Thank you guys, i am getting my car repaired now as is, cause i have run out of rego since i was waiting for their long ass reply. So now i need to repair out of my own pocket and have to go through blue slip etc for rego.

I will talk to a lawyer on the weekend, and then i will sit down and have a chat with rms and see what i can get done.

Thanks for the help, if there are any more ideas out there, throw em in here

Also try finding their " road management plan" in vic they have these for most councils.

Might be a useful tool against their reply.

Ie My council have a 6 monthly inspection timeframe. Regular yes,only 6 monthly. After heavy rain and truck traffic potholes appear and they're aware of this.

They do have a duty of care for you the user of their roads.

Couldn't find the surry hills one online though.

Search councils duty of care road.

Hi Everyone,

I came across this forum and thread while scouring the interweb for a solution to repair my Rs4s which has suffered the same fate as the OP's car. Hence this is my first post.

I bought my Stagea 2 weeks ago. I was driving through Morpeth (Hunter Valley) last Sunday morning and hit a canyon where council had laid pipes under the road and only semi filled but not resealed the void. Basically the ditch in the spanning the width of the road was deep enough so that when I went over it my HICAS unit got mangled....yay

Luckily the car was still drivable albeit very slowly so I could get it home which was only 15ks away. It handled like the rear tyres were made of marshmallow and the tyres scrubbed in the wheel arch even going over slight bumps. It has lowered suspension and when the HICAS unit became dislodged the rear dropped even further.

I have ordered a replacement rack including the HICAS unit which should arrive next week. I plan on doing the transplant myself. I know nothing about cars however I do have a technical background. I bought this car because I want to learn.

Can anyone advise what I am in for? Are there any tips or ticks I should be aware of before i undertake such an operation?

BTW.... I have only been poking around for a few hours and can see that the forum community is a wealth of knowledge.

UPDATE!!!!

Finally got through to the RMS, sending more and more pictures and writing them back some slightly angry letters at how upset i was and it is their liability to make roads safe etc etc.

Turns out that other people contacted me a 2-3months after this happened stating the same thing happened to their car.

They also sent damage pictures and filed complaint which did help me back up my case.

SOOOOOOOOO, finally today, i receive a cheque in the mail today for a bit over $1k, while it is still a decent amount of cash, it is close to nothing compared to what i have spent on fixing the car, it being off road, rego running out etc etc.

getting a new rack, powdercoating it, installing it, alignment, blueslip not having a car to drive for 6 months, etc cost me way over the $1k mark.

I do feel lucky though that at least i got some form of reimbursement out of it.

Now i would like to say a BIIIIIIIIIIGGGGG Thank you! to all the people here who have given me advice and helped me out with this major problem.

I would like to say yet again, keep up the great work and you are the reason why this forum is still alive.

and if i do ever meet you guys outside the computer screen, beers on me :D

Good stuff! Hard to get a cent out of sometimes.... Oh bank the money in someone else's account and appeal the payout. They have insurance too, point being imported car special circumstance for higher parts replacement costs... Keep pushing its only stage 1 ( low payout first )

glad to hear you got a resolution!

$1k is better than nothing but if you've got receipts i'd appeal for more moneys

nothing but your effort is going to waste now that you've got your car sorted out

Its on a public road...just outside my work's carpark entrance. In fact there's about 4 of them close together...real fun dodging them...

i hear you wanted to write the council a letter ;) haha.

but seriously, i would report it.

on another serious note, on the way back from work, i just found out that another pothole is forming in one of the lanes. THE SAME KIND THAT KILLED MY SUBFRAME!!!!

So i will be reporting it tomorrow.

i can already see all the scrape marks on the top of the bloody Potbulge

People in my local area paint dotted lines & arrows pointing to the pothole from as far back as is necessary for a driver to see the markings & avoid hitting it.

It provides a valuable service to other road users & seems to have a major affect on the local council. ie they tend to fix them quickly. Win :)

There's a massive lump in the road as you approach the railway overpass bridge in Toongabbie, and the first time I drove over it a few months ago I very nearly got airborne, and the car lifted enough to throw it offline. Mind you, I'd already slowed down enough to turn onto the bridge and the light had just turned green, so I was in no rush...

Might have to break out the fluoro-coloured spray paints and mark the road.

Then we'll see if Blacktown, Holroyd or Parramatta councils will again fight it out to see who's responsible for fixing it (or blame each other for it not being done). That seemed to be their excuse for not upgrading the bridge itself properly... :domokun::rant:

Congrats Jean, but this ^^^ is not a bad idea.

Your traffic lawyer (of which there's a "Traffic Lawyer" thread here in the NSW subforum), can then regard that payout as...

i) an admission of guilt and

ii) an ambit payout only

Terry, I'm not 100% sure, but paying up does not equate to an admission of guilt. They are well within their right to payout to "shut someone up" (as per your ambit payout) while still maintaining that it was not their fault.

    • It's something we all have to consider as time marches on. Also consider lifted rally MX5 conversion at that point.
    • I should be fine for a few more years, whilst I do have arthritis I also exercise and do mobility training every day to keep as fit and healthy as I can, military life, which is the actual cause of most of my joint issues, has set daily regimes, which I weirdly enjoy I also train alot smarter now, not really focusing on lots strength or puffy muscles, I'm more focused on maintaining what I have for my future older self, I actually train as much mobility now as I do exercising Check out this "simple" drill I have been doing daily prior to training now for a while now, this has worked wonders in my all round mobility   
    • I'd say one thing that may make you sell is the same reason the guy with the hard top roof sold his. He got old, and his back was giving him too much grief stopping him getting in and out... Old guy said he was 73! He looked and sounded younger than 73 to me! Or maybe I'm just aligning with old people more...
    • Already looked at a few prior to getting the MX5, really nice car, had all the mod cons, but I wasn't really sold on the new "look" I did miss my 2017 Limited, and I personally prefer the "look" of the older car over the new model, but, when pondering I kept going back looking at MX5's But it was same same for the new ND's, I wasn't sold on the new "look", especially the RF with its weird roof, which only half goes down, like a targa top sort of thing As I stated before, I did look at NC's, but the cars I looked at were PRHT's, but I didn't like their roof line "look" of the PRHT, until I saw the soft top version, (someone on SAU posted a for sale ad for one with a soft top that caught my attention, you can blame them for my choice.....🤣) and.... that old style detachable hard tops were available for them, which keeps the old MX5 more smoother flowing roof line, and the more rounded body style, similar to the NA-NB, to me, the arse end of the ND looks to "modern" Much like how I prefer the NC1 front bar, over the later models How long will I keep this car for is unknown, but currently, there's nothing else out there that "floats my boat" for a small, fun, little "sports car", that I can play with and enjoy looking at and driving But, who knows what the future holds, and going off current new car styling, if I replace it, it will be a older model something something
