ this time. OR I have the above steps completely wrong and someone is willing to enlighten me ! I'll call up Dept. of Transport on Monday if no one is able to help... but being able to get organised during the weekend would be a big plus for me. If it is the same as Vic (which won't be because Vic is full of Jews) then you have 30 days from sale to re registration. But isn't it only official once those sales papers have been signed or will that be signed prior to pickup? Also, how old is the guy? Can't a family member register a car on you're behalf? I swear I've read it somewhere and I swear my mum did it for me when I was on deployment one time. Different avenues to explore. It does say that a family member can register the car, but it needs his signature on the same papers. That is why I have left it at step 4 To my understanding, the car is officially his once the receipt is signed. But the registration is still under my name. That said, to the QLD Government, I THINK, registration and ownership should not be the same. So I want him to "OWN" the car before he gets here in 3 weeks. Then, when he arrives, I'll happily sign the papers for registration. I am hoping this can be done... I really appreciate your input. Lets say they run a red light camera and do 100kph through the Clem 7 and guess who gets the tickets? A written document signed or not wont help, you need to sign and date the rego transfer papers the day the car drives away. You keep one page which shows the date of release and who it was too, incase this very thing happens. They then have 2 weeks to go to the transport dept to pay the transfer fee's. Doing it any other way and your open to being bent over... Just take his deposit and hold the car until he is ready to do it right... Or he signs a Power Of Attorney form for his family member to sign all forms on his behalf. This allows all paperwork and money payment to be expedited and then you can happily arrange your next car! He can fill out a Power Of Attorney to be valid for just a certain window period if he wishes. I know he could also state "Power to help process registration of car to my name" so all that person can do is specifically that task on behalf of that person. Missileman Posted February 11, 2012 Share Posted February 11, 2012 (edited) If the family here in bne is father/mother/gran then sell it to them, then when they transfer the registration over to him, they declare it a gift and no duty is payable, they only have to fork out for another safety certificate. mad082 Posted February 11, 2012 Share Posted February 11, 2012 as said above by others, the big issue is with not having someones licence info on the transfer papers the day you hand the car over, so if they do something naughty you can't fully deny it was you (not in the same way you can with signing transfer papers properly). when i bought a car off a mate a few years back, he was working away a few weeks at a time so his mum essentially bought the car. she filled out all her details on the rego form and registered the car into her name and then gifted it to my mate when he was next home. it is the simplest and safest thing to do from your point of view.
