BIG NEWS: An Australian Court has accepted authenticity of Japanese Registration Certificates provided by JOC

This buyer of a wound back car has received the original Japanese papers from JOC and then went on to win his case in the NSW Civil and Administrative Tribunal. This is a break-through!

Here is the text from the Daily Telegraph:

READER Apurva Mishra has prevailed in his car-clocking crusade. In April, Public Defender reported Mr Mishra was taking action in the NSW Civil and Administrative Tribunal, alleging the imported Lancer he paid Sydney’s Prestige Auto Centre $30,000 for had travelled about three times the 34,000km the odometer said.

The NCAT ruled Prestige Auto Centre had engaged in “misleading and deceptive conduct” and ordered it pay Mr Mishra $18,526.

NCAT senior member Sabine Thode said: “I am satisfied, on the balance of probabilities, that the odometer reading was changed by the respondent or that a third party changed the odometer reading with the knowledge of the respondent in order to mislead or deceive the applicant.”

The NCAT accepted the Japanese Registration Certificate Mr Mishra presented. This is important, as it was bought through a third party, not the registry in Japan, but Mr Mishra was able to demonstrate its authenticity. Until now there has been a question mark over whether such documentation is legitimate.

This result should serve as a warning to any dealer considering winding back odometers.

The dominoes shall fall thanks to the efforts of honest activists like yourselves and victims who are determined to become survivors!

We in the SAU.NSW Exec have been keeping a reference file called "Rogues and Villains" so we can advise Members who wish to receive information...

Even with an $18k payment to the car buyer? I think that would eat most of their margin on the sale of a $30k Lancer. But if only 1 in 5 people take them to court, I guess they may be undeterred.

"Punishment doesn't fit the crime!" - I agree.

Before social media, when hard copy newspapers and tv offered the only exposure, any scamming company could simply pop up a new head like Medusa.

But now with fb and forums, methinks "their name is mud!" > shame, shame, shame.

It's even common knowledge that one of those scamming thugs left two dead rats at an activist's doorstep.

We've all known it's been happening for years, this issue was with us early guys was there was no way of proving it. we just accepted that there was no such thing as an import with legit kms.

Times have changed and there are way to prove every thing now but it's still a case of buyer beware and do your home work and spend the extra time to find the right car

    • What HVAC actuator is under the steering wheel? Do you mean on the RHS of the centre console, immediately to the left of your shin? If so, then yes, it is probably that one, because that is the mode door actuator, and from what I know, it's still a pain in the arse to replace. I don't know about whole dash out, but you certainly have to rip into the centre console section. I don't know if it's covered in the workshop manual, as I haven't spent much time looking at those parts of it. (and by "the workshop manual, I mean the R32 GTR one, which is the most comprehensive one we have, and it should be similar enough between that and later cars to serve as a guide).

    • No I got mine from a friend that had fabricated one … but I had to fit it to my setup which was a hks turbo setup. His was a Garrett -7. So one of my turbos was not a flange for one side … then I had a leak in the welds I had to find a weld shut … in the end the setup was decent priced but I spent a lot to get it fitted. A couple companies I checked would make it but you’re talking 7-9k aud with titanium. No joke mine was 6-7k even second hand after I had to fit it in Hong Kong … labour is expensive here.
    • I'd just like to restate that I don't think anyone here is actually hating I recently sold a car part to a guy who was building a forged auto R34, with MV stall and aiming at ~450kw. I told him that I'm him, from the future and to stop after it explodes once. I told him I knew he won't listen the first time, and that's fine. But if my predictions do come true - Change direction faster than I did. I also said it's probably no coincidence that the dyno plot of a reliable turbo engine starts to look a lot like a N/A motor. :p
