Hey guys, I'm new to SAU.

Anyway, on friday I bought a new skyline (my first car). Before this I drove my dads automatic nissan pulsar.

On the drive home another driver swerved into my lane on a turn, and I tried to slow down and move out of the way. I lost control and ended up hitting the car. (It was an extremely wet day) Completely f**ked my bumper up and my the cheapest quote I could get was $1416.50 for a new bumper, fog light cover and bumper reinforcement. This was before I could get the car insured and hand in the vehicle transfer papers.

Just thought I'd share my bad luck.

If she came from an adjacent lane into yours, she is still at fault.

Get onto a traffic lawyer.

If you're in NSW, we have a list of traffic lawyers on a "Traffic Lawyer" thread.

Most don't charge for an initial consultation for a few minutes.

If the lawyer thinks that you are not at fault and have the other driver's details, your lawyer can draft a "Letter of Demand" on your behalf and go from there.

Which is why you always arrange a cover note before you pickup a new car.

But if you're not at fault, the other driver pays for your damages?? You don't need to involve your insurance company even if you did have one. Get three quotes, download a 'letter of demand' template and send it to the other parties insurer.

Other option, if the vehicle was still under the previous owner you could see if they feel generous enough to put in a 'not at fault' claim under full comp and nominate you as the driver, but with excess and the fee assosciated with a driver not on the policy, provably would work out much the same.

She's determined it's my fault. Her HBF insurance called me to admit fault, to which I said I'd call them back and talk later. I'm in WA by the way.

Yes Humma, it's only your bad luck if you let her wriggle out of it!

Did you hit her at the rear of the bumper OR on the side of the car?

It's easier for you to prove that you're not at fault if there are scratches on the side of her car.

Good news guys, got a bumper on in 2 days, can finally drive my new r33!

She ended up paying for her car, and I had to pay for mine due to no insurance. Unfortunately me being 17 cuts me no slack. However I have always had a passion for skylines and definitely did not buy it to thrash it!

Dude, that's not how it works.

If she hit your car; SHE is responsible for YOUR damage, as well as her own. It is irrelevant that you have no insurance. Your age is irrelevant.

You did nothing wrong; she pays. The end.
