Got done for 2 points and like $200 for not wearing my green p-plates. washed them one night

so i took them off and didn't put them back on, drove literally 5 minutes and got pulled over !

, kind of shit house considering a full fledged burnout is like 3 points, i hate it when they try make

you feel guilty over something like not wearing your p-plates, like im driving around naked in

my car or something !

How many were not displayed? I've heard it's 2 points per P plate not displayed.........

But you did take them off and not put them back on ....

I will be representing myself on the day, I've familiarised myself with how the courts work and such, I believe I have a solid chance of getting my license back with the given grounds I've got.

A bit of advice, I assume your young, so the prosecutors will take advantage of this

American court based tv shows is largely different to how local courts are run in Australia

i would more focus on fighting to have the negligent driving charge dropped, not focus on the licensing part, you get this over turned, then your points should be returned

but i STRONGLY suggest to seek professional legal person/s who are EXPERIENCED

but remember if it cannot be afforded then seek legal aid

P plates carries 2 points, whether you have none, 1, or 2 partially displayed.

The RMS will have their own solicitor there in relation to the appeal of the suspension or they will get a police prosecutor to loo after it.

Provisional drivers are in a unique position where they are the only drivers with the ability to appeal a demerit point suspension. You can appeal on hardship or all grounds. In your case you would be appealing on hardship. You could appeal all grounds if one or both of the previous matters were dismissed.

Lodging the appeal late may be your downfall as it may not even get off the ground at the hearing date.

Be polite and well-spoken - this is probably the best advice I can give you now. I mean I don't know you in person, so I can't really say if that's how you are or not, but it's something I'd go with.

If you need to state your case, do so calmly and as concisely as you can.

Character references will help (that describe the defendant and not the case as these will have it excluded) but there is still the nurse who her job is a hard character reference to top in the eyes of the court, done free charity work?

No free charity work :( I did clean up my school garden though last year if that helps? Haha :P

I came on to ask if I should, seen your response :D. I do have both suit and tie, and I will be wearing them. I thought, well it is a formal place so I should dress formally...

Yep, definitely agree with suit - make sure it's a sedate one though, don't want it too flamboyant. The whole idea is to show respect for the court, not to try and get off of things, but because showing respect in court is always good anyway, even if you're just there to watch events for a third party. Have a shave and tame your hair, you wild thing you :)

This was a good read, i look forward to seeing how this pans out. I strongly agree with most of the comments regarding dressing well in a suit, black, and a tie. Definitely be punctual and well mannered, judging by your comments in this thread you seem like an educated bloke so go in there and f*ck shit up.

Due to my appeal being lodged 2 days late, the magistrate could not hear my appeal.

What a waste of f**king time. Mind you, this kid that looked about 15 was discussing with the RMS lawyer him being suspended for 6 months due to going 45k's over the limit and street racing...

Unsuspension date: 14th of November

Well, you've learned for next time: get a lawyer when going to court. They would have told you when the appeal deadline was, what your chances of winning were, and whether you should bother. Still, you gave it your best shot.

    • I've owned a few scooters over the years, a Vespa PX oil burner was my first scooter, followed by a few others, including a little 50cc BeeWee that I used as a barracks bike, and I've had a blast on all of them, they really are the cheapest for of city/suburb transport around The only issue with scooters in Australia is lots of people look down on them due to their size,  maybe they need a big bike to make up for something else where they are lacking, unlike Europe and Asia where every man an their dog owns one, and now that filtering is legal in NSW, local traffic is never a issue Not to say I haven't owned my share of big cc bikes over the years, but they were for more blasting through the hills or Hwy riding where it needed to sit on Hwy speeds Safety wise, I ride like everyone is always trying to kill me, everyone is running a red, or running stop/give way signs, or generally asleep at the wheel, which most people are duringtheir commute, I also ride really safe, and give myself, and everyone else enough room in case I need to pull some hasty evasive actions, I've done a few rider training days over the years, which has come in handy on more than a few occasions  As for mods, there's nothing really, and yes your right about aftermarket exhaust, all you get is loud and obnoxious noises from them, like every 250-300 cc you hear with a aftermarket muffler, in saying this I did put a rear muffler from a 125 Aprilla on one of my old 125 scooters, it was horrendous and no amount of full face helmet and ear plugs would dampen that noise As for coming from the Harley, and what a overpriced POS that was, I no longer do big rides as my poor old busted joints ache after about 1/2 an hour of riding, long cruises are so much more enjoyable now in a car, so a big bike would be pointless   
    • Oh wow, it's easy to forget how cheap these can be. Probably the cheapest way to travel. Though people in cars here tend to be morons and I would not feel very safe. Were scooters ever big in Australia? It used to be the thing growing up in Europe ~20 years ago. 50/70/125ccm Peugeot or Yamaha and some others. Utterly obnoxious Polini race exhausts. Kick stands that slant as much as possible. So loud. So much noise for really not moving very fast at all. But it felt cool at the time. Not sure where I'm going with this, but there is an aftermarket for mopeds! Though I'd have pictured you more for a Goldwing kind of guy after growing out of the Harley.

    • Nah. H2S. H2S is "rotten egg gas", which is what is associated with no cat. SO2 is equally nasty, and if you've ever smelt it you'll know all about it. More of a choking, acid in the back of the throat sort of thing. But you can only smell it in a narrow range up to about 1ppm. Above that, it irritates your mucous membranes, but you don't smell it.
