Hi guys,i need some help and advice

i got a r32 gtr stolen inside my apartment in melbourne CBD in year Feb 2010

they found my car on august 2010.

so i guess i am lucky..

But the car been going through examine the detective said. so he added it might take couple months to go thourgh and ect.

So i don`t bother asking.since the car been found i am more than happy.

But till today i still can not get my car back. he said need to be make as evidence and etc shit...

I just can not win any conversation with this guy.

JUST WONDER ANYONE CAN HELP

I feel for you, but 2 points arouse my suspicions...

1) If your GTR had been comprehensively insured, you should have been paid out by March or April 2010 should you not?

2) Assuming that your GTR was then not insured, (and it's hard to understand why a person wouldn't insure such a car), the police have confiscated your car as evidence to build their case in a criminal matter perhaps?

For some finite closure, methinks you need a lawyer after all this time! After 2+ years even the fuel will be pretty stale!

Definitely get some legal advice; there must be a reasonable amount of time the police are able to hold personal property to build a case.

If your car wasn't used to kill someone, I can't see why they would need it for more than 2 years.

Take the fingerprints, take the pictures & swabs; hand the car back.

Either that or provide a proper explanations as to why that isn't possible.

You are a victim of crime here too; the Police must also serve your interest, not just their own.

Terry: I wasn`t insured my car,cos i planning to sell the car since i imported from japan mid 2009 personally. i am not aware and never this think can happen here in australia,since i was a

student from overseas. that kind of think never cross my mind

Daleo: i forgot to add, they started to re register my car. they change my VIN number,Chassis number. basicly they try to make a new car and sell the car i guess.

i am still looking for a lawyer to meet up and discuss further. Cos the detective not really respond to me. As i am a victim of crime. and i need the car.

syking: yeah mate,i try to speak with the detective, he just keep giving me excuse. a year and another year. i am so f***ing pissed what the hell are they doing and takes so long.

same shit when i called to the office and others would give any answer. Latest answer when i called this morning. he said waiting on court date and office public prosecutions.

Go see a lawyer!!!

A few questions.

Do you have the Police officers details? Badge number? and which Local area Command (don't need to tell us specifics, just a yes is suffice)?

You surely must have spoken to more than just 1 officer?

Did they give you formal documentation and or a Police case number for the break/enter and grand theft auto?

Sounds suss to me that they have done none of this?????

djvoodoo:yes i got all the detail and email history from the detective.

Here is the latest update from the detective.

January 2012

Your car has been seized under warrant at a search warrant.

This matter is now before the courts, the next court date is 05/03/2012.

The car is missing parts and is unable to be registered in its current state. It has been re-birthed (Its identity has been changed)

The car is also an exhibit in relation to a major investigation.

March 2012

The next court dates are as follows:

Mention Melbourne Magistrates Court 21/06/2012

This will be a listing hearing to see if they change their plea to guilty (at this stage they are have not done this) and then: Committal Hearing 28/08/2012 3 Day Hearing

This will be a hearing to test the evidence we have and should a Judge deem this so then the matter will proceed to the County Court some time down the track for a Trial in front of a Jury.

The next court date at the Melbourne Magistrates Court is 28/08/2012.

I am currently on leave until the end of this month.

As I have previously stated to you Iman this matter is before the Courts and the decision in relation to the vehicles seized under warrant will be made by the Judge.

You car has been re-birthed into another vehicle as I have previously explained.

If you would like to come to Court please feel free to attend the Melbourne Magistrates Court on 28/08/2012 at 9.30 am if you would like to see what is happening at Court.

You will however not be required to give evidence on that date.

August 2012

In relation to Operation RECLAIM, involving your motor vehicle.

The next court date is now 6th September 2012 at Melbourne Magistrates Court.

September 2012

Just letting you know the next Court date is 04/10/2012 at Melbourne Magistrates Court.

I am still waiting to hear back from the Office Public Prosecutions with any further information.

Sorry to say this - your car seems to be a net for a big fish.... since not insured, been rebirthed, missing parts seems the car will not be as you expect anyway. Not trying to rain on your parade just that probably not much more you could do on this.... can you see the state of the car as lawyering up might cost more than the value of the car. Seems like you have been given the chance to talk to the Police.... you should take it, tell him you are a victim and are upset, see what he says. He should be honest and might tell you even though it has been found it is a lost cause persueing it further, but rather waiting for it after the case.... rebirthed, uninsurable and maybe unregisterable.
