Got booked without specific reason- Not happy at all :(

Recommended Posts

This morning when I went to work I was pulled over by cops. I asked the reason why they pull me off, they just said that they want to check my licence.

Short story after checking my licence the other cop (there were 2 cops) asked me to pop the bonnet and the other start to checking around the car my car. They started to questioned me and start to hassle me.

They looked at the standard intercooler piping (I paint the piping silver) and start saying that it is illegal to change the factory piping ( what the..!!) I convince them that it is factory piping but they didnt believe me.

Then they pointed the intercooler saying it its illegal if not come from factory (mine is factory GTR intercooler with sticker that got Nissan Calsonic writting on it) I pointed to the sticker said that the intercooler is std nissan item and they believe me ;)

They asked about the BOV and ask me to rev the car ( my BOV is quite on low rev because I wind it down so it just sounds loud on full boost), they heard nothing and asked me to rev harder to about 7k RPM while it was start make hissing noise and they said it is noisy, OK I accept that but where in the world one driving daily driven in 7000 rpm all the time but anyway

For short story after they checking everything in the engine bay, interior ( glove box, under the seat, and they lift the mats because they were confident that I have piggy bag comp. but I don't), exhaust, height clearance, etc and they looked at the wheels and start make decision that 18" wheel is illegal for skyline.

I start to argue because I am a motor mechanic, I am doing RWC every day and I am 100 % that the diameter of the rim should not exceed 50mm or 2 inch and the width is no more that 2 inch wider either.

I know I am right so I keep argue with them. They said that they will double check for that and took about 20 mins for them to double check and come up with :" No mate, I think you confuse with insurance rule" ( WHAT THE?)

I had enough argue and i was just shut up because I am pissed off.

I got fined for $169 and I expect they write my ofence specifically but in the infrigement written that my ofence is:

" Use, cause, or permit a vehicle to be used that does not comply with a standard for registration"

Anyone here please explain to me what the meaning of my offence

I guess the answer is my car is not road worthy

However, they did not tell me to supply new RWC, they did not write the specific reason of why my car is not comply with std registration, and they did not give me canary, they just fined me

If the BOV is problem it is not RWC item instead it is EPA matter

If the exhaust is problem, I showed them the EPA test paper

If the intercooler is problem, all std turbo skyline has intercooler and why bigger intercooler is not allowed

If the rims too big, they are just 2 inch bigger

What do you guys think? Pay them or appeal the case

Any comment is appreciated

Sorry for the long post, but this post make me feel lighter

Damn, what wankers of police. They are only there to get you, its F**Kin Obvious. They complained that your intercooler pipes are silver LMAO, that has got to be the most stoopid excuse for ive ever heard. They were right to get you for the BOV, but it doesnt seem like anything else is wrong. Dont bother to appeal it because those cops will always get there way and there is nothing you can really do about it. Bad luck mate, but hey, Shit Happens.

Chris

hey i just got a canary on monday the cop was pretty cool all the others were f***wits he only got me for too loud and too low they saw all the other unroadworthy items like bov, pod filter, front tyres worn on the inside and a few other things and there wasn't any fine also i dont have to get a full roadworthy lucky me i think it would save alot of headaches to just pay the fine. I got fined $75 once for driving whilst i had my arm resting on top of the door (not hanging out)

Can they tell you exactly what you have to fix?

WTF is this bullshit?

Are you perhaps of Asian heritage?

If they told me to rev to 7,000rpm I tell them to fark off - wtf is this crap? I've never even had my motor up that high since the rebuild.

I like your rims btw ;)

T.

bit rich to bust you at that age... think it was because you were asian.. nothing more.. the only time my old car ever got defected in VIC was when my ex-gf (who was asian) was driving it..

cops are wankers in VIC. nice car btw ;)

I'm honestly gonna blow my top if the cops bust me going to and from work - it's not enough that work blows dogs but to **** with your workday???

Appeal it because it's not a valid offense.

T.

:werd: seriously, i would be writing a letter to local member, stating your concern over the direction that state government have encouraged police to pursue, be sure to cc it to plenty of ppl.

I have dowloaded about 80 pages of ADRs for when/if i get pulled over. Im armed with the facts and am pretty good at being a passive aggressive, years of dealing with ppl at work :)

If the stories about Vic police are true and im unlucky enough to cross paths with one of them, well lets just say i have lots of spare time now im in melb and im ready to kick up a fuss if what they ask is unreasonable....in this cae IT IS ;)

I'd love to see you appeal it and cause trouble for those bastards.

However, lets face it, is it worth the effort for $169? Most ppl just pay the fine, same for speeding.

But, if you're pissed off enough and have the time and effort, fight it!

I'd recommend against this approach....you're likely to get reamed. ADR's are Federal engineering requirements mandated by DOTAR's, but roadworthy requirements are state authority specifications. Sure some are ADR based, but many are local requirements. For example in Victoria if your windscreen washer (squirter) doesn't work the car is technically unroadworthy....even if it has just run out of fluid (my brother got pinged for that one...although it was a while ago). So even a brand new car can be 'unroadworthy'...say they forget to fill the washer tank.....

If you must carry any documentation, suggest downloading the appropriate Vehicle Standards Bulletins which are available on the VicRoads website. These give a lot of detail on Vic roadworthy requirments.

surely its an ADR requirement to have working windscreen wipers on a car? I was not aware of any *laws* which are different between states, its just the practice of enforcing them.

I think Steve was doing some research on this?

Aftermarket wheels can be maximum 1 inch larger diameter or width than stock wheels, so the police are in the right.

Tough but its on the vicroads website for everyone to see.

Pointless fighting it unless you got alot of $$ and time in court coz the law state 'In the opinion of the officer' or some shit like that which means even if the pig doesn’t know shit they can defect you if 'in their opinion' they think its unroadworthy. Its just another way the laws have been written so that revenue can be made off innocent people. :)

Also cops will just keep telling you to do things until to tell them to *** off, like telling you to rev ur car to 7000rpm. You don’t have to start ur car or rev it once they pull you over. Only time you need to that anything like that is at an emission centre and by the presence of an approved epa/adr tester, which a dumb donuts snorting cop is no where near being.

People need to read up on what rights they have otherwise the cops will just walk all over you when they pull you over.

do you have a link? I did a search but couldnt find it

the ADRs definately do NOT have a limit on diameter, just width

Yeh i hear you, but by the side of the road ill wear whatever they throw at me. I know my car isnt exactly legal, and admittedly there are things about my car which i know are stupid, yet they are there. If they ping me for that, damn but i deserve it....and the docs i referred to are actually the ones off the Vic roads which also reference some ADRs,

Ii should be given a job by the NSW Police Service as i typically side with them as a rule, but there are always instances where i dont.

When i pick up the head you will see, im a pin up boy for the pocket protector - dork brigade, i have never been troubled by Police and they never give me a 2nd look, im lucky.

So if they get me for my wastegate, cool, perhaps even BOV because i know better and its an easy thing to fix. But if they start having a go because i have blue intercooler pipes, a fixed seat wiht noone in the back seat of my car or an intercooler...then sorry that crap annoys me.

Sydney police are cool, i hear i should prepare myself for the day where i meet vic police on a dark night :) as there will be no saving me. And again if they get me for the wastgate then cool, but i fear they will just see polished turbo / blue - polished pipe and book me :)

There are right and wrong ways of doing things, arguiing with Police is wrong, but i will vent frustrations at ppl that are pulling the strings of the police

I was referring to the windscreen washer and really the point is that even a brand new car can be found 'technically' unroadworthy, it's just a question of how hard they want to look.

As to the laws being the same between states....up until recently, there was no requirement to get an engineers certificate (ie compliance) on 15yo imports to WA. I also believe that WA allows LHD drive cars to be driven over there without conversion to RHD and without a special permit (which is the case in Vic).

Here is some info on complaints. http://www.legalaid.vic.gov.au/main1.cfm?c...&InfopageID=127

If they ever pull you over always for the conversations to be recorded, be polite and ask what reason they have to suspect there are defects on your car. They may only search if there are suspicions of weapons/drugs/defects, but they have to have reasonable suspicions and I will suggest they will go away if you ask the question and they are just fishing. Advise you think you are unfairly singled out and will talk to a lawyer and the Police ethics department.

Thanks for your comment guys

I had a talk with my boss at work, and we discuss about "standard or registration" which is bassically ADR and Roadworthy of vehicle

After we read the latest release of roadworthy regulation book, which is 300 pages,

I found about the rims that it is allowed to change rims 1 inch bigger than what the maximum standard rims that offered by manufacturer for the same make and model of vehicle. So in this case my car is Nissan Skyline, Model: R33, std rims: 16x6.5 , but Nissan offered 17x9 rims for Nissan Skyline GTR R33. My boss think I am Ok with 18 inch rim because the make is same and the model is same. It is like Holden Commodore VT Executive and Holden Commodore VT SS they are the same make(Holden) and model (Commodore VT) but they got 15 inch in exec and 17 inch in SS.

The same regulation apply to the rim width.

I will definetely fight for this as you guys can see I have a valid point (I think) and I it very obvious that the cops that pulled over just want to fish me as they didnt put canary or asked me for RWC or EPA, just asked me to pay the FINE

BTW I am mature age Asian. How do you guys know that I am Asian

From what you guys said that Asian get puuled over more by cops yeah?

However this is the fist time I got booked since I bought skyline (I bought it in mid year 2000)

    • MR HAMMER has said his piece. Painted up to avoid Rusty Rusty. Actually lines up well. (i.e it lines up the same as the unmolested GTR guard). Turns out the GTR Strut brace does foul on the bonnet vents ever so slightly. May need a little bendy bendy if intended to keep using with a strut brace. So spacing it out to clear the FAST102 is not an option. Annoyingly, the bonnet vents also foul on the heater lines running over the engine. Given this engine does not EVER require a heater, a delete loop is going to be used. Don't worry, the defogger uses the AC. The heater is basically "Do not use the aircon and turn the fan on". It will still be effective, I promise.... once I get the system regassed... Will have to revisit with unvented bonnet I suppose, and suitable strut brace. There's plans to do this and other things tonight and bleed brakes (there was a weep) and put the bumper back on, and take Good Friday morning - Because troubleshooting on the side of the road limping it home at midnight tonight is ... not very smart.
    • Thank you all for you assistance. I contacted Nistune regarding the support for the RB20DE along with my ECU Code (23710-10U00). They do have a map for it and added the RB20DE as a purchasable option now as well. They also added Malta as a Billing and Delivery options as this was missing. I was honestly amazed at their quick response and action, it took less than 24 hours. I also looked again at direct fit options for injectors, just in case I were to replace them. DeatschWerks seem to use a Bosch EV14 base and makes ones that fit mine at 440cc lowest, but also have 550cc at the same price. I tried looking for other direct fit options and managed to find one (also Bosch EV14 based) which includes a plug and play adapter on ebay. Did a small test with a Noid Light on the troubled injectors and all seems good, so they are pulsing properly electrically. One weird part is that they are missing on the same two cylinders as before I got the injectors cleaned. Mechanic also found this weird as he did not label the injectors and it is unlikely to have the faulty injectors be installed in the same cylinders.
    • Nice, let me know how you find the 98 tune
    • Put a hand on an injector and see if that's what the buzzing is. You might be triggering the injectors by moving off idle command.
    • Ah, should have been clearer. Currently has a flex sensor installed all good to go.    like u mentioned, I’ve only ever known the car on e85, I might hate 98, but I have to try it out first. Everyone says the -5 turbos get pretty laggy on 98 octane tho…
